11-YEAR-OLD STANDS UP FOR HER RIGHTS - GETS BRUTALLY ARRESTED BY CALIFORNIA HIGHWAY PATROL.

Sophia Ibrahim and her brother & sisters joined the 5/25/02 “TAKE IT TO THE BRIDGE” anti-war march across the Golden Gate Bridge. Highway Patrol officers, who probably outnumbered the 125 or so marchers, decided they were going to shut down the peaceful permitted march early. CHP arrested those who refused to turn around – and began shoving and pushing those who weren’t moving fast enough. I noticed Sophia’s family when I heard her and her younger sister tell a CHP officer not to touch them - that he had no reason to touch them. By the time they were done letting him know how they felt about cops acting like goons he looked like a puppy with his tail between his legs. I was impressed. They knew their rights were being violated and didn’t hesitate to let the CHP know how they felt about it.

They are inspiring activists and often put a smile on the face of the marchers near them.

Sophia and others found themselves being pushed by the CHP even after they had left the bridge. The CHP officer in charge ordered his troops to “FORM A SKIRMISH LINE!” before they pushed marchers through the parking lot and into the Presidio. Again Sophia her sister and others ridiculed the CHP’s behavior, stood up for their rights, and demanded that the CHP stop pushing - that it was totally unnecessary.

The CHP kept pushing and as Sophia made her way into the Presidio she says she told an officer: “Don’t touch me - for the last time!” That’s when she was arrested and charged with Felony Assault on a Police Officer. CHP claims she tried to hit the officer. I doubt it. I think they couldn’t stand to see a young girl call them on their sh*t. She demanded that they treat her with respect. She demanded that her rights be respected. She ridiculed them and their behavior. They couldn’t handle it - so they arrested her. They wanted to scare her and break her spirit. That’s not going to happen.

The police convinced Sophia’s brother that if he came with them they would release her to him. Instead they arrested him for Child Endangerment for bringing his sisters to the protest!

As always in the USA, there are more cops than protestors. As always, they re the ones who turn peacful demonstrations into violent ones or riots.

None of these photos show the police to be close to any of the protesters, much less pushing people. That someone would photograph a child that is crying and visibly upset and post it on the internet is disturbing. So far, on every story about this, those who are saying the police acted improperly have proven nothing except to those who would tend to believe that type of thing regardless of the truth. Once again, those who preach to others are the ones who need to be preached to. Strike another mark in the "L" column.

Young children have no place in a demonstration such as this that could easily become dangerous. Parents, or in this case her older brother, should be held responsible for not keeping her out of harms way.

To fight police abuse effectively you need to know your rights. There are some things you should do, some things you must do and some things you cannot do. If you are in the middle of a police encounter, you need a handy and quick reference to remind you what your rights and obligations are.

That's why the ACLU is making these tips available as a downloadable .pdf file. You can photocopy this and carry it in your wallet, pocket or glove compartment to give you quick access to your rights and obligations concerning police encounters.

Be polite and respectful. Never bad-mouth a police officer.

Stay calm and in control of your words, body language and emotions.

Don't get into an argument with the police.

Remember, anything you say or do can be used against you.

Keep your hands where the police can see them.

Don't run. Don't touch any police officer.

Don't resist even if you believe you are innocent.

Don't complain on the scene or tell the police they're wrong or that you're going to file a complaint.

Do not make any statements regarding the incident. Ask for a lawyer immediately upon your arrest.

Remember officers' badge & patrol car numbers.

Write down everything you remember ASAP.

Try to find witnesses & their names & phone numbers.

If you are injured, take photographs of the injuries as soon as possible, but make sure you seek medical attention first.

If you feel your rights have been violated, file a written complaint with police department's internal affairs division or civilian complaint board.

IF YOU HAVE A POLICE ENCOUNTER, YOU CAN PROTECT YOURSELF.


1. What you say to the police is always important. What you say can be used against you, and it can give the police an excuse to arrest you, especially if you bad-mouth a police officer.

2. You don't have to answer a police officer's questions, but you must show your driver's license and registration when stopped in a car. In other situations, you can't legally be arrested for refusing to identify yourself to a police officer.

3. You don't have to consent to any search of yourself, your car or your house. If you DO consent to a search, it can affect you, rights later in court. If the police say they have a search warrant,ASK TO SEE IT.

4. Do not interfere with, or obstruct the police -- you can be arrested for it.

IF YOU ARE STOPPED FOR QUESTIONING


1. It's not a crime to refuse to answer questions, but refusing to answer can make the police suspicious about you. You can't be arrested merely for refusing to identify yourself on the street.

2. Police may "pat-down" your clothing if they suspect a concealed weapon. Don't physically resist, but make it clear that you don't consent to any further search.

3. Ask if you are under arrest. If you are, you have a right to know why.

4. Don't bad-mouth the police officer or run away, even if you believe what is happening is unreasonable. That could lead to your arrest.

IF YOU'RE STOPPED IN YOUR CAR


1. Upon request, show them your driver's license, registration, and proof of insurance. In certain cases, your car can be searched without a warrant as long as the police have probable cause. To protect yourself later, you should make it clear that you do not consent to a search. It is not lawful for police to arrest you simply for refusing to consent to a search.

2. If you're given a ticket, you should sign it; otherwise you can be arrested. You can always fight the case in court later.

3. If you're suspected of drunk driving (DWI) and refuse to take a blood, urine or breath test, your driver's license may be suspended.

IF YOU'RE ARRESTED OR TAKEN TO A POLICE STATION


1. You have the right to remain silent and to talk to a lawyer before you talk to the police. Tell the police nothing except your name and address. Don't give any explanations, excuses or stories. You can make your defense later, in court, based on what you and your lawyer decide is best.

2. Ask to see a lawyer immediately. If you can't pay for a lawyer, you have a right to a free one, and should ask the police how the lawyer can be contacted. Don't say anything without a lawyer.

3. Within a reasonable time after your arrest, or booking, you have the right to make a local phone call: to a lawyer, bail bondsman, a relative or any other person. The police may not listen to the call to the lawyer.

4. Sometimes you can be released without bail, or have bail lowered. Have your lawyer ask the judge about this possibility. You must be taken before the judge on the next court day after arrest.

5. Do not make any decisions in your case until you have talked with a lawyer.

IN YOUR HOME


1. If the police knock and ask to enter your home, you don't have to admit them unless they have a warrant signed by a judge.

2. However, in some emergency situations (like when a person is screaming for help inside, or when the police are chasing someone) officers are allowed to enter and search your home without a warrant.

3. If you are arrested, the police can search you and the area close by. If you are in a building, "close by" usually means just the room you are in.

We all recognize the need for effective law enforcement, but we should also understand our own rights and responsibilities -- especially in our relationships with the police. Everyone, including minors, has the right to courteous and respectful police treatment.

If your rights are violated, don't try to deal with the situation at the scene. You can discuss the matter with an attorney afterwards, or file a complaint with the Internal Affairs or Civilian Complaint Board.

I saw what happened was not in the protest though just a tourist on the bridge the protest was peaceful no banners on the bridge the protesters stayed on the side walk the cops stopped the protest at 1:35 the cops blocked the sidewalk the cops stopped the traffic on the bridge so the could get their buses in to take off the courageous protesters that where abused by the chpig fascists
The little girl I saw arrested after the protest near that little parking lot by the bridge walk way about 50 yds from the bridge at about 1:59 the courageous little girl did not assault the chpig the chpigs where pushing the people with sticks she said stop pushing me an the chpigs attacked her after the chpigs tied the little girl up and tossed her to the ground one chpig fatass kneeled on her and grabbed her ass I took a photo of this
if courageous people like the 11 yr old don’t protest the fascist practices of our dictator bush over in other peoples countries more terrorist will be willing to come over here and kill the people that support their oppressors

Thanks, Sophia, for being courageous enough to speak out for peace. Sadly most adults $old out their idealism for the illusion of climbing the economic ladder. Your idealism is an inspiration, and you're a hero in my book.

Very clearly though the child did misbehave. Comfort her emotional bruise, dont lift her up, jesis gd krist !

I was there. The police were completely out of line, as we weren't a threat to anyone, nor were we obstructing any traffic, or causing any disturbances. The police decided that we couldn't stay in the public view (Not in view of the freeway mind you, this was down near the parking lot), and began just forcing the entire group to hastily retreat or be treated to more police violence. IE mace and baton beatings.

Sophia didn't break any laws, and was targetted to make an example. She was brutally removed from the crowd, and pinned down facefirst by three CHP officers. Firstly, it doesn't take that kind of force to arrest a child. Secondly, the only danger she was in was from the police who were supposedly trying to protect her with tear gas, rubber bullets, pepper spray, and plastic handcuffs.

Where was the danger here? The protest was completely peaceful, even after the police got violent. If anything the police should be on trial for endangering everyone's life on that bridge. If they had started using those tear gas guns I can only immagine what would have happened. I could see many people getting knocked off the bridge in the chaos, including cops. Who exactly was trying to 'protect' and who was the ones creating the 'danger' that they arrested Sophia's brother for? The march was supposed to be completely peaceful, and non confrontational. That means that the only danger is from the law enforcement, and who knew they were going to overreact so harshly? Bottom line is it was the cops' fault there was any danger at all so THEY should be the ones under arrest for child endangerment. Sophia and her little sister asked their brother to take them to the event as I understand. If anything, the state should be put on trial here, not the protesters. What danger is there in participating in a peace march accross the bridge? Alot apparently when the CHP is in charge.
