Judge G. H. Tomlin finds Xamplify credible

by Kamal Sinha (xamplify.sucks [at] xamplifysucks.com)
Judge G. H. Tomlin stated "their lack of motive for fabricating their observations and conclusions" and "character of their testimony" in ruling "the claimant voluntarily resigned without good cause."
Administrative Law Judge G. H. Tomlin of California Unemployment Appeals Board, Ooakland decided to ignore tonful of documents and collaborating testimony from a neutral witness who watched the claimant at work closely, and with the highest regard for the employer Xamplify Inc, a company backed by rich and powerful, concluded that "their testimony is entitled to full weight and credit" in coming to the decision that "the claimant voluntarily resigned without goood cause."

A few facts:
Claimant (Kamal Sinha) - BSEE, MSCS, MBA + experience + Green Card, applied to Xamplify's job ad for a "senior level" data modeling regular employee. He was hired as a subcontractor without any benefits at $1000/week which comes to at most $25/hour. In contrast his white colleagues, some of them
didn't show up for work on a regular basis, and didn't seem to possess the technical background to do the job properly were paid much higher and were all regular employees.

Read it, and you be the judge and if possible send me your comments either to my email or on this place.

Thanks.

Kamal Sinha
