Additional comments in regards to Victim of a violent crime failed by the justice system.
Yes, one would think an arrest would have been made to protect an innocent victim. She was never once protected by the police. The one who pulled the trigger, lied to the police, her mother and family. He just sat back and watched us fall to pieces. He tried to get away with attempted murder.
My daughter saw, No Way Out. While she lay in ICU on a breathing machine for 2 weeks, the perp told his side of the story to everybody. He would also never leave her side in fear of the truth being exposed. He kept his story and stuck to it by saying "she shot herself with the double barrel shotgun"......Now dont you think that is Quite impossible !!!!
The Los Banos police dept holds key evidence that could have been used to prosecute the man who shot my daughter.
I was informed by an officer at the scene the District Attorney of Merced County could not prosecute the man who shot her without her testimony. Why Not, if the evidence exposed the truth? She could not have done this to herself. If they had prosecuted right away using her testimony from the beginning, she would not have suffered all of his abuse for the 2 1/2 years that she has been.....
I think someone needs to be accountable for the torture, torment and pshycological warfare she has endured while he gets away with attempted murder?!!!!
I have also asked a police officer, who was at the scene of the crime, "if she would not have made it through being shot, would they have investigated further???"
He said "yes".......then it would have been looked at as a homicide.
Why should she lose everything ( Her face is disfigured, she left her life, to get away from him, in fear of losing it. Her 2 children and 3 sisters life were also threatened. She was terrified!!!
The primacy of prevention should have taken place where negligence rested!!!! Primary Police activities begin during first response to a crime incident and reinforced by secondary responses. Didn't the Los Banos police department find the inconsistent statement a Big Red Flag!!! We are talking about a Firearm that almost blew my daughters head off. There were only 2 adults in the house. The police had all the probable cause they needed with the evidence they collected from the scene of the crime and her first response when she told them. Why did she have to suffer repeatedly at the hands of this man because the los banos police dept didn't do their job....
The LB police dept said to me, "The lack of funding made the decision on if they were to proceed". That is a bunch of crap if I ever heard.

I am the sister of the victim, and daughter of the author of the article. When this happened to my sister, I was the one who answered the phone when the man that shot her called. I remember him telling me a little bit too calmly that "tanya might have tried to shoot herself"...those were his exact words. When my mother drove down to her house to see what had happened I was in shock. I started crying and I got on my knees and started praying...All my life I've looked up to my older sister. She's taught me a lot of valuable lessons in life, so I hold her in high regard. When my mother came back she told me what had happened and the alleged "way" it happened. She told me what the wounds were and that she was still alive. I remember myself thinking ( and I was only eleven) that what had happened wasn't possible for her to do it to herself. I wasn't going to believe that my sister had done this. Later on I didn't know what to think and I just went along with what everybody else was saying about her trying to commit suicide. I didn't know what else to think. I remember talking to her and sometimes being the only one who could understand her because of her trachea. I always thought it was fun how we'd communicate through notes, even though she only did it because it hurt her to speak sometimes. When they got their own house in a really nice neighborhood, she was Miss Mom. I wish that the government or justice system would make this right. They had and have not been doing their job when it comes to stuff like this. I know this isn't anywhere near the severity of what my sisters endured, but when I was living with my father I was walking with some friends a gang came up behind me and started throwing rocks at me...and I don't mean little pebbles and just a small toss...I got hit in the head and pretty hard too. After a pelting of about 10 or 12 rocks, a police car drove by and he could see me getting hit with rocks, all he did was say on their walkie talkie that can be heard out of the police car "Dont do that" and drove off not even looking back. Those kids could have gotten in serious trouble if the right measures would have been taken against them. And the same goes for my sister. The man that did this to her needs to be put in jail. He has done something against the law, and he needs to pay for what he's done.
