Unjust, Unfair And Possibly Illegal! Eviction of Occupy South San Francisco

On Wednedsay, March 5th, Police with the banks stormed in and raided a building owner and her tenants. Now, the follow-up legal case is finding that not only was this illegal; the space will be retaken to provide a positive force for change in the whole country.
My name is Jackie Jo Lopez and this is my story. I am asking for help to bring my plight to the attention of the media and San Francisco City Hall.

I am a small business owner with a lease and I was abruptly evicted without being given a proper eviction notice. I was forced by the San Francisco police to vacate my place of business and was not given a chance to remove my belongings. The building was sold and I am being forced to pay the price in the form of loss of business. Additionally, my belongings have been lost and destroyed.

I operate an events company. Currently I have two events planned for this weekend including a wedding. My customers have spent a lot of money and time and now as a result of the eviction it's too late for my customers to make other plans. I have been involved in the community in a positive way. During Thanksgiving I opened up my business to feed the homeless and even then I was almost prevented from helping out. My business is not only about surviving financially it is also about giving back to those in need.

I have struggled very hard to build my business and to have someone in the 1% income bracket take it all away is unfair, unjust and possibly illegal!

Please help me by bringing my story to the attention of the public. I am also asking for help to expose the people who have destroyed my business and possibly many others.

Everything written in this article is true with the exception of her belongings being lost or destroyed! At Ms. Lopezs request the new owners were instructed to hire a profesional moving company and have her belomgings sent to U-Haul Storage facility on Bayshore blvd. in San Francisco. They paid for 1 months storage and forwarded all of the facilities information to her. Also at the request of Ms. Lopez her vehicle was towed by Bobs Towing of SSF and was also put in a secured storage facility with all the information being forwarded to her.

With that being the only other issue to discus is Eddie Miller aka: Mr. Lopez husband of JackieJo and his comments about re-taking the building. We will be forwarding his itenerary to the South San Francisco Police for further review, but I have it on a tip that if Mr. and Mrs Lopez do not relocate outside of the state of California, that not only with the State board of Equilization be looking for them for collecting sales tax without having a valid re-sale license? But also that they are being investigated by Walnut Creek PD for elder abuse, and Creekside Grill owners will be interviewed.

I’d recommend spreading this news that there are a few people up there, and to just have officers let us know if there’s anything unreasonable.
I’m looking for an acknowledgement of the political, social, and ecological innovation around Berkeley and in the Bay.

Again (seventh email, phone calls, mail delivered, and fax), I am meeting today via email with you guys in order to secure acceptance that we might find temporary shelter in the park(s).
Mayor Quan has proven very unreasonable to deal with; I am hoping for acceptance in this case that we might find temporary shelter in the square at Smythe Kramer. These campers are the committed who might climb, which will keep out the problems.


For transparancy, I’ve included all of the email attempts to reach the chancellor. So far, his office phone recommended I email and then these emails with no response. So, I figure from the police chief or a general department email (feel free to forward this!) would be best to raise awareness of who occupy hillside support committees are can be best to deal with this situation.
The soul of this protest should speak to 99% cops. Let’s make a beautiful world for our children (just don’t mess with us) ^^ we have had continued police intervention, which cannot continue this way.

It was good talking to you on the phone earlier.
I , Edward Miller, am trying this to negotiate the long-term peaceful camp spot above Berkeley, at 0-Dwight Way. It’s regent property, but practically has been shown to be a great space that’s near-deserted (only 30% of the housing above is now occupied) and we’ve had no community complaints (the heroin? one was because of a peace band, and officers clearly knew it not to be true, being us heh) but we have had continued police intervention, which cannot continue this way.
My group has great things we need to do, a mission much larger than protesting the police or the chancellor. We can build peaceful political, economic, social, and ecological solutions to world problems if given a few days of peace. You guys also have great things to do with your time, and we understand that it’s good to have the UC officers around on call, perhaps by blue button phone in case of emergency, but I understand that responding to calls is more important than a raid encounter every night. So I’d recommend spreading this news that there are a few people up there, and to just have officers not approach way up there on the hill. Maybe next week with Captain Steve Rodrick will be a good chance to test it out.

Now the fifth copy, and the fourth email the office has been sent. The police of Cal are not listening to department emails or being reasonable, so I’d like to talk with the Chancellor.

The plan for this area is to build the tools to solve poverty in this country. At a time where 1 in two Americans is below the poverty line, it is clear that we need solutions that work for everybody. Hi to whom it may concern,
I come to you today as an individual, with a small group of friends in solidarity as a support group. We are refugees of a Berkeley tent city, where some of us were camped before eviction. Some of us have day jobs, wilderness experience, sustainability degrees, art degrees, medicine interests, and feelings. Today, we face the problem of many young individuals raised in a system which we are protesting directly with democratic and peaceful assembly. Today, the request is approval of a small camp at Smythe Fernwald property. We come to you today with a most basic of needs and requests; we are learning what those basic needs and requests are.
1. Assurance of safety.
a. We know about health. Good medicine and keeping things decent is the reason I am writing this email. There is no better medicine then peace and; let those who are the most in need of healing in society come to “Che camp” where we are established at the base of Claremont Canyon and a whole regional parks system that can support them. I have already talked with folks from the regional parks, and they seem quite reasonable. It’s good exercise and exploration to explore parks and live with nature and eat healthy food. Native Americans know further about how to provide the opportunity of health to a common group. Community is healthy, too. For those genuinely concerned in the health and human services of the camp, we would request access to use a restroom that can be recommended in response to this email.
b. We know about security. From experience, a system of mostly peacekeepers and an order to ”dogs” (at the independent UC police) to stand down WILL work best for security. If anything occurs, having an infrastructure for emergencies will be essential to maintaining this camp. I simply ask today that after the chancellor’s support, University police tasked with maintenence of that area can simply respond to calls from the blue button phones for now. We do not need lights in our eyes, in fact a basic understanding of civil liberties and the people you are hired TO PROTECT from those amongst you who would cause problems is sufficient. If these basic rights arguments are not sufficient for a reasonable dialogue with “the police,” support from the city of Berkeley and internal affairs lawsuits in your own office may speak to the most hard-headed. Please, respect our first amendment right to assemble.. I need assurance that Berkeley Cal police will not be an interference with land that is a housing project.

2. Houseless youth and helping the most needy
Again, I am meeting today via email with you guys in order to secure acceptance that we might find temporary shelter in the park(s).
We are a small group of peace-loving assembly-people, with nonprofit and legal support, hoping to start a long-term peaceful occupy spot within the East Bay. We’re starting a housing project that’s bottom-up and is soon a 501c3 and foundation. If some would like housing, this would be great to organize with health and human services at Berkeley City Hall, and the Smythe Fernwald (not the physical center, but the services) in order to find a place for some. Ideal in my mind would be a farm because, what industry is left for (us) here in the US? Farming, and community and urban gardening, is a future for America’s youth. 14th Feb 2012 Open Letter to the Chancellor, UC BerkeleyHello,

In the spirit of the police review commission yesterday, I’d like to extend a welcome to the Chancellor to come to a meeting on Wednesday, in the creation of a peaceful protest mission statement. This is now the sixth copy, and the fifth email the office has been sent. Also copied are a student, community member, and staff who served on the board yesterday. These are hopefully enough caucus to get some respect and basic human dignity from this office.
The police of Cal are not listening to department emails or being reasonable, so we’d like to talk with the Chancellor.
We’re looking for an acknowledgement of the political, social, and ecological innovation around Berkeley and in the Bay.
Again, we are meeting today via email with you guys in order to secure acceptance that we might find temporary shelter in the park(s).
Please come for a wonderful peacekeeping meeting at the Question Mark Cafe, with the interfaith and support committees of Occupy Hillside and Occupy Cal.

5th Feb 2012 Events for the week: Hillside Dinner and Tilden Regional Bus tomorrowHi!

There will be two inaugural events for the Berkeley and Oakland Occupy communities at Hillside tonight and tomorrow. We hope to have the full support of people as we continue to establish this movement:

1.~ 5:30 tonight (and every night) — Dinner at Occupy Hillside. Leave from People’s park at around 5:30 when it’s getting dark to go watch the sunset and occupy. Tonight (Sunday) we have big baguette pre-prepared sandwiches that are going out after we get don weith the sunset. Let’s hold space and occupy/discuss…
2.12:00 TOMORROW (Monday) LEAVING FROM PEOPLE’S PARK: Bus ride to Tilden park. 12:00 noon we will meet up and go and take a group campsite (we’re paying for it maybe in long term, too) New Woodland Group Campsite in Tilden Nature Area.
Tilden, and Wildcat canyon areas have proven to be good areas to camp.

Crime

If you are the victim of a crime, observe a crime or suspicious behavior, call the U.C. Police department immediately at 642-6760; from a cellphone, call 642-3333. In a life-threatening situation, call 911.

After calling the police, please call the Resident Advisor. The RA keeps a log of crimes that take place on the grounds and issues ‘Crime Alerts’ when necessary.

Fire Safety

•All apartments are equipped with smoke detectors. It is important for the safety of your family that these remain in good working order.
•If your smoke detector is not working (it is a good idea to test it monthly), please contact the Office so that it can be repaired or replaced.
•If you live in buildings E, H, or Jand your smoke detector goes off accidentally:
•Immediately open the doors and windows to clear the smoke.
•There is no shut-off switch and there are no batteries to disconnect, so the only way to stop it is to clear the smoke from the detector.
•The fire department will be summoned automatically if the heat sensor is triggered in an apartment for more than two minutes.
•If you live in buildings F or Gand your smoke detector goes off accidentally:
•DO NOTopen your door to clear the smoke from a false alarm. The fire department will be summoned automatically if the smoke detector in the hallway is set off.
•The smoke detectors in the bedrooms are battery operated and not connected to the Fire Panel, so they do not summon the fire department.
•Please remember to call the Fire Department whenever you suspect a fire, DO NOT rely on the fire detection system to notify them. By law when the fire alarm is activated, everyone must evacuate the building even if you believe there is no real fire.
Earthquakes

A serious earthquake could occur during your stay here; the Hayward fault runs through the property, above the lower field area. After an earthquake, you should be prepared to live for several days without electricity, running water and with little or no outside help (Dwight Way may not be passable).

Red Cross website provides a comprehensive information about how to prepare you and your family for a major earthquake. Spend some time going over the website in detail, and also refer to the Earthquake Safety Checklist.

At a minimum, all residents should keep a supply of bottled water (one gallon per person per day is recommended), one or more flashlights per adult with extra fresh batteries, and a first aid kit. Plastic jugs of water can be purchased at local supermarkets. Water that is stored should be replaced once or twice a year.

At least one flashlight should be kept near your bed; you will need it close at hand if an earthquake occurs while you are asleep, as the floor may be littered with broken glass. Also be sure that shoes for all family members are easily accessible. Again, the floor and ground outside are likely to be covered with broken glass and debris.

Do not run outside during an earthquake; you risk injury from falling objects. Rather, get yourself and family members under a desk or table. (It is a good idea for children to practice this ahead of time). Once the shaking has stopped, leave your apartment and gather outside your building. Please try to stay calm.

After you have made sure your family is all right, look around and see what kind of help is necessary. A preliminary assessment of injuries, damages and what kind of help is needed should rapidly be communicated to the Resident Advisor, Office Assistant or the Manager, who will be in touch with central campus authorities. In a major event, volunteers will be needed to direct traffic and carry messages and supplies. If you are able to help, please come forward.

After everyone in the buildings has been accounted for, residents should report to the lower field, where any further evacuation will be planned.

If you are interested in helping other residents after a disaster, and especially if you are certified in adult and/or infant CPR, please let the RA, Office Assistant & building reps know (see list of building reps on page 28). The more prepared each building is before a disaster, the better off each resident will be.

The site manager coordinates annual disaster preparedness meetings. All residents are welcome. During these meetings you can pick up brochures and tips that will help you be prepared in case of a major earthquake.

Crime Prevention

Generally, there has been very little crime at Smyth-Fernwald. Despite the pastoral natural setting of the complex, it is only a few blocks from a vibrant urban center. Residents should exercise the same caution about their personal security that they would in any large city.

It is vital that you get to know your neighbors as soon as possible and that you at least recognize the occupants of your building. The Residents Association can help fund building-wide social gatherings so that you can get to know your neighbors better.

If you observe suspicious persons, call the campus police immediately at 642-6760, or 642-3333 over a cell phone. Someone is suspicious not because of their race or style of dress, but because they are behaving in a suspicious manner; hanging around a building or parking lot without appearing to be visiting anyone or sitting in a parked car. In the past, prompt action by residents has resulted in several arrests.

Do not let people you are not sure of into your apartment; they may be there to case the apartment and obtain your phone number with the intention of coming back when you are not home to rip you off. All U.C. employees should be wearing a uniform or carrying an ID Card. Always insist on proper identification from anyone (phone company, cable company, maintenance, etc.) who wishes to enter your apartment.

Some outdoor bike racks are available for residents use as well as the storage room in G building. Since bicycle thefts have been common in the past, we recommend that residents use the bicycle storage room.

Make sure that cars are securely locked. Do not leave personal items in cars (ex: CD’s, briefcases, purses and wallets, etc.), as this might entice would-be vandals to break into your car. You might consider investing in a car alarm or a steering wheel lock device to deter car thefts.

If you enter or leave the complex especially late at night, never jeopardize your own safety by approaching individuals who are behaving suspiciously. If you observe such behavior, you have at least two options. If you feel safe doing so, park your car and quickly go to your apartment and call UC Police or 911. If you do not feel safe leaving the protection of your car, turn around, leave the complex and find a telephone from which you feel safe calling the UC Police or 911.

There are three emergency call boxes on the site: lower parking lot, outside G laundry room, at J parking lot. All are identified by a blue light. When a community comes together against such crimes, criminals sense that unity and generally move on to another, easier target.

Hi, this is Eddie Miller the original writer of the article. I have been impersonated in the above two comments. Typos, bad grammar in the second sentence with the possessive, a random threat ... Freedom of the press, but I will copy this to the IndyBay staff to decide on . Omar Bahnasy is an evil man and I stand by the value of my own name. We have rights and they were violated. I (as well as legitimate tenant witnesses) had a lease in that building in South San Francisco at 415 Grand Avenue for my bike shop startup for the community of South SF and was threatened verbally and threatened by Omar Bahnasy in this video: [vimeo link]

I would like to point out that this sort of abuse of money has been going on a long time against the tenants of San Francisco, especially those who are poorer with banks like Savvy Real Estate think that they can walk over with a 25%, $40,000 a month lease signed in duress to an elder woman. Delal Metwally and others like her are ruined along with small business person Jackie Jo Lopez and two startups with Occupy tenants in the bay area and Ron Paul Campaign and Wendy Pope who had been there over a month and gotten mail there and other witnesses because of Omar Bahnasy and Michael S. "Savvy" Kraszulyak. Now I seek justice within the system. We were wrongfully evicted, and are the rightful tenants. Curtis Heinz is the proper owner of the building. We have the lease. Tenant paid rent to the new owner. Omar is the only problem here, and we suspect he is working with Savvy. The written comment above should provide good evidence for the police that he is trying to threaten myself and my client with some kind of blackmail. I do not respond to threats. We seek justice within the legal system of the United States of America. A signed letter from Curtis that we have as evidence will clear this up.

I stand by my rights, documents are uploaded online so that they will be available to everyone, and I have a very good lawyer if Mr. Bahnasy thinks he has been wronged in any way by me, he is welcome to file a case against Eddie Miller. We my client and I have been continue to be harrassed and attempted to be tricked over and over again; now impersonated in an attempt to .. what? .. There's evidence this man has worked with to corrupt the police and government in an otherwise working system.

I will finally say that yes, I identify with Hillside. In fact , we have a video of Omar Bahnasy supporting having an occupy in Delal and Jackie's building. Occupy just wants the tents, Omar. We are going to set up at Hillside after this week :)
