Save KPFA: Occupying The Lies

by Tracy Rosenberg
Save KPFA continues to broadcast bald-faced lies in the interests of destabilizing radical radio.

In the middle of a Bay Area convulsion over the brutal treatment of Oakland occupiers and a growing conviction by people all over the country that they are tired of being lied to and manipulated: Save KPFA continues to broadcast bald-faced lies in the interests of destabilizing radical radio.

This has got to stop.

Once again, they shamelessly accuse Pacifica of not responding when they know perfectly well a response was sent on October 21st, confirming all 403B payments are current.

(See attachment).

Enclosed is a copy of the last completed pension audit.

How, in a time of such social unrest and exciting possibilities for change, can it be top priority to disseminate lies over and over again?

As someone directly affected by this, I can assure you that my concern was not due to a bizzare scheme to 'destabilize' the station, but rather due to a very valid concern over the state of the retirement plan that is supposed to be part of my compensation at KPFA. The timing of a letter is the least important item here. Looking back over a 18 months worth of statements, it seems that for the last year Pacifica has been in a continual state of 'catch up'. In November of last year, they were two months behind as well, varied between then and now,but haven't caught up money wise until just now. If I understand our plan correctly, the legal deadline is seven days.
The last four payments were on Oct 20,21,24,26. If you count the 20,and 21 to August, then you have 24th and the 26th. Even if you apply these to the most recent paychecks, (Sept 30 and Oct 15), they are still late. Today, Oct 31 is another paycheck,Pacifica has until Nov 7 to show that it can apply 403(b) payments on time, like every other employer is required to under law. And that is simply following the law.
This is not even counting the issue, that if the funds your money was supposed to be put into went up during the time period it was missing, then you lost that money as well.

If it turns out, that it wasn't simply getting behind, but that Pacifica has been using 403(b) plan contributions to pay other bills as a kind of no interest loan, that's an even more serious matter.
That too would be illegal.

Finally, the audited plan you have included, is for the Pension plan which is completely different and unrelated to the 403(b) plan that Arlene's letter talks about or the subject of Save KPFA's post.

The due date on the payments in question is the 15th working day of the next month . September payments are due by mid-to-late October, October payments are due by mid-to-late November.

So it seems you don't understand much clearly at all.

The document Tracy posted is not even the same pension plan (yes, Pacifica has more than one), and even if it were, it is over a year out of date.

Audits are only performed once a year. Pacifica pays for them. The point is that despite all the accusations, the retirement plan which has considerably more assets in it than the 403B accounts is untouched and in perfect order, as it will be in this year's audit.

And the 403B payments are now entirely current, so calm thyselves and go back to sqawking about something else.

There is no there there (or here here).
