Geneva or not, Bush’s decisions on Guantanamo detainees are against the Constitution of the United States, Article I, Section 8: "The CONGRESS shall have power to... MAKE RULES CONCERNING CAPTURES ON LAND AND WATER [my caps]".
Any decision on the Guantanamo captives belongs to Congress, not to Bush, as further clarified in U.S. Constitution, Article III, Section 2, Clause 3: "but when [crimes were] not committed within any State [of the U.S.], the trial shall be at such place...as the CONGRESS [my caps] may by law have directed."
And how about you, Ashcroft?
Your (in)justice dept. argued (International Herald Tribune, June 21, 2002: "‘Enemy combatants’ don’t have right to lawyer, Bush administration argues", by Jackman/Eggen) that "prisoners declared enemy combatants do not have the right to a lawyer": thus spake one who shouldn’t have spoken.
Prisoners of war are none of your goddam biz – got it now?
It’s Congress’s business.
