Careless, Irresponsible Logging By Maxxam's Pacific Lumber

Fallen tree hits Pacific Lumber security guard.
Maxxam/Pacific Lumber will likely find itself in another wrongful death lawsuit if they don’t change their ways. Five years after of the death of peaceful activist David “Gypsy” Chain, a similar tragedy was narrowly averted on September 18, when a tree cut by a Maxxam/PL contracted logger came within inches of killing yet another person on Gypsy Mountain, this time a security guard working for the corporation. Without warning, a tree fell where activists and security guards were talking, the branches slamming a security guard to the ground.


You would think they’d learn to do better. But instead, the lack of accountability has taught Maxxam/PL they are above the law, and that every careless or malicious act will result in nothing more than a token punishment. What’s worse, due to a mutual defense clause in the HCP, government agencies must defend Maxxam/PL’s right to destroy forests and water quality regardless of the findings of independent PhD scientists. How convenient.


Forest activists and workers are not the only ones at risk. Local residents, and the harm caused to them from corporate logging, are consistently ignored even as water sources are spoiled (if not destroyed completely), and others have to move or raise their houses due to increased flooding. In Freshwater, more than twenty families are routinely stranded during winter storms as erosion and canopy removal cause the creek to jump its banks, flooding roads and houses. Meanwhile, as millions of pounds of sediment from these barbaric clear-cuts pour into degraded waterways, tax-payers foot the bill for dredging Humboldt Bay - the final resting place for tons of silt.


While nearly every elected official sits on their hands, claiming no responsibility to do something in the face of such injustice, we the people are being manipulated out of our health, our rights, our money and the quality of life for future generations.

Maxxam/PL almost killed two of their own workers and a whole group of non-violent activists just last Thursday, September 18th, the day after the five-year anniversary of Gypsy's death at the hands of an enraged Maxxam/PL faller.
Again, Maxxam/PL continued to fall trees with full knowledge of people in the area.
Eyewitnesses said that two PL thugs were following our friends around in the woods, while loggers continued to fall trees. All of a sudden, a tree came smashing down within 15 feet of one of the goons, who called himself "Sparklepole," sending his orange hard-hat flying. The activists were sure that he was dead, and then Sparklepole got up, dusted himself off, got on his radio, and said something to the effect of, "Wow, that's an adrenaline rush!"
Yeah, because he ALMOST DIED, that's why!
The top of the tree fell dangerously close to a group of forest defenders, and could have killed everyone on site, except for the faller.
When is Maxxam/PL going to learn that it's not safe, not OK, to fall trees with people in the area.
When people show up, they have to stop, period.
MAXXAM/PL ALMOST KILLED A WHOLE GROUP OF PEOPLE, JUST ONE DAY AFTER THE FIVE-YEAR ANNIVERSARY OF GYPSY'S DEATH.
It's time to Save Gypsy Mountain.
Let's keep the focus on the real issue here.
All the legal THPs in the world doesn't give anyone the right to blatantly fall trees with people in the area.
You can't hide behind your rubber stamps anymore.
Learn from the past, and improve in the present and future. Don't make the same stupid mistakes, just to satisfy your sick ego.
You can't log with people in the area, period.

Shunka, you have been smoking a big fatty way too long. If you have noticed, there is signs posted that says "NO TRESSPASSING". But then what do you care. You pump these young kids up with your B.S. and send them on their marry way into an active cutting area. Why don't you do us all a favor. Why don't you go out there and stand under a falling tree just like Chain did. Thats a nice way to commit suicide. You asked, when are people going to wake up. There is a lot of us that has been asking the same question about you. As for that guard, it was you that almost got him killed, not the logger. And how do you get a group of people out of one guard?

PL was there when steep hillslopes were clear-cut which triggered landslides that wiped out houses in Stafford. They forgot to tell those families to get out of the way.

Next, I don't think anyone has been killed recently (within 5 yrs) on PL property except people who are unfamiliar with timber operations and should have been playing bongos on the plaza. Yes people get hurt in the woods regularly. That's exactly why non-timber professionals shouldn't be there, duh. You didn't learn from David, did you? Instead, you continue to "shadow" timber fallers in an effort to get whacked again, and it almost happened. Sounds like mosquito behavior to me.... you just don't know when to quit sucking.

Why would we recognize the validity of "regulatory agencies" who have admittedly approved every timber harvest plan pl has submitted since '99? good god no I dont' trust cdf or dfg or the water quality bored to do the job their paid by the people and protect the public trust. cdf themselves documents the hundreds of pl's violations and still approves every plan and lets them cut without any monitoring. its a damn crime, and the good people who pay thier taxes are getting screwed every time this texas fraud company takes their saws into the woods.

I say we shouldn't be silent and ignore how they are doing the people wrong!

It was up to the County planners to tell people building houses in Stafford that they were building on an active alluvial fan. Dangerous place, logging or no, just like all those places outside of Santa Cruz. That subdivision never should have been approved. County dropped the ball, developers made money, residents got stuck holding the bag.

Only a portion of the tree even came close to me and it was a long way from your mis-informed friends. I would not of had to be there if your type were not breaking the law by being there. I was there to protect the innocent young people you two send in to the woods. If anything should happen to any of our people or to the kids you send up the mountain, I will do my best to hold you two accountable!

You want to blame the Planning Commission? Why didn't the great floods and storms of '55 and '64 trigger slides in Stafford?

PL's head forester Tom Herman approved the plans that caused the slides that wiped out Stafford. Now Tom Herman is Roger Rodoni's appointee on the County Planning Commission. Is Tom Herman overseeing any development in your neighborhood? How do you feel about breathing asbestos?

The unfortunate truth is that the logger(s) on Gypsy Mountain failed to stop their illegal logging when non-violent activists entered the work area. This resulted in one worker coming VERY CLOSE to being killed(and he knows it), and several others, who were in the immediate vicinity, including one more PL worker, coming dangerously close to being hit, injured, and/or killed. This is the unfortunate truth.
It seems that PL can't count on its hired workers to observe the protocol that was set up as a result of the out-of-court settlement from the wrongful death civil suit, brought about by Gypsy's family, after Gypsy was killed by a PL worker, who also refused to stop falling trees when he KNEW that there were people in the area.
That protocol says that PL workers have to shut their chainsaws OFF when they know that there are people in or near the fall zone. This protocol was completely ignored on Thursday, September 18th, 2003, on Gypsy Mountain. This protocol has also been broken many times in Freshwater, during the intense raids this past spring and summer.
As long as endangered species habitat is being threatened and destroyed, people are going to protest.
As a company, Maxxam/PL, having full knowledge of a long history of direct action protests, which are obviously not stopping, have the responsibility to create a widespread protocol for dealing with protestors in the woods, in order to avoid MASSIVE LIABILITY CIVIL & CRIMINAL SUITS AGAINST THEM, and to avoid MORE PEOPLE GETTING INJURED AND/OR KILLED on "their land."
Since Maxxam/PL employ hundreds of people every year, they have the obligation to create a broad, all-encompassing set of PROTOCOL for dealing with protestors in the woods.
The protocol for loggers is:

1)Turn OFF your saws.
2)CALL your supervisor.
3)Wait for authorities to arrive.

The protocol for supervisors is:
1)Make sure that all timber harvesting operations in the area have stopped.
2)Call security
3)Make sure that no one is being violent
4)Wait for authorities to arrive

The protocol for security is:

1)Make sure that all timber harvesting operations have stopped.
2)Call the police
3)Make sure that no one is being violent
4)Wait for authorities to arrive

The protocol for the police is:

1)Make sure that all timber harvesting operations in the area have stopped.
2)Make sure that no one is being violent
3)Give people the option to leave or be arrested
4)Arrest those who decide to be arrested
5)Make sure that no one is violent to your "prisoner" until he/she is released.
6)Fill out your paperwork.
7)Go and try to stop some real crime.

That's it!
You can't chase us down, pounce on us, injure us, tie us up, torture us, kidnap us, and call that a "citizen's arrest."
A citizen's arrest is when you go over to a police officer and say, "I want to put that man/woman under citizen's arrests for such and such offense." Then, if the officer decides that it's valid(there are enough witnesses, enough evidence, etc.), then he/she can go and place the person under arrest. None of us can just go and tackle someone, throw them into a vehicle, do who-knows-what to them, and then take them to the police station, and say that you "citizen's arrested" the person.
It just doesn't work like that, and any form of the above-mentioned behaviour constitutes assault, battery, kidnapping, and others.

..the pattern of extending property was practiced by settlers whenever they wanted to take more land from the Native Americans. The treaties were broken again and again as the Native tribal land got smaller and smaller..

..this is the same pattern of MAXXAM eating more old growth redwoods to feed the pockets of Hurwitz, Bush and other greedy imperialists..

Logger Dave Walters doesn't know PL's property boundaries and doesn't care if he crosses them when he cuts. He testified to this in court, so it is part of the public record.

Carl Anderson doesn't even know for sure where PL's boundaries are. He also testified to this in court.

Maxxam repeatedly breaks state laws like the Forest Practice Rules, as well as Federal laws like the Endangered Species Act. They break the "stringent" rules of the Habitat Conservation Plan. Of course they over-cut their boundaries, they don't even try to hide it. And why would they? It's not like the government is going to slap them with a fine, or send them to bed without supper.

Maxxam/Pacific Lumber amassed 300 violations of the law from 1994 - 1997. They continue to commit violations. Any fines levied against them are pennies on the dollar.

To help their friends at Maxxam avoid further violations, state regulatory agencies (paid for by you and me) handed out permits to these crooks to violate environmental regulations, resulting in violations of neighboring property owners rights. Good, up-standing, tax-paying, hard-working and retired Americans are suffering from having less rights than Maxxam.

The government rewards Maxxam for their transgressions. The agencies act as a barrier, defending Maxxam from any challenge no matter its validity. Uncle Sam made a deal with Maxxam and called it the Habitat Conservation Plan

The battle between people for and against Hurowitz and PL has always been a war of truths and half-truths. Here are some examples:

Statement: Hurowitz/MAXXAM took contol of PL (a small family owned company) in a hostile takeover. They tripled the harvest and emptied PL's retirement fund.

Truths/half-truths: Hurwitz did take control of PL in a hostile takeover, but the company wasn't family owned. The Murphy's owned only 5% of the company at the time (actually Bank of America owned 44% at the time). They did't triple the harvest, but they did double it. Of course, the old PL thought they an inventory 3.5 billion feet of timber, when the actually had over 6 billion. Also, it should be noted that all timber companies nearly doubled their harvest starting 1986 due to the slump in lumber sales for 1983-84. As for the retirement fund, he did what all the other retirement funds were doing, re-investing. Unfortunately, the investment firm went bankrupt and Hurowitz had to personally backfill the fund.

Statement: PL amassed over 300 violations from 1994-1997.

Truths and half-truths: PL amassed over 300 violations from 1994-1997. This statement is not disputable. What I do find that is interesting is that over 90% of these violations were issued by one CDF forester who was very vocal about his dislike for PL. It also should be noted that he transfered out at the end 1997 and in 1998, PL had only 10 violations.

The war of words will continue as long as PL is in business. Coming from someone who used to work at PL and now, has moved on to another profession, it seems to me that the easiest way to put PL out of business is tell people to stop buying wood. Of course, to do that, we would have to stop building wood houses, eliminate population growth, take over other countries and force them to do the same, and curtail mother natures rath. Then start building haw-bale houses and use lumber made from milk cartons. Possible, but not reality. If we stop logging in this country completely, it will only speed up the harvests in other countries that don't have any environmental restictions.

We forget that the redwoods are sacred beings that have existed here in the west coast for millions of years. As a tree species, redwoods have existed here since the time of the dinosaurs (Cretaceous). Redwoods are an integrel part of the coastal temperate rainforest ecosystem. Their needles take in atmospheric moisture and draw fog in a continuous cycle via transpiration. Individual old growth redwoods are over 1000 years old!

This is an amazing feat, to live on Mother Earth for so long through storms and ice and earthquakes. The trees standing tall today were alive before the first European arrived on this continent. Native people's ancestors may have stepped over the seedling of a tree that is now taller than the eye can see..

People who have immigrated here need to show respect for the redwoods and honor their timeless wisdom. Native people of the north coast do not appreciate the continued destruction of European colonialists, now under the name MAXXAM/PL. Those of us Europeans who are saving the redwoods realize the mistakes of our ancestors and are actively preventing the oppresive cycle of colonialism from continuing. We seek to live in harmony with Mother Earth and respect the redwoods and the Native peoples whose land we are living on..

MAXXAM/PL Hurwitz/Bush do not show respect for this or any land. They operate based on greed an materialism, while showing no love for nature..

Mother Earth is growing weary of her disrespectful greedy childen..

people need to be there to record extinction info, we need to wait for several years before determining a species is extinct and sometimes a species we think is extinct isn't..

this doesn't alter the fact that habitat loss leads to species extinctions. The rate of extinctions is increased as habitat loss is increased. Fragmentation of habitat (ex. clear cut logging) leads to inbreeding among isolated populations, such as the red tree vole and marbled murrelet. Inbreeding increases risks of harmful genetic mutations that weaken the species. This increases the risks of extinction..

You have loss of habitat in Africa for the Lion and the Cheetah. Do you see interbreeding going on there? Hell no. The Lion would rather eat the Cheetah than to make out with it.
This is the same old B.S. that you environmentalist always throw out there when you know that true science not E.F. science always shoots you down in your claims. Take for example the mantee. There is no threat to them from man, but yet the population of the mantee is declining even with all the protection provided by man. And what about the California sea otters. The population was on a steady increase until about two years ago when scientist started finding hundreds of them dead at a time along the California coast for no reason. This has the science community puzzled. as to why this is happening.
Nothing last forever. One speice dies out while a new one is formed. I do beleive they call this evolution.
And one last note. We are talking about 200,000 acre's. What about the other millions of acre's that is already protected by law in wilderness areas set aside. And some of these areas are accessible from the ocean. Palco's property is not the only area where they (the birds) can come in to nest. Kings range is one example, and the Redwood National forest is another.

Inbreeding is different from interbreeding. Inbreeding occurs within the same species, not different species. Inbreeding occurs when closely related individual organisms of the same species begin to
breed together and share too much of the same genetic material. This results in the offspring having greater risks of unhealthy mutations..

The manatee is declining because of frequent encounters with motor boat propellers. Manatees graze on sea plants and spend a considerable time floating under the top of the water surface and are not visible to a motor boat going 60 mph. The propellers then scar the manatee's back and/or head, causing often lethal injuries..

Sailboats and kayaks would help a great deal in keeping the manatees living healthy happy lives in the estuaries and seas around florida..

Converting to alternate building material to end clear cut logging would help the red tree vole and marbled murrelet survive also..

We can prevent many of these extinctions from occurring by changing our lifestyles and living more sustainable..

it is barely recognizable as a manatee let alone that there is even a scar, or if so where it came from.

If you want to argue whether humans are negatively impacting manatees, you're going to lose. Without question. A simple Google search will illustrate the depth of your ignorance, but it doesn't matter. Adili is right. Convincing you just doesn't matter. The enjoyment you derive from taunting people whose humanity is broad enough to encompass concern for other living things is too puerile...too bestial for a man of experience and education. You are unworthy even of scorn.

considering there has been "NO PROOF" for anything that Adili - ( i.e.-moth) has posted, I find it quite questionable that any information they present to the general public is indeed factual. further more I will add that this group has had some very questionable practices associated with it, seems they have quite a bit to hide.

I don't normally make a habit of responding to these ludicrous posts, but just wanted to make mention that someone has used my name to post things that I do not think nor did I say.

Let's not forget the real issue here. We ask 4 simple things:
1)Stop cutting old-growth
2)Stop clear-cutting
3) Stop using herbicides
4) Stop logging on steep and unstable slopes.

Rock on North Coast Earth First and all other forest defenders!
