The Humboldt County DA Recall - A Corporate Affair

Maxxam seeks to set the standard in Humboldt County politics - work in the interest of Corporate Timber or be recalled.
Background

The campaign to recall Humboldt County District Attorney Paul Gallegos has a proud sponsor. Maxxam/Pacific Lumber Co. have funded over 93% of the campaign – a campaign that began just days after the newly elected DA filed a $250 million lawsuit against the timber corporation charging fraud.

When recall proponents found there was little community support to get the recall on the ballot, Pacific Lumber hired a professional signature gathering company, US Petitions, paying them a whopping $8 per signature. Many who signed have come forward claiming signature gatherers, who claimed the petition was against rape or regarding a car tax, misrepresented the petition to them. Nonetheless, enough signatures were gathered and Humboldt County voters will decide on the recall March 2nd.

The Candidates Debate

In the event that DA Paul Gallegos is recalled, voters have a choice between three possible replacements.

Steven Schectman, a civil attorney from Eureka, was the first to enter the race. Schectman is staunchly against the recall, calling the whole thing “abhorrent” due its funding by the DA’s richest defendant. “This recall is bad – bad for everything good Humboldt County stands for,” Schectman said during his opening statements at a debate between the candidates Monday night on the campus of Humboldt State University.

Following Schectman’s lead, long-time deputy DA Worth Dikeman threw his hat in the ring, citing his two decades of experience and his contention that Schectman is an “unacceptable” choice for the office of the District Attorney. At Monday’s debate he said he didn’t want to discuss the merits of the recall because “it’s here,” meaning it’s just a reality we have to deal with. Although Dikeman maintains he is against the recall, he has taken endorsements from several of the county’s law enforcement agencies, which are backing the recall. Sitting side-by-side during the debate, Schectman asked Dikeman to say he is against the recall, and that everyone including law enforcement, should vote ‘NO’ on March 2. “Will you say that now?” Schectman asked. “No,” Dikeman answered.

Third to join the race was Gloria Albin Sheets, an ex deputy DA who worked eight years under the previous DA, Terry Farmer, and who was laid off from the Gallegos DA office because of budget cuts. She is the only candidate who admits to being for the recall, claiming Gallegos is “soft on crime,” a stance taken by recall-backers several months ago as they sought to distance themselves from the obvious reasons for the recall – the lawsuit against Pacific Lumber. Albin Sheets openly criticizes Gallegos, going so far as to say he’s “disgusting” and that he has “grossly mishandled” important cases. She blames this on Gallegos’ lack of experience as a prosecutor. “Mr. Gallegos is a defense attorney,” Albin Sheets said. “He will always be a defense attorney.”

Monday’s debate was held in front of a packed room on the Humboldt State University campus. Questions ranged from whether the candidates would prosecute the fraud case against Pacific Lumber, to which they all said they would, to how they feel about medical marijuana. This being Humboldt County, where it would be political suicide to take a stance against the drug for medicinal purposes, all voiced their support. Albin Sheets said she would recommend it to a friend who was suffering from Parkinson’s. The room erupted in laughter when Schectman pointed out "you have to be a doctor to recommend medical marijuana."

The candidates were also questioned about the controversy surrounding treesitter Jeny Card, also known as Remedy, who was arrested after sitting in a 1,200 year-old redwood for a year, but only received a $10 fine. PL has made this a major reason for their support of the recall, though they did not try to recall former District Attorney Terry Farmer who never pressed charges against Julia “Butterfly” Hill following her treesit of two years and eight days. Dikeman pointed out the many things that have to be taken into consideration – like prior convictions and recidivism. He also noted that the fine for an infraction is set by the state, not the DA.

The disagreements are most pronounced when it comes to the recall itself. It is obvious that without Schectman’s involvement, Dikeman and Albin Sheets would have an easier time sliding their premises by the public that this recall is about Gallegos’s alleged “soft on crime” stance, or Mr. Dikeman’s opinion that the public has a “lack of confidence in the DA’s office,” which he says is evidenced by the 17,000 signatures that got it on the ballot. Schectman maintains that at eight bucks a pop, enough signatures could be gathered to recall any elected official. Albin Sheets, after saying “I don’t care how the recall got on the ballot” was booed by a majority of the audience, who evidently does care.

Following the debate of the candidates, host Dave Silverbrand asked some questions of Paul Gallegos, as did members of the audience. Gallegos described some operational procedures of the DA’s office, and countered allegations leveled by Albin Sheets as being inaccurate. Gallegos pointed out that Pacific Lumber has supplied 93% of the funding to the recall effort, and if you add the contributions of Steve Will’s Trucking, a company contracted exclusively by Pacific Lumber, it comes to 97%.

When asked what affect the recall will have on the community, Gallegos said, “that depends.” If the recall is soundly defeated, elected officials will be confidant in doing their jobs without losing their jobs. If the recall is defeated but is close, elected officials will be cautious in how they do their duties. And if the recall succeeds, there will be a “chilling affect” on officials whose courage will be undermined by fear that they will be recalled if they try to evenly apply the law to corporations and citizens alike.

Gallegos said the two most powerful urges in human beings are sex and fear. “In Hollywood they sell sex and in politics they sell fear," he said. “Fear cannot rule this community.”

Fact: In order to avoid a trial exposing their fraud in the Headwaters deal, MAXXAM subsidiary Pacific Lumber has funneled nearly $70,000 into the campaign to recall DA Paul Gallegos.

Tim Stoen's past has nothing to do with MAXXAM's fraudulent business practices or destruction of the forest. Tim Stoen is not the entity responsible for destroying the forest- MAXXAM is.

MAXXAM continues to clear-cut the forest, cut old-growth, log on steep and unstable slopes and use toxic herbicides.

MAXXAM is ruining water quality and is making life hell for residents who live near their watersheds.

MAXXAM has made it difficult for residents to rely on majour roads for transportation, since flooding and mudslides have increased dramatically due to MAXXAM's destructive logging practices.

MAXXAM's unethical logging practices have placed several animals on the endangered species list.

MAXXAM has permanently altered the state of this country's temperate rainforest and done irreparable damage to it's ecosystem.

Reply: It's not a fact. It is what the court case is about. Or do you believe that someone must be guilty because the cops arrested them. Cops never arrest people who are innocent.

Reply: Changing the D.A. would not make the case "go away" . Pacific Lumber doesn't have enought employees to carry the ellection alone. If the people of the county vote to recall him, it can't be all P.L.

Reply: It isn't against the law to clearcut old growth. You may not like it, but the Heritage Tree Act doen't seen to be getting any traction. PL can not cut on unstable slopes. The geology reports are part of the public record in the THP. So show me where. And again, herbicides are legal. You can buy them at most hardware stores.

FACT: Mr. Stoen's past has as much bearing on the matter as Mr. Hurwitz's past does. History is a two sided sword. If you want to use 19 year old "allegations" against the Company he owns then be ready for the same long lived historical allegations to be used in reference to your friend Stoen.

I was leery of all the candidates but have been relieved to see that one of them has to date shown himself to be honerable. Mr. Dikeman has not joined in the mud slinging nor has he indicated he would cave in to Corporate power. He has simply put himself out there as a qualified and reputable candidate. His campaign is above reproach and his record speaks volumns for his ability and his dedication to this county. He is showing a level of respectibility that has too long been absent in our DA's office.

YES on the recall and yes for Dikeman.

Yes! COPS! ... who risk their lives to help people.... Who see that injured treesitters are carried safely to hospitals at the risk of their own safety in stormy weather on dangerous terrain.... Cops who are enforcing laws only to have their work treated as irrellevant by a DA who has decided to be the lenient judge instead of the prosecutor.

Cops who know that Paul Gallegos would make a good public defense lawyer but in not cutting it as a prosecutor.

Are you trying to say that Mr. Dikeman is bad because the Cops agree he is a good and honerable man with the experience to get the job done in a fair and impartial manner? Or that all Cops are bad?

And those of us who are not in the Timber Industry or Cops, Who are fed up with Enviro Extremeists trying to terrorize the local businesses and act as scofflaws. Who want to see all crimes punished to the fullest extent of the law. Corporate and Tresspassers. Are we bad people too?

When Humboldt cops start "risking their lives" to bust meth houses and wife beaters, instead of the risk-free job of busting treesitters and medical pot growers, they might earn some respect.

Current police behavior of harrassing Eureka business owners with Gallegos signs in their windows does not command respect, only reinforces feelings of bitterness toward thier obvious allegience to Maxxam. This does not lead perceptions of cops being "good and honorable."

Read the Sub-Standard News and you will see they do bust Meth houses and wife beaters and Child molesters They make the arrests
and turn the cases over to the DA's office for prosecution. But the DA either plea bargains the cases away or simply files lesser charges so that justice is not served. They do put themselves out there but it does no good if the DA's office fails to do it's sworn duty.

As for business owners being harrassed for pro Gallegos signs...Funny that has failed to make the news in a paper that is against the recall and takes every opportunity to try to critisize it's proponents. But it is just the type of lies and rumors that his supporters keep thowing out and hoping the public will swallow. If you can't substantiate your claims they are nothing but gossip and slander.

There are too many residents who will tell you different - that calls reporting domestic violence go unanswered by Humboldt "law enforcement." Same with robberies and meth labs. Violence and theft was so out of control in Freshwater, Blue Lake and the surrounding areas that residents called a meeting to figure out what to do in absence of help from police, whose only response was telling residents to "get an alarm."

As for the Eureka business owners, who should they report police harassment to? The very police who are harassing them? Your dismissal of these events does not change what many voting residents know to be true - that the degree of bias and inaction from sheriffs does little to make our community feel safe, or impress us with their support of a Maxxam-sponsored recall of a democratically elected official.

Repetition of unsubstantiated accusations does not make them truth.

IF the residents are not recieving coverage by the Sheriff's department in outlying communities it is not fair to say the department does not care to do it's job. It is, instead time to see WHY they are not able to respond. Could it be lack of funding? Could it be a matter of too few officers to cover too large an area? Would they recieve better coverage with a different sherriff ?

As for your repeated accusation that the Eureka Police are harrassing businesses, I repeat, they should indeed be filing complaints and making certain the problem is well documented IF it is happening. Otherwise it is just another baseless rumor and desperate attempt to smear them because they are proponents of the recall.

Richard Salzman can not stop sending spam out to people telling them to vote NO on the recall. EVEN AFTER THEY REQUESTED NO MORE CONTACT. Paul Gallegos is supported by "outside area support" In fact, Richard Salzman may LIVE here in Trinidad, but "works" in San Fran. So far Salzman will NOT comment on how much work Paul has done in office BEFORE AND AFTER the recall has started, and shut his blog down in FEAR. Gallegos is filing more cases because the COPS are busting more people, not him.

On tuesday the voters of Humboldt County stood up and voted to defend our democray. Looking through the lies and towards the future, our community refused to back the malignant interests of the Maxxam corporation.
We showed that there really can be government for the people, by the people, if the people aren't afraid to say no to corporate corruption. What happened in Humboldt County is a microcosm of what needs to happen from sea to shining sea. We need to take our government out of the hands of a few "good ole boys"-aka corporate america, and put it back in the hands of the people.

What happened Tuesday is called Democracy. It was decided by a majority of the voters that thy did not back a recall. This does NOT mean that all those 61% backed Gallegos or his soft on crime attitude. It means they decided that they were willing to put up with him for now and will be watching him and his office more closely than ever to turn it around and do it right.

It also means that if he continues to go light on criminals those same people will vote him out of that office in the next election when he will no longer be able to hide behind the Palco Lawsuit.

Do not confuse the unwillingness to vote for a recall with satisfaction in his performance. He has a second chance to start prosecuting crimes instead of going soft. Or he can feel smug about his "victory" and continue as he started and we the people will be the ones who will suffer for it.

He needs to get out of the pockets of special interests like EPIC, Earth FIRST etc. and truly serve ALL the Public good. Prosecute Palco....Great! Prosecute treesitters....Great! Prosecute child mollesters...drive by shooters....PLEASE!
