SAN FRANCISCO (AP) - A condemned murderer whose bid for clemency was denied by Gov. Arnold Schwarzenegger won a stay of execution on Monday, hours before he was to be executed.
The 9th U.S. Circuit Court of Appeals granted a request for an 11-judge panel to rehear the case of Kevin Cooper, convicted in 1983 of hacking four people to death. His execution would have been the first in California in two years and is the first death penalty case Schwarzenegger had to deal with.
It was not clear when the panel would hear the latest challenge, which Cooper's attorneys filed Sunday.

A convicted killer who was due to become the first death row inmate to be executed in California under Arnold Schwarzenegger’s rule was granted a stay today.

Kevin Cooper, 46, was due to die by lethal injection early tomorrow, but an appeals court granted a request for an 11-judge re-hearing of the case.

Schwarzenegger had refused a plea for clemency saying the evidence against the quadruple killer was “overwhelming”.

But Cooper’s supporters – including civil rights activist Rev Jesse Jackson and movie star Denzel Washington – said there was new evidence casting doubt on the 1985 conviction.

Cooper was convicted of hacking to death two adults and two children with a knife and hatchet after escaping from a prison in Chino, Southern California, in 1983.

His execution would have been the fourth in California in as many years, but the first one under Republican Schwarzenegger, who was elected last year.

Judge James Browning, in California, said there “should be no hurry to execute Cooper”.

Cooper’s supporters want DNA evidence which was recovered from the crime scene to be re-tested.

Rev Jackson said: “This is not a case of seeking mercy on the philosophy of opposition to the death penalty.” “The outstanding information deserves a hearing.” He said Cooper was at a disadvantage because he is black and poor.

Cooper’s lawyers have released excerpts of statements made by a police informant.

The informant suggested that the quadruple murder was the result of “a hit gone sour” and that Cooper was made a “scapegoat”.

Cooper’s lawyers have also released evidence from a former news reporter.

She said she met the informant by chance in 1997. He told her that evidence was planted and said the murders were a “hit on the wrong family”.

On Saturday three of the jurors who convicted Cooper called for a postponement of the execution, urging new tests on hair and blood evidence.

The sole survivor of the killing spree, Josh Ryen, who was eight-years-old at the time, suggested that there might have been more than one attacker and that they were not black.

But Mr Ryen, who survived despite having his throat slit, has reportedly told Schwarzenegger that he favours Cooper’s execution.

Protesters had gathered outside the prison in San Francisco, where the execution was supposed to happen at 5.01am Irish time tomorrow.

Meanwhile, in Schwarzenegger’s home town of Graz, Austria, about 50 people demonstrated, calling on the governor to stop the execution.

Some protesters wore black arm bands as a sign of mourning.

A leaflet they handed out said: “We condemn Schwarzenegger’s actions.

“One wrong can never be corrected by a second wrong, not even when it’s an ’action prescribed by the state’.” On his campaign website, http://www.savekevincooper.org , Cooper writes that he is going to “murdered by the state”.

He said his execution would be “a continuation of the historic system of capital punishment that all poor people all over this world have been and are subjected to”.

But the mother of one of Cooper’s victims, Mary Ann Hughes, dismissed the last minute appeals.

“This is nothing new. It’s stuff that has been looked at millions of times,” she said.

Describing the appeal by the three jurors, she added: “This is just an example of the defence playing on the jurors emotions at the last minute.”

Protests Continue in California as Execution Nears

OAKLAND, Calif., Feb. 8 — California is set to put to death a man convicted in 1985 of killing four people, in what, barring a reprieve, would be the fourth execution by the state in as many years and the first under Gov. Arnold Schwarzenegger.

The man, Kevin Cooper, is scheduled to die by lethal injection just after midnight on Tuesday. Mr. Cooper, 46, who was convicted of killing two adults and two children after escaping from a prison in Southern California, has maintained his innocence.

Mr. Schwarzenegger, in his first clemency decision, described the evidence against Mr. Cooper as "overwhelming" and said the brutality of the killings — the four victims were hacked to death in a home near the prison in Chino — justified the death sentence.

According to Justice Browning:
"There should be no hurry to execute Cooper. If he is truly guilty, these simple tests will resolve the matter. If he is truly innocent, those same tests will tell us that. When the stakes are so high, when the evidence against Cooper is so weak, and when the newly discovered evidence of the State's malfeasance and misfeasance is so compelling, there is no reason to hurry and every reason to find out the truth."

Since Governor Schwarzenegger has refused to even have a clemency hearing or to issue a stay of execution, the anti-death penalty community of the world, including all of Europe (which has abolished the death penalty) should call upon Austria to:
(1) Revoke Schwarzenegger's Austrian passport, which he still holds;
(2) Rename the Schwarzenegger football stadium and everything else named for him as his name is now as despicable as Hitler's.

All California voters should oppose his disastrous bond on the California ballot. That is vote Yes on 56 and No on all the rest. Vote only for Peace & Freedom or Green Party candidates as these two parties are the only anti-death penalty parties. Do not vote for any registered Democrat or Republican at any level as their parties are both pro-death penalty. The handful of Democratic politicians who claim to be against this execution or even against the death penalty just do that to keep the Reds and Greens out of office. That insulting game must end and can only end when you stop voting for any candidate who belongs to a death penalty party.

Keep those phone calls, faxes and E-mails coming to the governor so that he learns what it is to be a death penalty governor.

As this might just be a stunt to stop the protests, the stay of execution might be overturned.

PLEASE CALL, E-MAIL, FAX THE GOVERNOR THROUGHOUT THE DAY, AND TELL EVERYONE YOU KNOW TO DO THE SAME. WE CANNOT STOP UNTIL WE ARE ABSOLUTELY SURE THIS INNOCENT MAN IS GIVEN CLEMENCY.

The death warrant expires at 12:01 a.m. Wednesday. If the 11-judge panel hasn't reached a decision by that hour, Kevin will automatically have at least 40 days while a lower court reissues a new death warrant.

Arnold's fax machine unplugged all day yesterday and today.

I can hardly wait for some lame excuse such as "we were out of paper." Call and e-mail him, please.

In his automated email response, it is stated : "Governor Schwarzenegger is committed to restoring your confidence in state government. As the Governor has said, with hard work and your help, California will once again be the 'Golden Dream by the Sea' ".

You might want to remind him of those very words in your emails. Don't let him off the hook.

Free at last! Free at last! Thank God Almighty, he is free at last!

After first hearing about him, I thought what every other right-wing bastard thought of the death penalty: "He killed, so he had it coming".

No. I guess in some way, I'm for the death penalty; WHEN THE GUY IS GUILTY. After thoroughly examining all of the evidence for and against him, I come to the conclusion that he's completely innocent. The cops planted the evidence cause they wanted one less black man in the world. The racist bastards wanted death to a man who, of course, doesn't deserve it.

Thank God Almighty he is free at last! Even if it's free from death, it's progress!
