SF Democratic Party's Opening Statements against Sheriff Mirkarimi Perpetrate More Lies

San Francisco City Attorney Democrat Dennis Herrera has made a case for having himself removed from office in wasting our tax dollars with his 27 page opening brief, his witness list and his 8 page letter on whether Sheriff Mirkarimi should cooperate with the city attorney all filed with the Ethics Commission on May 1, 2012 in the Democratic Party's frame-up of Sheriff Ross Mirkarimi.

While you read all this, keep in mind that all these domestic disputes have NOTHING TO DO WITH OFFICIAL MISCONDUCT AS SHERIFF. Please also keep in mind that all the Ethics Commission does is make a recommendation to the Board of Supervisors which decides to retain the Sheriff.

The witness list has an extraordinary, obviously prompted description of the proposed testimony of the beauty queen neighbor, Ivory Madison, in whom Mirkarimi’s wife confided. It claims “On January 1, 2012, Ms. Lopez and Ms. Madison met to talk about their goals for the coming year.” This is hilarious and has nothing to do with official misconduct of Ross Mirkarimi. These 2 women each have a baby in diapers who will spend the coming year in diapers at least part of the time (Lopez’ 2 year old should graduate from that phase this year) and each baby will do the usual endless whining that children do. These 2 women each have some other activity besides dealing with the endless demands of their children, but they are the primary babysitters.

We soon arrive at a sentence in Madison's proposed testimony that is an appalling insult to the intelligence of the reader and has no place in any legal statement: “Sheriff Mirkarimi responded by screaming at Ms. Lopez, saying fuck you, fuck you, and turning the car around, adding that Ms. Lopez didn’t deserve to eat.” Clearly, Dennis Herrera is showing off his “manhood” with this foul language in this witness list that mandates his removal from office as it certainly falls below the standard of decency, good faith and right action impliedly required of all public officers and he did this in his official capacity as city attorney. Sheriff Mirkarimi’s domestic problems were not in his official capacity as sheriff. They did mandate a trip to a marriage counselor, which is all Ivory Madison, a law school graduate who has not passed the California bar and thus is not licensed to practice law, should have recommended. If she had any sense, she should have kept out of this. Instead, she went to the trouble of making a video of a bruise that healed in a week and was an inadvertent bruise, not a deliberate violent attack.

Another person Herrera put on this witness list is Callie Williams, a neighbor who “sometimes heard fighting between Ms. Lopez and Sheriff Mirkarimi.” This is the stupidity of marriage as marital disputes are routine and sometimes ridiculous statements are made. It is outrageous that our tax dollars were spent recording a neighbor’s statements about a marriage that have absolutely nothing to do with official misconduct of Sheriff Mirkarimi.

What has been clear from the beginning is that a very unequal marriage is being used to frame a duly elected sheriff so as to remove him from office so he will not expose Mayor Ed Lee’s election fraud and so he cannot stop foreclosures and evictions. This marriage is unequal in terms of age, with Ross being essentially a grandparent and parent at age 50 to a 2 year old as age 35 is the last year one can be just a parent, he is some 14 years older than his wife, and they are culturally from different worlds with his wife having lived her life in Venezuela, speaking Spanish, and he has lived his life in this backward country, speaking English, each used to the customs of their respective native lands. Such a marriage is soon before a marriage counselor. This has nothing to do with official misconduct as sheriff.

The lies as to the domestic dispute in the 27 page brief have been previously refuted. City Attorney Democrat Dennis Herrera adds more lies. He states “The ultimate purpose of enforcement proceedings like this one is to protect the public, not to punish an officeholder.” (p. 16). THIS IS NOT PROTECTION; THIS IS GRAND LARCENY OF OUR TAX DOLLARS TO FRAME A DULY ELECTED SHERIFF IN THE INTERESTS OF AN ELECTION FRAUDING MAYOR AND THE CAPITALIST CLASS. If one is to “protect the public faith” as Herrera claims to be doing, then it is Herrera and Mayor Lee who should be removed from office immediately. City Attorney Herrera and Mayor Lee are punishing Mirkarimi by denying him his paycheck so now he cannot feed his family or support himself. Should their Democratic Party succeed in terrorizing the Board of Supervisors, Mirkarimi will be permanently unable to feed his family.
