Bay Area Filipino Family to Face Deportation on April 7

The undocumented Fremont family that appealed to Sen. Dianne Feinstein, D-Calif., and other legislators for permanent U.S. residence received its deportation letters Monday evening and is scheduled to be sent back to the Philippines on April 7 after living in the United States for 19 years.

The undocumented Fremont family that appealed to Sen. Dianne Feinstein, D-Calif., and other legislators for permanent U.S. residence received its deportation letters Monday evening and is scheduled to be sent back to the Philippines on April 7 after living in the United States for 19 years.

The letters from the Department of Homeland Security ordered them to report to the U.S. Immigration and Customs Enforcement's San Francisco offices on Sansome Street at 8 a.m. on the scheduled date for deportation.

"It's going to take a miracle (to stay)," said Dale Cuevas, 23, the family's adult son. "We are setting up to leave. We're looking into selling the house, doing other things to prepare."

The letters, addressed individually to each family member, read: "A review of your file indicates there is no administrative relief which may be extended to you, and it is now incumbent upon this service to enforce your departure from the United States."

Feinstein's office had advised the family to seek help from other legislators. Howard Gantman, Feinstein's director of communications in Washington, D.C., said she has already sponsored five private bills in the last year.

"These are extremely difficult bills to pass," he said. "We feel right now five is the maximum we can hope for, and we'll be lucky if we get them through (Congress)," he said.

The Cuevases also appealed to Sen. Barbara Boxer, D-Calif., and Rep. Pete Stark, D-Fremont.

UPDATE from Scott Lay: We had great success getting signatures on the petition to Senator Dianne Feinstein requesting assistance with the Cuevas family. Unfortunately, there has been no action from Feinstein’s office. Therefore, we need to put pressure on Barbara Boxer—who faces reelection this November—and the local Congressman, Pete Stark.

This e-mail is only being sent to the 399 people who consented to be contacted with follow-up information about the Cuevas family. Put your thinking caps on folks, we can't allow this to happen, as the family has stood up and asked for help. We must give it to them in whatever ways possible. Hopefully there will be some more direct organizing efforts and am sure there are already, besides just lobbying politicians to intercede, which they don't seem to want to do for one reason or another. Personally Barbara Boxer loses my vote this fall if she doesn't do anything, and I am ready to help organize other folks to take action on this manner(not the voting part, but stopping the deportation somehow).

The Cuevas family do not deserve deportation. Despite the massive support this family has drawn, the effort, finances, and the hard work they have done in their attempt to legalize their stay,no elected official has shown compassion or willingness to assist this family.
The Cuevases have contributed to our community and to the American economy as well.They are productive, hardworking, and honest people.
Senator Feinstein assisted three Mexican families recently.She can no longer offer the same assistance to the Cuevases. Senator Boxer has no intention to assist. She plans to address the issue regarding undocumented immigrants.This was her response when asked regarding the Cuevas family.No government official in their district wants to help.
I hope a great number of voters will remember this come November.

<The Cuevas family has overstayed their tourist visa.I agree, they are wrong.
<On the other hand, they have contibuted to American economy by being homeowners and paying taxes.
<They have been woking hard towards legalizing their stay.The last decade, they had the same lawyer working on their case.I am absolutely sure that had cost them a great deal of money

Am happy for the Cuevas family.I feel better regarding our immigration officials. By granting this hardworking and extremely stressed family, the extension,I finally am able to sense feelings of compassion and sensitivity .
In my opinion, the Cuevases have earned our trust and respect. They have come forward, have spent much of what they have worked for the past nineteen years in their genuine attempt to legalize their stay in our country.
I wish the Cuevases a great life....they most certainly deserve it. The parents have really worked very hard to provide their children the best that they could possibly offer. I know the Cuevas children appreciate their parents considering things have not quite turned out the way we all hoped.

The Cuevas family's problem with immigration is very much publicized. Focus has mostly been on the children. I have sympathy for the three kids,it must be devastating to be taken away from the one place they have known as home. I feel greater sympathy for the parents.They are the ones who have worked all these years to legalize their status, all for the children. At this time in their lives, I am sure if it was just the both of them, they wouldn't have to be this stressed and pressured to get a green card. The Cuevas children are greatly blessed.

Why are the Cuevases being punished for attempting to legalize their U.S. residency?They have done wrong staying illegally after their tourist visas expired, but they have worked hard toward legalizing their status for several years.This most definitely,has taken most of their time and money.The Cuevas parents have proven to be productive and stable and have contributed to our community.

The Cuevases have done a great deal in the attempt to resolve their problem with immigration. Their many supporters have worked hard rallying beind this family in their fight to stay in America. The fact, is - the father and mother had twenty years to find a way to fix and resolve their immigration situation. It appears, that they sat on it, hoping throug "prayers" that their situation will get resolved. How come some folks given even just five years can fix their papers. 20 years, that's a long time!

And now, the kids have to suffer? I think the father, Delfin has been gutless to find a way...

Prayers can not move mountains. Legislation does. Pinoys are in that denial state that makes them believe that things can happen with prayers. Wrong. If I were Delfin Cuevas I would stage a hunger strike and chain himself to the White House gates to find a remedy. If the Cuevas family has enough guts and gumption to stay they should do everything and anything to prove they worthy to be designated as Americans.

Othwise, welcome back to the Philippines. The shithole of Asia where the next President is a lackluster Filipino actor.

Anybody knows who is/are their Lawyer(s)? I am not sure if they did their job supporting this family on their legalization. Just my opinion.

Prayers do help. In my opinion, they have covered all bases in their attempt to legalize their residency in the U.S. As Catholics, we always believe that as long as we do our best, God will take care of the rest. Filipinos are strong in their faith, not dumb and stupid to just rely totally on prayer and not do anything.

The Cuevases had an awakening after they had consulted with other attorneys. Apparently their current lawyer, upon reviewing their case had asked them questions, that made the Cuevases realize that the options, they had previously mentioned with their first lawyer could have given them a better shot at permanent residency.She had given them bad advice .Their first lawyer has caused them this financially straining and nerve wrecking predicament they are in

.The Cuevases should have sought second opinion.They had placed too much trust and faith in their fist lawyer.And after they spent thousands, this incompetent lawyer, am sure has not even offered any type of support to this family.

The Cuevases are honest people. They aspired to get lawful permanent residency the right and honest way.Am sure they have had offers in the past . I know they would have jumped at the opportunity of getting their green card as long as they believed it was legitimate.

The Cuevas parents have worked very hard to legalize their status.I feel for the kids, but the parents' hearts were in the right place, and to this day, they have their children's best interest at heart. After all, their reason they came to this country, is to provide their children a better life.

In view of all the above , I strongly feel, it is unfair to have this family deported.

Legislation has the power to change the Cuevas situation. Apparently, no elected official in this family's district is willing to help.I n this case, we look to the ALMIGHTY...He has the most power over all legislature, government, and the INS.

There is nothing wrong in believing in prayer.And yes, prayer can move mountains. The Cuevases are strong in their faith and trust that God will grant what He deems best for their family.

I very much want to help this family. They have until June 30th to stay in America.I realize the Cuevas parents had nineteen years to resolve their immigration status, however I also believe they really worked hard in their attempt to get permanent residency.

The lawyer they had initially, was incompetent. She had them apply for assylum as opposed to employer/employee, or family petition. I believe the Cuevases had brought up these options.They were advised, seeking assylum was the only way to go.They did migrate to America after the father lost his job due to some political turmoil in the 80's. But during the process, this lawyer had to know, the family's chance of getting their green card was unlikely. So, why persist on the unworkable.She should have explored other options. The Cuevases paid her big bucks to get them to this unbelievably critical phase in their lives...deportation.

The Cuevases sought legal assistance from Mr. Carl Shusterman, he was the one who had advised them to seek legislative assistance. The Cuevas children did a great job in their campaign to stay .They practically took over, determined to put up a fight and not give up on their dream. Legislative assistance was unattainable.

Presently, Mr.J. Lyons, is assisting the Cuevases.He has been unselfishly given them his time , effort,and support . Mr. Lyons accompanied the Cuevases to the immigration office to apply for the extension,for the interview to get the extension, and ultimately.got their stay extended to June 30th. The Cuevases would not be facing deportation if their lawyer was as greatly competent,knowledgeable, devoted, and compassionate as J. Lyons.

So, someone with ideas other than the father going on hunger strike, let it be known. This family do not deserve to be deported.

The first time I saw/heard their situations in the Filipino Channel-it really breaks my heart especially for their children.
I put them in my prayers and following the progress of their case in the television. Even-they've granted a 90-day extension, it is not yet a peace of mind for them--ttheir still battling. But who knows--I beleive that God answers prayer-with HIM there's no impossible!!

It seems like the Cuevas family has given up on a resolution with their immigration problem. Not because they want to but they have no other choice They have been given the ninety day extension for the sole purpose of getting everything packed and settled.

The Cuevas supporters can still put up a fight on behalf of this family.So, anyone with ideas ,is very much needed to communicate via this website.Am sure with prayer, we may be able to help the Cuevases.

After this family has genuinely and honestly attempted to resolve their plight with immigration, I cannot understand why they end up being penalized. Deportation should not happen for the Cuevases.

FOCUS....this , if am right is the organization that has been assisting the Cuevas family. My concern is , now that this family has been given the ninety day extension, has FOCUS and all related support groups given up on helping this family?If this is right, I feel more sympathy for the Cuevases. They should not have come forward at all. Making their case public did them no justice either.
It is a shame that these highly productive, motivated,stable, hardworking, and goodhearted people are not appreciated in this GREAT country.
The Cuevases will find what's best for them. They are a respectable family.More power to them!!!!!

Senator Boxer is being mentioned as the official who has the power to assist this family.The major issue or concern in this aspect is, does she have the compassion and the sensitivity toward this family who broke the law, is she willing to look past the wrongful act and appreciate this family's sincere and genuine effort over several years.

Yes , I know who the incompetent lawyer the Cuevases had. The Cuevases made a huge mistake with consulting, and trusting this lawyer's advice.She should do California residents a favor and cease practicing law. The Cuevases are not her only extremely unfortunate victims.
I t would be fair if they can reopen this family's case with immigration.Their lives have to drastically change because of bad choices and decisions .They paid a great amount of money for legal counsel that only led to deportation.
Despite everybody telling this family to go after this lawyer, the Cuevases have chosen to let things be. I have love and respect for these decent people.

The Cuevas family got extended to June.That is not too far off.I want to remain hopeful for this family, but it does not seem to look too promising.This website mentions Boxer and Stark.I have not heard or read anything humanitarian about either one of them In fact, Senator Boxer was clearly not supportive when asked regarding the Cuevas family.
Miracles can happen. I'll keep them in my prayers. The Cuevases should not be deported.

I completely agree, this family does not deserve to be deported. The Cuevases have proven to be productive residents of our country. Furthermore, they have spent so much time, and money , and have been through multiple rejections in the long stressful process.They did commit a wrongful act overstaying their tourist visa, but they sholud not be punished for coming forward .
I hope and pray this family will find a resolution to their problem with immigration. It is hard to believe no legislator has offered / agreed to assist this family.

The Cuevas situation has opened my eyes to the sad fact that America ,at this point in time has less compassionate legislators. Immigration laws are beyond us, we cannot change them.Legislators have the power to look beyond immigration laws, and change people's lives.
This family has amazingly gained support because they have a history & ongoing record of being hardworking, contributing residents.Even more important, they have exhausted all possible means to legalize their immigration status.

I know the feeling of what this family is going through. My husband was one of the 108 deportees last December. I even had a petition for him way before he was taken. We have 2 girls and I can tell you this has been the hardest months of our lives. We have lost so much emotionally and financially. All I can say is that really push hard on anyone that is handling this type of situation because now I have to fight for him to come back and prove hardship for it. The thing is how much more hardship does one need to prove? No one was prepared for this but then again who would when you thought all this time something was being done about it. Don't give up the fight!!!

I feel for this family and all others who @ any time had or have to be in such a considerably difficult and stressful situation. The sad thing is the people affected are the ones who do not deserve to be punished. It is so unfortunate that lawmakers and legislators cannot appreciate the urgent need of these families to be assisted. I keep reading about new immigration reforms, hopefully, by next year, they will pass congress.
But these families who have come forward, asking for help will no longer be here because they have already been removed.The ones who will benefit will be those who have chosen to remain in hiding, millions , who have not worked as hard and have not spent money, time, and effort to get their immigration status legalized.
The Cuevas family deserves their American dream. I hope they have not given up their fight to stay in this country. I know their supporters have not lost their desire to help these good people.

I have recently heard about other family situations, similar to the Cuevas family. The other families have been given permanent residency. They have less number of years in America, no family member is a green card holder or a citizen.
I am happy for these fortunate families, but how unfair is that??????
The Cuevas family is just as deserving or even more qualified to be given permanent residency.

I totally agree. The Cuevas family has been in America for nineteen years.They have proven to be productive members of our community. They are homeowners, they pay taxes and have contributed to American economy. Their only drawback is that none of them is a green card holder. The other families had less years of being in this country, they too have no green card holder among them. Immigration ,plain and simple, is unfair and unjust.There is no justification with the Cuevas deportation.

I am very hopeful the Democrats' proposal for immigration reforms will benefit the Cuevases.. This family has been working so very hard in their honest and earnest attempt to resolve their undocumented immigration status.They most definitely deserve amnesty or a waiver of the ten year bar. Not only have they spent a large amount of money , they took great risks in the process, and ultimately got themselves unfairly punished with deportation.The Cuevas family do not deseve to be harshly punished.

The Democrats' SOLVE ACT will only be beneficial to the undocumented who will be presently residing in the U.S.at the time it will pass Congress. The Cuevases will no longer be able to avail of amnesty then.I am so very angry with the way things are with this family. It may seem like we have given up on the Cuevas family, but we have not. Our campaign continues and will absolutely remain active even after this family leaves our country. The immigration laws may change, and we are looking to keep the Cuevases in mind , we honestly want this family back in the U.S.!!!!They deserve these immigration reforms much more than those who are in hiding, evading paying taxes,and have not spent anything trying to resolve their undocumented status.

It is wrong and unjust to punish the Cuevas family for trying to resolve their problem with immigration and grant amnesty to the millions of other undocumented who will be able to avail of the immigration reforms when they pass Congress! If these undocumented immigrants have not come forward now, am positive they will,when access to permanent residency will be an option @ no cost and burden to them...money, time, effort , and their American dream.This is extremely unfair!!

This is a major issue that needs to be addressed by our legislators.The injustice done to the Cuevas family is huge!!!

There is no fairness and justice when it comes to immigration laws.
The Cuevases have learned the hard way. They have lost their their American dream despite the fact they did sincerely try every legal and honest route toward resolving their battle with immigration.They could have done what other undocumented immigrants are doing, and they could have availed of whatever immigration reforms will pass Congress.
I totally support this family. If they ultimately are removed from America, they ought to be given special amnesty that will give them another shot at regaining their American dream! They deserve it!!!

1) we have (and will continue to have) a meeting this Sunday at 3:00pm at the New Covenant Presbyterian Church in San Leandro on Fargo Street. We will be planning the major actions for the month.

2) the first major action is that we will be sending a delegation to
Boxer's office next Wednesday June 9 to formally present her with the list of organizational endorsers. We will follow up with a major rally to support the family June 16 and then a final action (if they don't respond favorably) on June 23

3) action: organizations can send their official endorsements to me and on their own, they can send letters of support to Boxer. Individuals can also send their endorsements to me as letter of support to Boxer; if they are not already involved in an organization they can attend the Sunday meetings because this group will eventually transform into an immigrant advocacy group.

I understand the Cuevas family's support group is still trying to reach out to Senator Boxer. Time is running out. My concern is, if and when time has run out, the Cuevases will have to leave. Then what can the support group or the immigrants advocacy do to further assist the Cuevas family.I f and when legislators pass immigration reforms, this family will not be in America ,again they will miss the opportunity toward getting lawful permanent residency. Meanwhile, the ones who have chosen to remain in hiding after witnessing the Cuevas plight with immigration will be the ones to gain from these reforms. My point is, millions will reap from the Cuevases' misfortune.
The Cuevas family does not deserve to be punished with deportation!!!!But if they will end up, being removed, will the support group continue to help them regain the lives they have built in America for nineteen years?

I am very much bothered that this family's battle with immigration has remained unresolved .

I cannot begin to understand why this family is being harshly punished while others can get away with serious crimes.

I totally support the plan of action on behalf of the Cuevas family.
Senator Boxer's legislative intervention is crucial. I hope she can assist the Cuevases like Senator Feinstein recently has, with the other families .Legislators have expressed they are not too keen with private bills because they are no guarantee they will pass congress. There may be no guaranteed resolution from the private bill, but the Cuevas family will be allowed to stay and may be able to qualify for future immigration reforms.For the children , the dream act could be the one.
If they had the compassion and the heart for the other families they had helped, the Cuevas family, very highly deserves it just as well.

June 30th is the most dreaded day for the Cuevas family and their many supporters.It remains highly unacceptable that this family is for deportation inspite of their outstanding history of multiple attempts at resolving their immigration status.The Cuevases need to be recognized for coming forward with their plight with immigration.Sadly, they have been denied legislative assistance, but they have accomplished something, not directly for them but for others who have issues with immigration. This family has opened the eyes of many, has moved us to organize support groups and actively participate to assist people in similar situations.

I recently heard of Senator Feinstein assisting another family.I was not the only one who was confident Feinstein would draft a private bill for the Cuevases. The Cuevas family lost a great deal of time only to be denied help, anyway.
