For extorting private identification, perhaps. But it isn't clear that they can't make that a condition of use, which is, after all, voluntary. Bring on the lawsuit and we'll find out.

But unconstitutional? I need a bit of help here. What clause of the Constitution do you think they are violating? There simply isn't much in the Constitution that refers to what an individual or corporate entity can't do.In fact, offhand I can't think of a single clause that isn't saying either:
a) What the Federal government can or cannot do.
b) What a state government can or cannot do.

Nothing in there saying what you or I can't do. There are implications of what we CAN do because of the clauses specifying the government can't forbid. But maybe you see something in there that I don't.
