Injured workers and their families are under attack. As a result of insurance driven so called "reform" SB 899 under former governor Schwarzenegger and theDemocrats in the legislature and Governor Brown's SB 863 pushed by DIR Director Christine Baker, the head of the Division Of IndustrialRelations DIR seriously injured workers are being prevented from getting prompt medical care and compensation.
In SB 863 which was also supported by California AFL-CIO Secretary Treasurer Art Pulaski and CA AFL-CIO Legislative Director Angie Wei who is also the chair of the Commission On Health And Safety and Workers Compensation CHSWC, injured workers are excluded from getting compensation from depression and other psychological injuries following a physical injury when many workers get depression.
At the same time, SB 863 allows anonymous doctors to make so
called independent medical reviews that cannot be appealed.
This is a system made for corruption and for company doctors to
deny injured workers proper treatment for greater insurance
company profits.
It is time, that there be full vocational rehabilitation and the right
to go to any doctor you desire instead of being forced into
insurance company medical mills.
SB 863 also discriminates against immigrant workers who
who need interpreters to find out what the laws are.
Also there is a spike in opiate addictions in the California
Workers Comp system as workers are denied medical care and
instead fed pain drugs which of course the Pharma industry loves.
We need to eliminate the insurance industry control of workers
compensation and also investigate and prosecute those
employers and the insurance industry who are cost shifting
forcing injured workers to go on State Disability and Social
Security Disability because they refuse to pay for the cost of their
injured workers.
