Oakland's Safehouse Experience Violent Attack After Attempted Unlawful Eviction
This afternoon, owners of 3277 Martin Luther King Blvd in Oakland attempted to unlawfully evict it's residents. After OPD deemed the situation a civil matter to be solved in court, owners broke through blockades into the house where they assault occupiers and damaged property. OPD came back to the house several hours later and arrested one of the homeowners on assault charges. Tenants and community supporters continue to occupy the Safehouse after being threatened with more violence tonight and in the near future. A video of the homeowners assaulting occupiers is linked.
Today, December 2, 2010, the tenants of the Safehouse at 3277 Martin Luther King Blvd, Oakland, with supporters in the community blockaded entrances to the building in preparation for the owners' threats of violence towards them. At 12:45, the owners arrived with the intent to carry out their unlawful eviction (the Safehouse tenants occupied the building lawfully under California civil code 1006). The owners were accompanied by the OPD, but after assessing the situation, the police made the owners aware of the legalities of the situation, and that they could not lawfully remove the tenants.
At 1:15, when OPD left the scene, the 4 of the 8 owners and 4 of their associates hopped the fence, forcefully broke through barricades and entered the home, where they they began a rampage on the members of the house. Their verbal belligerence was paired with equally intense physical violence. The owners and accomplices swarmed the house with boards and hammers, throwing furniture and assaulting occupiers. Upon entering the kitchen, one owner hurled handfuls of knives at a group of occupiers. One occupier was slapped in the face; another was punched in the arm. After the hard barricades were broken, occupiers improvised soft barricades to obstruct entrances. In an attempt to break through the soft barricade, one accomplice stomped repeatedly on blockaders' heads, resulting in a concussion. 2 more accomplices waited outside of the house verbally assaulting people in the community that had arrived for support. Supporters were repeatedly called "Honkey" and "Faggot" and threatened with physical violence.
At 3:00, police arrived and restrained one of the owners, who is now being charged with assault. The other owners and accomplices fled the scene, yelling, "We'll be back tonight!" The Safehouse has decided to stay at their home and reinforce blockades against further threats of intrusion and emmenant violence.

i am a resident of the community and a witness to all the chaos that was taken place today on 33rd and martin Luther king way in oakland ca and i must say 90% of the article above is over exaggerated. Those people was asking for their property back which from what they showed to the police (was rightfully theirs) i wasn't able to get to close but i watched just like many of spectators from a far. and i didn't see any violence go on.. of course it was alot of shouting back and fourth between the owners and the trespassers. however nothing got to far out of line where anyone got hurt. i know some of the kids that are invading the house just by me passing by them day to day in the "community" which are the homeless squatters. They have stolen many of bikes and tools from people in the neighborhood and all over town. These people tend to play the victim in mostly all there situations. really they had the owners out numbered i seen the homeless squatters on the phone making many calls and sending more people to come to their aid for what reason i am not sure. . at least 30 squatters was already in the house. and 15 or so came up on bikes. alot of what is being said in this article is just not true. you said it yourself the owners of the safe house. they own that building! i have been waiting for them to leave my neighborhood for months now. and i can say after all the spry painting and vandalism and stealing they have done to many of the people in the " community" the squatters are getting what they deserved i have never seen not one time have they offered any kind of help or support in our community they keep saying community like its people up and down the street.. they are not a community they are people who invade on peoples property and take over. they used that house to their advantage and thought no one would come to claim it..Thats not their home that house belongs to a family who cam to take their home back! .i have known the owners descend family member who was the soul owner many years ago. all my life and he would be just devastated to see his family get disrespected like they did about their own property that he worked so hard for ... the squatters did so much damage to the property i do feel bad for the owners when they do have a chance to get rid of them... those squatters are playing victim when really they made most of the scene.Weather the owners came too soon or too late they came today!! and they wanted to claim whats rightfully theirs and for them to walk away empty handed i was shocked!! i don't know all the details myself however today was just a pure example of injustice one owner went to jail. and the rest went on their way. while these squatters are still in these peoples property. i lived in this community for over 30 years and never have i seen such a thing where homeowners of a property leave and go to jail and the squatters stay.. Race did play a big part the owners are African American and the squatters are all white not a black squatter in sight... (that tells you alot right there) i don't know how much time was giving to the people to leave but. myself i would just give that family their home and move on.. . i do wish my peace and blessings for both sides. my advice to the homeowners " give it time and make sure all the paper work is handled" and my advice for the squatters " give it up and just move to the next house". besides its enough of you to to rent a house out.
squatters im not buying it .. i had this problem before and i had the most hardest time ever getting rid of squatters and it coast me more to repair behind all the damage they caused my property if i was the homeowners i would keep calling the police and make sure all the paper work is right and go from there the damage is done once the squatters take over your home they hard to get rid of. You commenters must be paid by the 'owners'. I live in the neighbourhood and anyone who thinks the occupants of 3277 MLK are destroying the property and stealing bikes (wtf?) has never seen the house. The back yard has transformed from head high weeds to a garden filled with flowers and veggies (which was ripped apart by the spiteful group of owners i was told). And did you watch the video? How can you deny that no violence took place?
since you live in the neighborhood and are supporters of the squatters so much let them live on your property Ghosttowner i am a family friend of the 1st owner and no matter which way you put it thats their property they are entitled to it since you are impressed with the garden and what they can do. move all of them in with you. Everyone keeps saying "it's there property" but the residents there are tenants, and any property owner has to go through an eviction process to evict tenants, and give a minimum 30 day warning. It's because of people like the owners of the Safehouse that so many people in Oakland are getting unlawfully evicted right now, kicked out of their houses with little or no warning, often to let these houses sit vacant for years Stop taking advantage of poor people to make yourself richer!
o well.. if you moved in and have a rental agreement with the owners dont worry about it. if you have been paying your rent on time and doing all the necessary things as a tenant then dont worry about it.
I am a resident of the community as well and know and have become friends with the people who live at 3277 MLK. The tenants there have done an immense amount of repairs on that house. Noone in the area who knows that house can deny that it has been a blight for years untill the "squatters" moved in. They've repainted the facade, replaced broken windows, cut down the jungle of weeds, cleaned out all the trash that has accumulated in the yard over years, put in a beautiful garden, hosted potlucks and community events, and taught free school classes! They are an asset to the community! They have done more to enrich the community in the last 7 months or so that they've been there than the "owners" have done in the 30 years that they have left the house to rot.
All of the Safehouse occupiers deserve the utmost respect and admiration for their sacrifices from the entire anti-capitalist, anti-statist radical community.
I have seen nothing but improvements since the people who now occupy the Safe House have moved in. They have cleaned up the house and improved the neighborhood by occupying a house that would otherwise be (and has been) used as another drug and crime trap. They have a community space and free clothes and a library. They help neighborhood kids fix up their bikes. Not once have I visited the Safe House when someone wasn't working on, making, or fixing something. It is refreshing to see youth and young adults like the tenants of the Safe House with such motivation and determination to take on and accomplish such a huge project, especially in radical scenes where laziness, drug use and scum-baggery is so prominent.

Unfortunately, there are homeowners out there with "underwater" mortgages whose lives have become just as precarious as that of squatters. They can't afford to fix the place up because the house has become devalued and they can barely make the monthly payment to the bank. I'm not saying this house is in that situation but I'd hope that the squatters would try to find this out. There is possible class solidarity here! Not probable, but possible.

Fuck them! They threw knives at the tenants (which is on video http://www.youtube.com/watch?v=P-xZr3CxFfU&NR=1), slapped people, broke a plate over some one's head, and kicked some one else in the head(on video too!). How could anyone take their side? The owners new that people were staying there, and gave them permission. In California you have to give at least 30 days notice of eviction and you can't just beat the shit out of your tenants if they don't do what you say! Thats why one of the owners got arrested and the tenants didn't, because they were the ones breaking the laws not the tenants. What would you do if your landlord brok into you're apartment and attacked you? I give the tenants props for not getting violent back. Stay strong SafeHouse!
I was there for a majority of the "altercation". I witnessed a lot of sketchy comments made by the supposed "anti-authoritarian" squatters. Even ignoring those very questionable statements, the occupiers as a collective and as individuals lost any credibility and/or trust they had going for them. Before praising them as "anti-capitalist", "anti-statist" and "anti-authoritarian" is should be made clear that the occupiers were in fact the ones that called the cops the second time around and were more than willing to file police reports and press charges on the family resulting in one of the family members being arrested. It was one individual who called the cops with several people totally co-operated with the cops, yet they still had the backing of the majority of the occupiers.
Did the family break the barricades? Yes. Did they destroy furniture? Yes. While I am not defending the legitimacy of private property and while I share affinity with squaters and anti-authoritarians, it is quite ironic that the family went about this without any police help and it was in fact the occupiers who called the police to protect them. If the occupiers actually wanted to protect their property they had the capability to fight back and resist, instead they chose to sit down and practically sing kumbaya, while the owners tore away at their stuff. If you can't protect your house and your friends then you probably shouldn't be squatting and go rent a loft somewhere in Berekly. those videos give me no sympathy for the squatters. just a bunch of punks playing poor and getting excited at the chance to be self-righteous. if I was trying to take back a house that my family owned and there were kids who had barricaded themselves inside, acting like they had a right to be there and I didn't, I'd be pissed off, too. I agree that is was really shitty that the cops had to come and someone (anyone) got taken to jail. But what went down yesterday was beyond what we all thought could conceivably happen. Its easy to criticize our handling of this chaotic situation, but we felt we were left with little other option at the time. Fighting back would have ended in a blood bath, and giving up would mean the death of a space that could be a radical center for the neighbourhood and greater community. Those guaking outside (and later criticizing) were asked a number of times by a number of people to participate in our decision making and actions. Maybe with your support and superior ideals we could have survived the night without the cops. Unfortunately we didnt get your support, only your criticism.

I personally know the owners of the home and have spoken with them and others in the local community. It should be 1st identified that the individuals currently in the home were never "renters", "tenants", or "authorized occupants" of the home. The homeowners have never agreed to let the trespassers stay there and never requested rent or any compensation because they had no idea the vagrants were there. The home has been tied up in legal battles for several years and as result the current owners had not been able to occupy the home. The owners came initially in peace to rightfully ask that the trespassers vacate their home. You cannot just take someone property w/o consent, that is called robbery. Many of the trespassers seems to thoroughly understand the law and have a decent education. Why not put those assets to good use and get a job, their own PURCHASED property and then create a "safehouse"? For the life of me I cannot fathom how one would think he could just take someone's house and make it their own with the only reasoning "You were not using it". That is ludicrous!!!

Some of them have even come over an commended us on the improvements we've made, hung out with us, and been quite friendly. Obviously the owners of the house want the house back, but by California code 1006 the occupants of the house are considered "tenants" which is why the owners need to file eviction papers. The owners came with the police, who told them exactly that. That is why the owner was arrested and not the occupants. Why break into the house and start throwing shit at people? Why not just file the eviction papers? Is it just a matter of pride? That is what I don't understand.

I've heard anarchists talk a lot about "respecting the diversity of tactics" and being anti-statist, but really thats all a bunch of shit. How many kids in black hoodies who call themselves anarchists were out there in the streets crying about Mehserle not getting a long enough sentence and how it was some failure of "justice" and the legal system. Truth is, those same fucking people are doing the criticizing about the cops getting called now, thats pretty hypocritical. And now after the fact, these arm-chair anarchists want to seem self-righteous about the reasons why they were too scared, apathetic, or just "better anachists" to get involved and help out the SafeHouse. I say that anarchists have no solidarity because most people who claim that as there identity spend their time bickering in circles about tactics and idealogy or picking locks and doing stick-and-poke tatoos than actually doing anything awesome or would rather criticize than help. The people at the SafeHouse are awesome. They did fuck up some things, thats obviouse, but they have learned from their mistakes.

For those of you defending the owners saying it's their property and they have every right to kick those squatters out, let me ask you this:
When people who own a home neglect it and leave it boarded up for years, letting it become a crack den with syringes and shit everywhere (which the squatters cleaned up), for YEARS, and then once people move in and make it liveable, how much right do those owners really have over it?
Before those squatters moved in, there was literally shit everywhere and trash and needles, and they cleaned it all up, built stairs in the back, built a garden - and the preschool next door asked them to come teach the kids how to garden. But you think its better for the owners to just leave it boarded up for junkies to break into and do drugs in at night and deficate in?

1st i think you need to get your facts straight as far as what your calling the owners you need to go do your history on the property and understand when it rightfully became the owners property due to them fighting for it for over ten years with there own legal issues.. then after you find out the true info on that.. then bust out with your opinion ... on why its been sitting so long!!

You may have been one of the many "spectators" during these events, but that doesn't mean you know ANYTHING about the situation. As one of the original occupants of the house I'd love to set some things straight for you. First, the building in question has been un occupied and ignored for over 18 years. this is a fact. we know this because we researched the building and its history and found out that there hasn't been water service there in 18 years. another interesting fact is that the current owners of the property haven't paid ANY back or current property taxes or blight fees on they're property since they became legal owners. We even went as far as to call these owners personally to ask them about their intent for the building. all of those whom we managed to get ahold of denied having any connection with or knowledge of the house. To me, these things don't indicate that the owners had any interest in there building at all. It seemed as though none of them wanted anything to do with the building, or its debts. we, however are more than willing to take on this debt. WE are willing to follow city ordinance and keep the lawn clean. WE are willing to pay the back taxes.

On Sunday, October 10th, a group known as Creative Housing Liberation occupied Hotel Leslie in downtown San Francisco. This occupation was planned as part of a rally and march for World Homeless Day. Over 120 people convened for this event, which began around noon at Civic Center with speakers, musicians and spoken word. Eventually, the group marched up Larkin Street to the hotel, gathering outside for more performances and speakers, food and music, tours of the abandoned building, and the eventual occupation of the building by a core group of people

As much as I don't like all the unpleasant rules and regulations that our society has become encumbered with, to live without them would be a step backwards towards primitive tribalism. One problem as I see it is that theres literally about twenty million vacant homes around the country, and theres millions of people that live on the street because of private property laws keeping them out. What are cops for 999 times out of 1000? Protecting it. What do the laws of the racist capitalist state do throughout history to working class people of all colors? Shut them down when they try to assert a right that goes against the owners of society, with jail, violence, discrediting, etc. Its the middle class dream that has bought off too many Americans, mostly white but black too in recent decades.
This family probably neglected the house because it would have cost them too much. As we were not at the house when these events went down we really cant comment on them. People should always have some common sense and be mindful of what your saying. Lets get some things clear:
-The building has been abandoned for about 10 years and used for various things (used as a flop squat, crack house and many other things), the recent group of us who have been squatting there wanted to make it a home and refuge for people who need a place to stay, we fixed up the building, got the water turned on in our name and paid the bills. Since we started staying in the house we have sought to befriend the neighbors and made friends with many of them who are in support of what we were doing. There have been many times when neighbors came over to tell us that they support and are excited about what we are doing. The bike mechanics of the house fixed up bike of the kids in the neighborhood and were planning neighborhood BBQs (which never happened due to the recent illegal eviction). I personally am confident that we have alot of support from the local community.
- When SOME of the owners (some were supportive of us and said they had no interest in kicking us out) cut our locks and broke into the back door they proceeded to destroy the large garden we had and destroyed many things in the house including breaking the sofa and throwing it down the stairs. We have talked to the main owner who led the charge who refused to treat women the sam as men, talk to them or even shake their hand. While some of the owners and their muscle were trashing the house the stole many things (including a laptop and guitar), threw knives at people, smashed a plate over a persons head and slammed a bookcase on a girl.
The people occupying the house have legal right to live at the space through several laws and documents the break in/ trashing of the house and the later eviction were both illegal, violent strong arm attacks on the people who are currently residing at the house. I personally never advocate calling the police, EVER! However if a person who is not a stubborn of an anti-authoritarian am me might call the pigs if they were assaulted, all it takes is one person to do that and it doesn't reflect the principles of the majority of the house.
I would say that their is very little tension "between black people in Oakland and the white young people who occupy Oakland's neighborhoods. " that is a stark over exaggeration. We have lived in Oakland for a while and feel part of the community, and it is better to squat and fix up an abandoned building then sleep on the street or in a park like many from the house (myself included). The whole project of the Safehouse, in my opinion, was to demonstrate a way of thinking and living to support "use value" over "property value" and not let buildings which can house people be abandoned and destroyed. I cant speak for the actions of the people of the house in the last several days but I have absolutely no regrets about occupying the abandoned space which a group of friends which considers itself family fix up and made it a home called the SafeHouse. We are not a political group, we are a family with various political and moral beliefs who see value in working with each other to get through problems together, caring and looking out for each other, and in this sense the Safehouse family can only be destroyed but it self so we must maintain our principles. muslimah queen, actually, I was not there when this went down, I am out of state seeking temporary work, the 7 (7 out of 10) of the actual tenants who actually lived their permanently and fixed the place up our out of state and are completely against calling the police which legitimizes and seeks to use the power of the state and the pigs that we are against instead of demonstrating that we can solve problems without them, we seek to demonstrate that we can overcome the many obstacles in our daily lives. ANSWER : we did not abandoned the property!!! we just became rightfully owners of the property in the summer of 2009.. as you know there are more then3 owners of the property as a family they waited to come up with a plan for everyone to be pleased with what ideas that were going to take place with the property so pow!
Explain to me why you left the property empty for ten years while waiting on the courts, but your not waiting on the courts to follow the proper eviction procedures?
ANSWER :and how could my family take care of the property for ten years when we just started to have ownership of the property IN 2009 we had no legal right to the property untill 2009 is that 10 years??? i didnt think so... so miss me with that 10 years bull and NO eviction papers were needed for trespassers ..
Have you considered the fact that if you had maintained the property properly, and made use of it while the title issues were pending in court that you would not be in the situation where squatters take up residence on the property you claim to be yours? Have you not even considered the repercussions of your actions? hiring a bunch of thugs to strong-arm the building with weapons, and brute force-AFTER the police told you that you CANNOT legally evict the occupants outside of civil court- looks REALLY bad on you; especially to a judge. We have legal support, and know the law. you directly disobeyed the instructions given to you by the oakland police department. I guess we owe you a thanks for that.... you and your violent methods will condemn you in the long run, and makes us look a whole lot better than you in court. afterall, those "fake documents" aren't. i was there when they we researched, found and filed. whether you want to believe it or not, they are the real deal. they demonstrate our ability to follow the law in order to accomplish our goals.... you on the other hand have only demonstrated your lack of respect for the law, and violent tenancies. if you hadn't have hired the invaders to threaten the occupants with deadly force, you may have stood more ofa chance in court.... too bad :)
if we want any chance of legally inhabiting the safehouse, we need to rise above and not stoop down to the level you have. your violence will hurt you in the end. ever heard of martin luther king? i think its absolutely appropriate that the occupants defend themselves through non-violence, especially on the street that bears that name.
with the property in ythe condition it is in, the owners could not legally rent it out. it would cost tens of thousands of dollars to make it "inhabitable"

If a deceased family member owned the property his or her decendants became owners upon his or her death with the right to enter the property. Now you say that you have only owned the property for 3 years.

Still, waiting 3 years before at least doing a little maintenance is still irresponsible.
If I had such a unified family to attack squatters I would have gotten my family together sooner after my father, mother, uncle etc. passed away and fixed up the house. It seems like you and your family are just making excuses for your own negligence and pretending that you are the victim.
Since you have resorted to violence you will have to deal with the repurcussion of your actions in court. Meanwhile, the squatters have had their belongings stolen by your family and are scrambling during the winter to find places to stay.

what a can of worms good job radicalizing the masses squatters when these people saw the state woud not help them they took matters into their own hands
