Mary Cummins Receives Reprimand from CA Dept of Fish and Game

Perhaps the CA Dept of Fish and Game should be asked if Mary Cummins is continuing to violate their Memorandum of Understanding (MOU) that she is required to abide by in the state of California in order to have a rehabilitator’s license.

The California Department of Fish and Game documented “incidents of concern” as it pertains to Mary Cummins ‘wildlife’ rehabilitator’s license. Apparently Ms. Cummins takes her role as a rehabilitator very lightly. In 2012 she was taken to court and after a 4-day trial the judge announced her defamation of Amanda Lollar and Bat World Sanctuary was “egregious as well as malicious as well as intentional”. Prior to the trial, in deposition, when asked why she obtained a USDA license Ms. Cummins responded, “for the hell of it”. Seems Ms. Cummins thinks the agency regulations that govern wild animal care are a joke. So for Ms. Cummins to be a party to the hateful stories that have appeared on the Internet as it applies to Bat World Sanctuary and Amanda Lollar is clearly a case of the pot calling the sterling silver black. Mary Cummins is the one who violated the rules when she took a squirrel with no eyeballs to a public event. The reprimand went on to state: 1) “Displaying animals undergoing rehabilitation to the public is inconsistent with and a direct violation of your wildlife rehabilitation MOU….” 2) “Inappropriate pictures of wildlife being held in your care have been displayed on your Animal Advocates website….All of these photographs are not suitable for a rehabilitation website and do not promote education or dignity to wildlife. They promote these animals as pets.” 3) “The documentation of the squirrel with ‘no eyeballs’ is of great concern and the quality of life for that squirrel is questionable at best.” 4) ….”The photos depict a fox squirrel being choked, a fox squirrel in a public area on several peoples’ heads and shoulders, a juvenile raccoon chewing on the lead of a pencil, and a fox squirrel wearing a t-shirt.” The letter went on to list other violations.
In summary, Mary Cummins was in DIRECT VIOLATION of her wildlife permit; she was accused of endangering an animal with NO EYEBALLS and many other violations. The letter is at this link or you to read for yourself: http://marycummins-reprimand.blogspot.com/

Mary Cummins of Animal Advocates and Cummins Real Estate Services, has been admonished by a third Judge after filing false police reports and attempting to use them to get a temporary restraining order against an innocent party, Amanda Lollar.
Mary Cummins owes 6.1 million to Amanda Lollar after losing a defamation lawsuit, so Mary Cummins attempted to last lashing out by filing frivolous lawsuits and getting a restraining order against Amanda Lollar.
Mary Cummins has been involved in over 20 lawsuits around the U.S. and has been sued at least four times for defamation, so she is savvy enough to act as her own lawyer. Mary Cummins filed a federal lawsuit in California against Amanda and three of her perceived enemies from many years ago along with ten anonymous "John Does," alleging defamation and various ridiculous legal theories she most likely found by doing a Google search. Mary Cummins even sued Eric Shupps, the IT expert who testified against her at trial, claiming he "defamed" her and "inflicted emotional distress" on her.
Although Mary Cummins tried desperately to convince the judge that her lawsuit against Amanda was not frivolous the case was summarily thrown out of court. She tried to appeal the judge’s ruling but the Court of Appeals dismissed her appeal: http://batworld.org/wp-content/uploads/2012/12/Mary-Cummins-loses-case-against-Amanda-Lollar.pdf
Because her lawsuit against Amanda Lollar was obviously a loser, Cummins decided to file a second harassment lawsuit in California federal court against Amanda. In this second case she added Bat World and its board of directors claiming that she had been wronged in various ways, including an allegation that she had bumped her head while trying to climb through a window at Bat World and it was somehow Amanda's and the board members' fault. After ruling that Cummins had acted in “bad faith” the judge threw out most of her allegations in this second lawsuit and then transferred her bump-on-the-head claim to a Texas court: http://batworld.org/wp-content/uploads/2013/05/Judge-Rules-Mary-Cummins-Acted-in-Bad-Faith.pdf
After listening to Mary Cummins try to justify her third ridiculous lawsuit, a restraining order against Amanda Lollar, the superior court judge not only threw it out, she also ordered Cummins to pay Amanda Lollar's lawyers over $6,000 in attorney's fees for having to respond to such a frivolous lawsuit:http://batworld.org/wp-content/uploads/2013/07/Mary-Cummiuns-Court-Order-Dening-TRO-Sanctioned-6350.00.pdf . The fact that the judge ordered her to pay the other side's attorney's fees speaks volumes, since judges normally only do this in the most blatant cases of lawsuit abuse. The judge also informed her that both she and her application for a restraining order against Amanda were "annoying." http://tweedledumdum-marycummins.blogspot.com/
The apparently delusional mental state of Cummins as seen in her frenetic internet postings clearly indicates that she is extremely dangerous. While obsessing on Amanda Lollar this mentally disturbed woman posted on the internet: "The police actually told me to shoot her dead." She has also posted, "I went through the police academy, took the gun class. I've been going to the range." In response to her lunatic ravings about shooting Amanda, her internet followers posted things like, "Mary whatever you do...if you shoot her make sure you shoot to kill; if she survives she'll sue you!" and "You have to do what you have to do Mary," and "Someone needs to throw water balloons filled with urine at her." http://marycumminsbranchcumminians.blogspot.com/2013/07/mary-cummins-branch-cummidians.html
She proudly--and ludicrously--proclaimed that Amanda "will soon be arrested." However, she later posted that when she went to LAPD and was unable to talk to a detective about Amanda, "I refused to leave the police station," and "I will try internal affairs." Police departments always attract crackpots and the Los Angeles Police Department obviously figured out long ago what they were dealing with. Cummins' threat to go to "internal affairs" is a sure sign that the city can probably expect yet another lawsuit by her if they don't arrest or shoot Amanda soon. This pathological Beverly Hills woman (who, by the way, thinks she is actor Charlie Sheen's "neighbor" and posts photographs of Jennifer Aniston's house and obsesses about her on Facebook, Google, blogs, Twitter, etc. - http://animaladvocateswildliferehabilitation.blogspot.com/2013/06/jennifer-aniston-lives-at-901-airole.html) seems to believe that if she files enough frivolous lawsuits and false police reports, and if she spreads enough lies all over the internet something is eventually bound to stick, enabling her to finally destroy Amanda--a selfless woman who has devoted her entire life and virtually all of her worldly possessions to rescuing, rehabilitating, and caring for her beloved animals in Mineral Wells, Texas.
Mary Cummins of Animal Advocates and Cummins Real Estate Services in Los Angeles, California is obsessive, vindictive and relentless. She has been attacking and smearing her perceived enemies on the internet, filing police reports against them, and suing them for many, many years. When she has been sued by her victims she has claimed that she can't be held liable by courts because they don't have "jurisdiction” over her. However, when she tried to sell that absurd argument to a Texas judge it fell flat and she wound up owing her victim $6.1 million.
According to the Office of Administrative Hearings before the Fish and Game Commission, Case #2012030817, Mary Cummins was DENIED her Native Species Exhibiting Permit. Violations cited, including the alleged abuse of a squirrel with no eyeballs.
CA Game wardens and lawyers investigated and found Mary Cummins of Animal Advocates had been neglecting and abusing the animals in her care. They had a video from an event called, “Best Friends” where she had rehabilitating animals being “passed around amongst the public” which is a direct violation of her wildlife rehab MOU (not to mention an inhumane action)
Cummins posts videos online of babies being ripped from their dead mother by their necks, with such force that the mother’s nipple tear in the babies mouths.
All educational animals must be approved through the Department, but Mary Cummins lied about the animals that were to be educational animals. The Department had documentation of a “squirrel with no eyeballs” and stated it was of “great concern” to them , adding, “the quality of life for that that squirrel is questionable at best”: http://www.indybay.org/newsitems/2013/05/20/18737124.php & http://marycumminss.files.wordpress.com/2013/04/mary-cummins-reprimand.pdf
They went on to cite “a fox squirrel being choked”, “another fox squirrel in a public area on several peoples’ heads and shoulders”, “a juvenile raccoon chewing on the lead of a pencil”, and “a fox squirrel wearing a t-shirt”. In yet another instance a “bobcat kitten” went missing.
Cummins was then notified that the Department, as the authorizing agency, “may revoke wildlife rehabilitation MOU’s for cause. The Department of Fish and Game has a signed copy of your MOU. Upon signing the MOU, you the permittee, agreed to comply to all of the conditions in the MOU and with the provisions of the California Code of Regulations.” Further, “This letter is being written to document the above situations and serves as a written warning of the Departments concern……the Department will revoke your Wildlife Rehabilitation Permit.”
The investigation went on for nearly 3 years while they built a case against Mary Cummins of Animal Advocates in Los Angeles. And then on February 2, 2012 the order came down and Mary Cummins was served via Certified Mail:
Subject: NOTICE OF DENIAL OF YOUR 2011 APPLICATION FOR A NEW NATIVE SPECIES EXHIBITING PERMIT
Reason for Denial:
1. “ The Department has determined that you submitted FALSE, INACCURATE, or otherwise MISLEADING information on your application.” (EDITORIAL NOTE: A section 1054(a) is code within the legal community for ‘you lied’).
FGC Section 1054(a), states that “It is unlawful to submit, or conspire to submit, any false, inaccurate, or otherwise misleading information on any application or other document offered or otherwise presented to the department for any purpose. Including but not limited to, obtaining a license, tag, permit or other privilege or entitlement pursuant to this code or regulations adopted thereto.”
a. “Curriculum Vitae” (EDITORIAL NOTE: This is the document wherein Mary thinks it is an accomplishment to state that she is proficient in Iphone and typing!). “The document titled “Curriculum Vitae” (CV) that is required pursuant to Section 671.1(c)(2)(C), Title 14, of the CCR, and was submitted with your application, includes SEVERAL items that are FALSE, INACCURATE, or otherwise MISLEADING information.”
“For the reasons stated above, your application for a Native Species Exhibiting Permit is hereby DENIED, pursuant to Section 671.1(c)(4)(A)1, Title 14, of the CCR. Your voided check is enclosed.”
In government terms that is a ‘adios and see you around because you are out of here, Mary Cummins of Animal Advocates’.
Write to the CADFG and lend your support for a job well done in having Mary Cummins license application DENIED. Also, commend Nicole Carion, Cummins game warden, for working so hard to make certain an animal abuser, Mary Cummins, was held accountable.
