PL/Maxxam major contributors to Humboldt DA recall efforts

EUREKA -- If a special recall election against District Attorney Paul Gallegos happens, organizers may have Pacific Lumber Co. to thank.

The company played an active role in the final weeks of the signature-gathering campaign, pumping time and money into the effort, according to a recent letter from PL President Robert Manne.

In the Oct. 24 letter, addressed to all PL and Britt Lumber employees and retirees, Manne said the company had not participated in the recall effort until "recent weeks when our employees, community members and the recall committee sought our support."

"We decided to contribute time and money to the effort to give the voters of Humboldt County an opportunity to decide the question of recalling the DA themselves," Manne wrote. "I know many of you participated in the effort as well, and for that we are appreciative."

As of Oct. 24, the company contributed more than $40,000 in "in-kind" support of the signature-gathering effort, the letter says.

PL says it backed DA recall effort

The Pacific Lumber Company has recently contributed "significant" time and money to the drive to recall District Attorney Paul Gallegos, according to an internal company letter obtained by the Journal.

The letter, which is printed on Pacific Lumber letterhead, is signed by CEO Robert E. Manne and addressed to company employees.

If the letter is authentic, the move represents a switch in position for the company, which is the subject of a multimillion dollar fraud suit brought by the DA shortly after Gallegos took office. Previously, PL had stated that it would not take a stand in the recall effort.

"As a company, we had not participated in the recall effort until recent weeks when our employees, community members and the recall committee sought our support," read the letter, dated Oct. 24. "We decided to contribute time and money to the effort to give the voters of Humboldt County an opportunity to decide the question of recalling the DA for themselves.

here's the oct. 24, 2003 letter to pl's peeps. the admittance of 40k spent to buy their way out of the fraud lawsuit if successful with the ballot recall.

is it that paul is soft on crime or is it that he's hard on the crimes the good ol boy network is used to getting away with? wonder if all who were accused of crimes could afford to buy their way out of prosecution?

I am not suprised that PL has decided to support the recall. It effects thm in ways other than the lawsuit. Their employees and the rest of the community in which they are active participants are directly effeced when plea bargaining is out of control and criminals are let off with a slap on the wrist instead of being held accountable for their actions.

By plea bargaining it can be made to appear that the number of convictions is up overall while the criminals thumb their noses at justice.

Our DA is not serving the public good by this and his attempts to spin the numbers is so obvious that even his supporters are speaking out.

Where are the statistics that show how many crimes were prosecuted at a lesser degree so that the victims were not given justice and the criminals walked away laughing.

If Mr. Gallegos is acting for the public good and not out of political expediency why is he so willing to attack a corporation and grab headlines but unwilling to actually prosecute the tresspassers and treesitters who take the law into their own hands, to the full extent of the law? Why not show some real ethics and prosecute the tresspassers as the criminals they are and prove that his suit is not a personal effort to aide them (environmental criminals) in thier vindetta against Maxxam?

His obvious bias in favor of criminals makes it difficult to believe he is seeking justice in his lawsuit. His credibility suffers everytime he fails to uphold the laws that defend Palco as equally as he tries to prosecute them.

OK, so if plea bargains aren't to happen, then should the DA under Farmers reign have not accepted any plea bargains either? No prior record, being in compliance with the officers once placed under arrest, doesn't warrent much more than an infraction.

If Ms. Card had been prosecuted and Gallegos had asked for the death penalty, to what costs would the taxpayers end up footing the bill. The hearings, the change of venue, the motions, the appeals would have cost the taxpayers thousands of dollars. If Ms. Card gets caught next time trespassing, she's now got a prior, won't be that easy next time around.

Did Farmer ever choose to seek the death penalty for the 300 violations Maxscam/PL recieved during his tenure? I doubt it. Did Farmer seek injunctive relief recouping the finacial losses the residents of Stafford suffered through during the landslide trigger by PL? Nope.

Lastly, there were 45 arrests that resulted from the Freshwater uprising. You aware how many times those individuals went to court, were forced to miss work or loose their jobs. You aware of how much jail time was given out for the convictions? You ain't got any idea what went down on the second floor.

It's politics. Wish every time I got a ticker or was charged with a crime, I could spend a 100k and oust the DA before my charges came before the court.

Oh yea, a majority of those who gripe about the infraction plea, don't forget the righteous defenders of life, still face a Strategic Lawsuit Against Public Particpation lawsuit which PL filed and had the Sheriff's personaly act as their agents of repression for them in serving all arrested related to timber protests. Oh the media spin is a rollin!!!!!!!!!!!!

What are you babbling? No one said she (Jen Card) should have gotten the Death sentence! But to fine her 10 dollars for her tresspass when by her own admission it lasted almost a year, defied court orders and endangered lives is ludicrous. It sent a clear message from the DA that he has no intention of prosecuting any anti Maxamm crime fairly but will lean over backward to see that they are given the least effective sentences available.

Anyone who was sitting on the fence, trying to decide if this DA was truly going to treat both sides fairly could not help but notice his obvious failure to remain impartial.

As for plea bargains, They are used too often for the sake of expediency and in this DA's office they are used way to much! Even if you took Palco/Maxamm related cases out of the equation you would still have a DA that is not serving the public good. The Drive by shooting case alone would have been enough tojustify th public outcry to oust him!

Why no criticism of the attorney who defended the drive by shooters. Bragg afterall also defended Ammons in the wrongful death lawsuit filed by Mr. Chain's family for the voluntary manslaughter. Why no critical ill judgement of the judge who accepted the plea on the drive by? Afterall, the DA agreed to the plea bargain, but I believe if the judge thought the plea didn't match the deed, he/she could have rejected it. Not even sure who the judge was, but no criticism there. Nope, the DA recall effort isn't about Gallegos tough on crime or lack thereof, it's strictly about the fraud lawsuit that's driving this sucker. Arkley senior has created a division in his family, have heard his son thinks he ought to crawl back into his house and leave it alone. But, once again, those with a 100k can buy there way out of facing charges which aren't bogus. If they were or are, let em file a motion for summary judgment and have the court throw it out.

As for being tough on crime, a forest defender arrested the same day Ms. Card was arrested, Ms. Wagner got 40 days of jail time for resisting. The jury hung on the trespass charge in her case. The assistant DA dropped the trespass charge, partly because again, it was a plea bargain, but also partly because the DA never recieved the proper information to actually prove that the tree MS. Card sat in, was actually PL's to gripe about. The facts are deeper than saying a $10 fine was a pat on the back.

If you research the public records, you will see that the charge of violating a court order was dropped because she wasn't served until she was in jail. The judge who signed the court order was the same judge who granted the infraction, and obviously he didn't have a problem dropping the charge as he is the one who did it. Also, Card was not charged with resisting arrest, however much PL doesn't like it. If they think she should have been, their problem lies with the sheriffs dept., not the DA, as the sheriffs were there and didn't bring the charge or claim she resisted.

In contrast, other activists who were arrested at the time have gotten jail time, probation, fines, deferred sentences and community service, in other words, every possible penalty for breaking the law.

Public records also detail the hundreds of violations PL has accumulated and continues to accumulate. Most of them did not result in fines. PL didn't seem to have a problem with this.

How could we measure the long term damage resulting from MAXXAM/PL's clearcutting?

Unstable slope erosion, stream sedimentation, biodiversity loss, eutrophication of Humboldt Bay and other effects still waiting to happen. As a result of MAXXAM/PL's actions the people of Humboldt are being left with a major environmental clean up and we will need financial help..

What MAXXAM/PL owes to Humboldt and the redwood forests is beyond a price tag, old growth redwoods are irreplacable. We need financial reparations to begin the restoration of the redwoods and stream ecosystem..

MAXXAM/PL's profit from fraud and theft of Humboldt's redwoods need to be returned for restoration of the damaged redwood ecosystem..

I did not criticize the defense attorney because they did their job. No matter the final outcome a defense attorney is there to defend the accused. As for the judge, he tried to over turn the plea bargain but for reasons, I as a lay person, do not understand was not able to do so. His only option was to give a as stiff a sentence as possible for the shootings they were actually tried for.

As for the sentence of Ms. Card vs. the crime, it was ludicrous and the only purpose I can see for her to have been treated in this manner was for the DA to show the EF and Palco that he had no intention of acting in a responsible manner.

The DA's job is to prosecute ALL crimes both large and small to the fullest extnt of the LAW. Mr. Gallegos has proven he is either unaware how to do this or is willfully refusing to do so. He needs to join our ex Govener in history as a recalled public servant. The sooner, the better!
