Launch Americans with Disabilities Act fight to stop the death penalty at occupysf

Physician activist from Texas was a direct witness to a prominent forensic psychiatrist stating she had no significant knowledge of obstructive sleep apnea (OSA). This means that, under the Americans with Disabilities Act, she would not be considered competent or experienced to evaluate anyone with OSA as a mitigating cause of antisocial behavior. This forensic psychiatrist (Pascua-Lim) was trained in California. The co-director of the Harvard forensic Psychiatry Program was contacted and believes people cause their own difficulty breathing while asleep! An ADA attack on this forensic system which consists of pseudoscience promoted by Big Pharma has the potential to stop the death penalty in all states plus may include legal fees and punitive damages and may halt the commercialization of physician education. While I was attempting to sue the Texas State District court system to enforce the Americans with Disabilities Act right to allow testimony from an expert competent and experienced in my areas of disability (sleep medicine diagnoses like periodic limb movement disorder and obstructive sleep apnea), the State of Texas targeted my medical license. Explicitly stated was that the State believed I was incompetent because I initiated paper and verbal screenings for sleep apnea symptoms in my solo medical practice. I was aware that the research shows that 20% of the US population had OSA, typically undiagnosed and often associated with higher risks for hypertension, stroke, heart attacks, car accidents, social disarray like sexual abuse, divorce and more. However, the textbooks lag behind by about 15 years (at least!). So, I brought an experienced Board Certified Sleep Medicine physician with me to the Texas State Board of Medical Examiners. When introduced to him, Dr. Pascua-Lim stated, to my face, that she "didn't know hardly anything about sleep apnea". The Board decided to ignore the Sleep Medicine physician's statements that I was competent to practice medicine with accommodations for my areas of disability. I was ordered NOT to send MORE than 10% of my patient population for sleep apnea testing! Whoa! What a great opportunity to expose the system. I started trying to find attorneys who would recognize the opportunity to show that, since 7% of the US population has severe obstructive sleep apnea (typically men more than women), for these individuals forensic psychiatrists would not be competent nor experienced to evaluate them. I subsequently contacted the co-director of the Harvard medical School Forensic Psychiatrist program. He advertises heavily his services for forensic evaluation in legal publications. He believed that people develop obstructive sleep apnea when they become depressed over life events. Whoa! where in hell did he get this belief? I knew to call him because I had heard a faculty member of the Texas medical school in San Antonio,trained at Harvard, make virtually the same statement as he was lecturing to Family medicine residents and practicing physicians at St. David's Hospital at a continuing medicine event (for CME credit necessary for medical licensing).

I tried to pursue an ADA law suit against this medical licensing board in January 2005. Within 2 weeks, I was told that the legal writing expert who had agreed to contract and write this attack for me had died suddenly. I was not paranoid enough yet to get in my car and drive the 100 plus miles to the town he lived/worked into investigate if he was alive or not. His website was reportedly down suddenly also. I experienced stalking, various forms of harassment endangering not only myself but my family. I left Texas only to find prominent civil rights organizations and prominent lawyers either not responding to my requests for assistance or not responding appropriately. This information is discussed more fully in my blog cynthiajeanneleemd.wordpress.com Since this would be a major suit and would eventually cost Big Pharma a lot of profits (as they seem to be influencing the psychiatric profession's ability to make accurate diagnoses...so that a psychiatric diagnosis is mistakenly made and a psychiatric drug prescribed in stead of CPAP) I believe it can be established that they are using U S government "assets" and State of Texas employees to illegally to suppress whistleblowers

The right to sue your government is a first amendment right and cannot be denied. This represents a RICO situation as in Racketering Influenced Corrupt Organization, much as the activist organizations in the SF bay area have expressed many times. This means that in addition to legal fees and punitive damages, the persons injured by this behavior of the forensic experts with corrupted education may also be allowed triple damages. Think of it. Reparations for prisoners ill with lead toxicity or other toxins causing illnessesThat may only be a pipe dream, but the process of pursuing an ADA attack on the Death penalty and criminal justice system may initiate the changes we need to see anyway.
