[...]Braden converted Godby's bond to an appeals bond. The former chief has 30 days to file an appeal. The judge said he had received letters in support of Godby and said some were the best he had ever received on behalf of a defendant. 

The defense argued Monday that Godby posed no risk to the public and had never received so much as a traffic ticket. Special prosecutor Brian Wright said the Commonwealth opposed probation because the event has had lasting effects on the county and to probate Godby would lessen the violation.

Godby was indicted last fall on charges that he intimidated a witness by threatening a police officer over his statement in an internal investigation and that he committed official misconduct by violating an ordinance against city employees accepting gifts meant to influence their actions.

He was acquitted of a charge of accepting a bribe by taking $1,000 from a local businessman then steering city business to him.

Godby has been on paid suspension since he was charged last October. He became police chief in August 2002.
