On Sunday, September 17, 2000, at its board meeting in Arlington, VA, the Pacifica Foundation, Board Chair Mary Frances Berry, and members of the board present at the meeting, were personally
served with a new lawsuit brought by Pacifica station
listener-sponsors "to restore Pacifica to its founding purposes and remove directors for breach of trust and gross abuse of authority and discretion." The lawsuit demands 'defining and democratically nominating and electing directors,' and charges breach of a charitable trust.
