Anaconda lockdown - Maxxam/PL remains defiant in court order

MAXXAM/PL CAUGHT VIOLATING JUDGES ORDER - ACTIVIST ARRESTED

Over 20 non-violent forest activists who stayed out overnight at Fox Camp Gate, in the Mattole Watershed, caught Maxxam/Pacific Lumber red-handed violating Judge John Golden's August 29th stay, which ordered that all logging operations on all company land must cease. When the Humboldt County Sheriff arrived the activist's 24 hour blockade was destroyed and one man was arrested.

Despite repeated clarifications strengthening and extending the stay, Maxxam/PL has continued to conduct business as usual, felling trees, and yarding and hauling the logs that they have cut in defiance of the five-week-old ruling.

In fact, Maxxam/PL has completed clear-cutting on at least nine Timber Harvest Plans, from Fox Camp to Taylor Peak, since the stay was issued.

"Why is the Judge's ruling not being enforced and why are they allowed to profit from illegal logging?" asked local resident and activist Naomi Wagner, after she viewed the scene of the car blockade at Fox Camp Gate.

At dawn on Monday, three log trucks and numerous Lewis Logging and Wills Trucking vehicles carrying crews to work, passed through the gate and across Humboldt Redwood State Park property to their off-limits Timber Harvest Plans. On their way out, the first fully loaded log truck was stopped by a strategically placed older model car, spray-painted with the message: "Maxxam Out of Humboldt County!".

An activist attached himself to the outside of the car by locking his arms into a sixteen-foot-long "anaconda," a flexible, tubular lock-box covered in silver duct tape, coiled through the car's windows and trunk.

Activists are willing to take risks including arrest prevent the cutting of old-growth, clearcutting, logging on steep slopes, and the use of toxic herbicides in the forest. Maxxam/PL's operations in the Mattole include all of these unsustainable practices, causing massive erosion which increases the potential for landslides in this seismically active area, and destroys crucial habitat for numerous endangered species.

This protest is focused specifically on Maxxam/PL's flagrant flouting of Judge Golden's rule. The order stems from a lawsuit filed by the Environmental Protection Information Center (EPIC), the Sierra Club, and United Steelworkers of America against the California Department of Forestry (CDF), California Fish and Game, and Maxxam/PL. Golden ruled that they failed to comply with the conditions of the Incidental Take Permit under the Sustained Yield Plan, as required by the 1998 Headwaters Forest Agreement.

After three years of non-compliance, including crucial "lost" documents, the stay was issued prohibiting all further logging operations. Company officials, subcontractors and security guards have feigned ignorance of the court order, although Maxxam/PL lawyer Frank Basik acknowledged in court the "broad and sweeping" nature of the ruling. When called upon to enforce the ruling, CDF said it would "defer to the company's interpretation," and newly elected Humboldt County Sheriff Gary Philps says he can not enforce the ruling in this civil case until Maxxam/PL is found in contempt of court. The Sheriffs, have arrested some twenty people in logging protests over the last two weeks.

"I'm not leaving until they haul me to jail," said the activist from his lockdown, "I'm here to fight for the trees."

Humboldt residents have vowed to maintain blockades until a contempt order is issued and enforced. They call on the community for solidarity and support.

I truly hope that Judge Golden hangs in there to the point where he can put the entire Sheriff's Dept. and every PL/Maxxam "mouthpiece" in the same jail cell. There goes Remedy's mom again (source of the Remedy) insulting more folks. Mrs. Of the Remedy, I remember once you wishing the name calling and insults to stop. Yet again, by insinuating that the sherrifs department and others in Hum. County are corrupt you are spewing insults at people.
Sherrifs can not arrest people unless they have broken a law. When the judge decides that PL has broken a law, he will issue an order stating so. The police can not interpret the stay. Don't fault the law officers. Yet again your lack of information and inability to think before you speak has left you with a hollow arguement. Grow up and stop calling names. Your double standard is embarrassing.

I am not saying that the actions of law inforcement in Hum. County are kosher. It is just that the debate need not include attacks and insults.
As far as the necessity of digging, that is the point of this web site. It you find concrete evidence (not opinion) of wrong doing, then post it. Please, do some digging.
Facts would add to the discussion and enlighten readers. Insults only bring the debate down.

The Department of Fish and Game, which could impose a stiff penalty on the company, is

Thank you for the substance filled arguement S-dog.
While most of your listings are opinion oriented to a large degree, at least there was some relation to fact.
I neither remember discussing the forest pracitce rules or the FBI in previous statements, and will abstain at this time from those topics for brevity's sake. I also don't remember stating a given affiliation to any corperation. Your assumptions may continue to fly as to the truth of that.
In regards to the local police, the incident that occured in 1998 was terrible, but not quite a clear example of police corruption. The testimony was reduced to he said-she said. It would have been extremely difficult for anyone to proove that the faller was guilty beyond a resonable doubt (remember O.J?).There was an investigation and it turned out that they could not get enough evidence. The actions that occur in the woods may be a better arguement. The catch is the motive. Why would law officers risk their careers to shove some protesters?
Tell you what, show me an instance where the police have taken bribes in return for actions and then you have corruption.
The Judi Bari reference is something I confess to having little knowlege on. Local law enforcement had little control over the actions of Oakland. You may need to say more that just that name to get your point across. Unlike your previous posting, I will neither assume who you are, or what you are thinking beyond what you post.

With the track record of MAXXAM legal and moral problems (dispite the legal staff I’m sure that is in retainer) fines and its apparent disregard for existing

I'm not going to lay out all of the evidence, but I will tell you that Jaun Freeman(sheriff's investigator) coached A.E. Ammons(murdered Gypsy) during his investigation. If you looked at the transcript or heard the recording of the initial investigation at the Sheriff's department, you'd know why I say coached. If you knew all the facts of what A.E.'s motives where prior to this incident, you'd say at the least, he should have been charged with manslaughter 1. However, Terry Farmer in agreement with Juany boy, covered up this murder/manslaughter. You see, at a local level, the DA decides what to charge and what to brush off. Terry decided to brush off this incident, probably with cooperation from the past largest employer of the county. There's a bunch of boxes of documentation to David's death, but since the civil suit settled out of court and the DA choose to never prosecute, the public is and will always be left in the blind on this subject. Leaving it to be a mystery and topic of discussion that never ends to most.

It's time for this community to heal, but the Chain incident was mishandled by the appropriate law enforcement authorities.

A new DA takes office in January of 2003 and the new sheriff has already taken office for the county of Humboldt. Maybe some changes will occur and the healing can begin once the fraud and lies stop at the local government level.

S-dog. Accusations should be backed up with evidence is all I am trying to say. It makes for a better arguement. The debate is multifaceted and corruption is but a piece of the puzzle. I am afraid that I am not yet sold on what you have to say, but I don't think you are totally off base. But your job is not to convince me.
One thing though, Judi Bari is your movement's best martyr. She was intelligent, effective, and understood that there were people on both sides of the issue. Please don't go throwing her name out cheaply to add emotional pull to an argument she has little to do with.
From what I can gather, she had more resistance from other branches of EF that from the Hum County Law. My original statement was about the fairness of the accusal of corruption toward the local police. Your replies have danced around the issues.
Semp, now you have a good response. There may have been some inappropriate actions in that event. But does it boil down to corruption? I don't think it is all that cut and dry. Simply disagreeing with the outcome does not allow for the demonization of those who made the decisions. It is possible that the law officials had information that you are not privy to. There is also the idea that the view point of those protesters are locally in the minority of those that would make up a possible jury. There is no way that the logger would be convicted. Just as I see it.

why is it that the locals view the protesters as so out there. well part of it might be in the way the debate is pushed by the activists themselves. the other huge part goes back to Judi's case. Law enforcement(4.4 million dollar verdict for violating Judi's 1st amendmant rights) and the corporations spent millions upon millions in a PR campaigns to discredit these folks. Hill & Knowlton is a multi-national public relations firm who was hired back in the day to discredit the forest forever initiative & the entire forest defense movement the same year Judi was bombed. The lies are deeply rooted back then and even prior. Hill & Knowlton brought you the yellow ribbon campaign for desert storm. They also brought you the yellow ribbon campaign for the timber workers back in 1990. The lies and deceit started prior to that, but that's what comes to mind. Why is it that every judge recussed themselves from the mattole civil suit against those activists for the winter 200 campaign? why is it that an out of town judge is overseeing the present epic case which judge golden has issued a stay on all of PL's logging operations? why is it, that when a logger sucker punches an activist, the DA chooses not to file charges when the incident was documented at the hospital and a report was filed with the sheriff's office? that same battery incident wasn't processed by the DA's office for almost four months after they recieved the paper work from the sheriff's deputy. the line from the DA's office was the sheriff didn't do that through of an investigation on the battery and caused them not to be able to prosecute the sucker puncher(Ed Lewis of Lewis logging). the list goes on and on, but the overall theme, justice in humboldt is blind. if you challenge things, don't expect much sympathy. yet, our nation is founded on that premise(was what the boston tea party?). rise up, resist so that your children's children can see a endangered coho salmon someday off in the future.

You can't fault PR firms or industry for taking the expected recourse and defending themselves.
Of course the timber industry spent millions against protesters. They stood to lose millions more.
Getting upset at the yellow ribbon campaign is unfair. The workers in the timber industry had felt more and more isolated as the timber wars progressed. Getting laid off and having their morallity questioned at the same time is not a good situation to be in. The ribbons were designed to show some sense of solidarity in an otherwise indiviualistic occupation.
While opponents feared a unifed timber front, there was no reason to assume nefarious intentions behind it.
As far as Ed Lewis is concerned, just try to "sucker punch" someone for a moving truck. It is difficult to see how the driver of a moving vehicle could sneak up on someone, lean out of his cab, and punch someone. I am not denying the action took place. I am questioning the interpretation.
Police have never been charged with the responsibility to defend and protect freedom. That task has always been in the hands of the people. Don't expect that those guarding the system will bend your way in the name of Karma.

For me that's the beauty of being a conservative. The important people and things that are my life, i.e., my spouse, my children, my faith, my job, my home, my community work, my leisure activities, I enjoy because of the individual pleasure they each hold. I have found that many of my left-leaning friends and acquaintances make themselves miserable over worry. They are more concerned with themselves and what makes them happy than they are about loving and helping others, even those of their own family. It is no wonder with that type of mindset they hold deep resentment for conservatives.

The German National Socialist party believed that all of the nations resources were to be utilized for the good of the nation. There were no private property rights. They believed that in order to create the perfect society they would have to get back to the Earth and reach what they understood as the natural state. All things that did not fit into that natural state (ie. minorities and disabled people) were expendable. The Nazis were proponents of organic farming and even Hitler himself was a vegetarian. cutting. Cutting areas are usually less than 5 hectares (12 acres) with removals of
maximally 50cbm – 80 cbm/ha (150 cubic feet to 250 cubic feet). Consequently there is no need to measure the cutting areas because they are so small and covered by the canopy of the remaining stands.-

do you have a point at all in this discussion or are you just here because you don't like Sheepdog? He's fairly easy to avoid, as with all of the discussion on these forums by merely not coming here. IMC is actually avoidable, you know, and it never ceases to amaze me how some people who claim to be so offended by it cannot manage to avoid it. I think they are attracted to it and the ideas here, yet you just can't bring yourself to admit it.
