Two human rights activists who have been refused entry into Israel petitioned the Tel Aviv District Court on Sunday to overturn the Interior Ministry's decision to keep them out of the country.
The activists - Jamie Spector, 32, from San Francisco, and Christina Grafer, 46, from the Netherlands - planned to demonstrate against the West Bank separation fence as part of their involvement with the International Solidarity Movement. Security officials asked the Interior Ministry not to allow them into Israel when they arrived at Ben-Gurion International Airport on Saturday, saying they constitute a "danger to state security."
The Tel Aviv District Court on Sunday issued injunctions delaying their deportation while proceedings in the case continue.
Spector and Grafer are not the first to be denied entry into Israel during the past two weeks on the basis of their left-wing activity. As fellow ISM activist Ann Robinson Petter did when she was denied entry to the country at the end of June, Spector and Grafer also refused to return to their respective countries, were arrested by the immigration authorities at the airport, and petitioned the court to let them in.
Robinson Petter, a 44-year-old graphic designer from New York, has since appealed to the Supreme Court against last week's district court decision ordering her to keep away from Israel due to her activity in ISM. The Supreme Court will hear the case on Thursday.
Grafer's attorney Gabi Laski wrote in the petition that the Shin Bet, and not the Interior Ministry, has the real power over who is allowed to enter Israel.
"Despite the Interior Minister's broad discretion regarding foreigners' entry into the state of Israel, he functions as a rubber stamp for the security forces, led by the Shin Bet security service, who pass on the lists of those who have been denied entry to Israel," Laski wrote. "And so in effect, the widespread authority of deportation and distancing from Israel are given directly and uncritically to the Shin Bet."
The Interior Ministry did not dispute Laski's contention, saying, "In cases in which the security forces recommend not to approve entry into Israel, the interior minister indeed doesn't use his own discretion, and takes the recommendation."
Both Grafer and Spector are involved in the academic world. Grafer works in computers at a Dutch university and Spector, who is a Jew from San Francisco, works as an educational adviser in schools.
The petition filed by attorney Yael Barda on behalf of Spector discusses her right to live in Israel under the Law of Return, the family members she has in the country, and her involvement in the Tikkun Jewish renewal movement in San Francisco, together with her parents. "The entire family holds left-wing views, which they do not hide," the petition says.
Spector was questioned for seven hours, according to the petition, and was then told she would not be able to enter the country because of her affiliation with ISM. She was planning to "conduct humane activity in the territories, to document the construction of the separation fence, and establish artistic projects for Israeli and Palestinian children, and to meet with the leader of the Bereaved Families Forum, Yitzhak Frankenthal," the petition says.

JERUSALEM - A Jewish American was denied entry to
Israel because she belongs to a pro-Palestinian
group, her lawyer said Sunday ó a rare case of a
Jew banned from the Jewish state.
Jamie Spector, 32, a social worker from San
Francisco, arrived in Israel on Saturday to
protest the West Bank separation barrier Israel
is constructing. She has been held in detention
since defying the order to leave, said her
lawyer, Yael Berda.
The separation barrier was ruled illegal in an
advisory opinion on Friday by the International
Court of Justice in The Hague, Netherlands.
Israel dismissed the nonbinding ruling as
one-sided, charging that it encourages terrorism.
Israel says the barrier is needed to keep
Palestinian attackers out of the country, but
Palestinians call it a land grab because it dips
into the West Bank.
Spector was denied entry because of her
affiliation with the International Solidarity
Movement, a pro-Palestinian group active in the
West Bank and Gaza Strip (news - web sites),
Berda said. The group's members often place
themselves in between Palestinians and Israeli
forces to prevent the army from carrying out
operations.
Tova Ellinson, spokeswoman for the Ministry of
the Interior, said officials acted in accordance
with a security recommendation. She refused to
comment further.
Huwaidi Arraf, an American-born Palestinian and
founder of the ISM, said that more than 10 group
members have been refused entry into Israel in
the past month. Two other ISM activists are in
the same detention center as Spector.
Israel charges that the activists defy military
orders and endanger themselves and soldiers. Many
ISM members have been deported.
However, banning Spector's entry was different,
Berda said. "This is a special case," she told
The Associated Press. "It is very difficult for
Israel to ban Jews from entering the country. It
means that the courts will look differently on
her."
With few exceptions, Jews are allowed automatic
entry into Israel and are offered citizenship.
"I am very sorry that the Israeli government is
denying me entry into the country where I have so
many family and friends," Spector said. "I am
committed to nonviolent actions and also
toprotest the illegal apartheid wall." Berda
relayed the AP's questions and Spector's answers
by telephone.

Jamie Spector, a social worker from San Francisco, has been detained at Tel Aviv's Ben Gurion Airport yesterday and is facing deportation. As a member of the International Solidarity Movement (ISM), Jamie was planning on taking part in non-violent demonstrations with Palestinians, Israelis, and other internationals against the "Apartheid Wall", the barrier Israel is building in the occupied West Bank. At least a dozen human rights advocates have been denied access to the Occupied Palestinian Territories over the past month and turned back by Israel at Ben Gurion Airport.
Spector has traveled to Israel and Palestine once before with ISM, a
Palestinian-led movement of Palestinian and international activists that utilizes nonviolent, direct-action methods of resistance to confront and challenge illegal Israeli occupation forces and policies. ISM has not been declared an illegal organization in Israel, though it is becoming clear that affiliation with ISM is grounds for being refused entry into the country.
In San Francisco, Spector works with Jews for a Free Palestine, an organization dedicated to ending Israel's occupation of Palestine and the recognition of Palestinian refugee's right to return to their historic homeland. "Israel claims to be the homeland for Jews everywhere, but a Jew can't even get in the country if she takes issue with Israel's gross violation of international law; this speaks volumes about the hypocrisy of Israel's policies in the Occupied Territories and in Israel itself," said Eric Romann, Spector's friend and a fellow member of Jews for a Free Palestine.
Stephen and Annette Spector,of Falls Church, Virginia, Jamie’s parents and the co-coordinators of the D.C. Area Tikkun Community, said they fully support their daughter’s actions. They also said that "Jamie's work with ISM and Jews For A Free Palestine is consistent with her long history of work for social justice. She spent four years in Bosnia right after their war ended and currently works in school with children at risk. She has also worked for prison reform and with children of prisoners."
Jamie's parents refer to her as “an angel of peace”.
Earlier this week, the International Court of Justice in The Hague ruled that major portions of the barrier violate international law, saying that it was "tantamount to annexation of Palestinian land" and it "severely impeded the exercise by the Palestinian people of its right to self-determination."
The Court called on Israeli officials to cease new construction of
The Wall in occupied Palestine, tear down sections, and compensate
Palestinians whose land it cuts across or whose interests have otherwise been harmed (New York Times and Ha'aretz, July 10, 2004).
Jamie made this statement Sunday, July 11:
"As a Jewish person, I can understand how Israelis are concerned for their security, given the long history of our oppression. At the same time, this is not the whole story of the Jews. Jewish people have fought for social justice, in the communities where we live and in support of others. It is to this Jewish heritage that I am most connected. As a Jewish person of conscience, I see the illegal Apartheid Wall that is being built as a modern Warsaw Ghetto. As a Jewish person, it is my responsibility to do everything I can to oppose this wall, and the unjust occupation of Palestinians. I will struggle nonviolently alongside the thousands of Palestinians who are nonviolently protesting everyday."
Jamie made this statement Monday July 12:
"In the article published today in Ha'aretz newspaper there were two mistakes. It was stated that I am very involved in the Tikkun community in San Francisco. While I respect the work of Tikkun, I do differ on several political points. I am not involved with Tikkun in SF in any way, but respect the work that my parents do with Tikkun in Washington, DC. I am a member of Jews for a Free Palestine, which works in solidarity with the Palestinian Liberation Movement. The second mistake in the article was the statement that I was interrogated for 7-10 hours. In reality, I was detained in the airport for 9 hours and interrogated for approximately one hour. I want to thank everyone in my community and family for their support and for the good media work everyone is doing. I would also like to ask that people send letters of support on my behalf to both the Minister of the Interior and the Prime Minister of Israel. My attorney has recommended that this will greatly influence my case. The letters should state that they know me, that they are shocked/dismayed by my arrest and deportation order and that they hope Israel changes its mind and allows me to enter. Most importantly, the non-violent resistance against the apartheid wall continues on a daily basis around the west bank. The courage and strength of the Palestinian people is being shown through their actions everyday."

I am a member of Jews for a Free Palestine, which works in solidarity with the Palestinian Liberation Movement. The second mistake in the article was the statement that I was interrogated for 7-10 hours. In reality, I was detained in the airport for 9 hours and interrogated for approximately one hour. I want to thank everyone in my community and family for their support and for the good media work everyone is doing. I would also like to ask that people send letters of support on my behalf to both the Minister of the Interior and the Prime Minister of Israel. My attorney has recommended that this will greatly influence my case. The letters should state that they know me, that they are shocked/dismayed by my arrest and deportation order and that they hope Israel changes its mind and allows me to enter. Most importantly, the non-violent resistance against the apartheid wall continues on a daily basis around the west bank. The courage and strength of the Palestinian people is being shown through their actions everyday."
