Regulation Would Gut Rent Control Eviction Protections
Rent Board Regulations have been proposed which would allow landlords to evict all tenants in a building under the Ellis Act
but be allowed to re-rent the units at market rents so long as just 1 tenant was allowed to stay. This would allow the Ellis Act to
be used to evict tenants simply for the purpose of re-renting their units at higher rents. The Ellis Act requires that the units of
evicted tenants can only be re-rented at the same rent the evicted tenants were paying (this requirement lasts forever and is
recorded on the deed of the property). But, the Rent Board is proposing that landlords can bypass these restrictions if they let
just 1 tenant remain. Thus in a 4 unit building, the landlord could evict 3 tenants (with the lowest rents) and let 1 tenant (with the
highest rent) stay and then re-rent the units at market rent!!!
These regulations are very, very dangerous. The just-cause eviction protections in rent control are designed to
prevent evictions for the purpose of simply raising the rent. These regulations would allow evictions solely for the
prupose of raising the rent.
(don't you love having this scheduled at the same time as RTS mayday!)
