FCGOA Defeats UGSOA at the Immigration and Customs Enforcement Headquarters in Wash DC
by FCGOA NEWS
Saturday Aug 28th, 2010 4:52 PM
UGSOA TROUBLES continue to mount as more and more UGSOA members reach out for help to FCGOA.

With over 100 officers eligible to vote in this election UGSOA's Troubles are just beginning as FCGOA Defeats UGSOA at the Immigration and Customs Enforcement Headquarters in Washington D.C. Today.

"Today's VICTORY by FCGOA against UGSOA and it's UGSOA Local 44 sends a clear message to UGSOA President Desiree Sullivan that all is NOT Well at UGSOA" Stated FCGOA President Guy James.

James also stated " that a Strong Labor Union requires that it's members understand that the Union is theirs and that the Union leadership be attuned to the desires of the members. Obviously UGSOA President Desiree Sullivan doesn't understand this...BUT FCGOA Does.

That's one of the major differences between the FCGOA and UGSOA". The Security Police Professionals working at the National Defense University found that out after voting FCGOA YES just last month.

On September 7 the National Labor Relations Board in Washington D.C. will be counting the ballots to decide if the 240 Justice Protective Service Officers working for WSI which are also members of UGSOA Local 44 in Washington D.C. are also going to join the 100 plus INS Security Police Officers who voted today in favor of joining FCGOA.

Subject: Re: MVM election conducted 8/27/2010

Congrats! to FCGOA and congrats! to MVM.

To all WSI personnel:

MVM got it right! Now, it is our turn to get the representation that we deserve. I am glad to have had the opportunity to meet with Mr. Guy James (P) and Mr. James Napolitano (VP) of the FCGOA International staff.

Listen. These guys know what is up! Federal Government Security is in a very high demand these days especially after 9/11/01, DON'T FORGET!!! I'm not trying to insult anyone's intelligence. But, rest assure the FCGOA is ready to represent us to the highest level and we definitely need it.

They actually walked around to checked up on us... WOW!! That is awesome!!! I actually felt respected for a change. I made sure that the brand new JPSO standing next to me at the time was clear that they are going to be our new union representatives.

In other words, VOTE FCGOA!!!

FCGOA is also awaiting the results of an election in case 16-RC-10932. FJC / UGSOA / FCGOA Texas which was filed back in April of 2010. At this time UGSOA President Desiree Sullivan is refusing to allow eight (8)challenged ballots to be opened and counted in this election despite several NLRB rulings in favor of the FCGOA to count these challenged ballots having her attorneys file appeal after appeal on every ruling.

"UGSOA President Desiree Sullivan continues to deny these UGSOA officers an opportunity to have their voices heard knowing that these eight (8) challenged ballots would give the FCGOA a clear victory in this election". Stated FCGOA President Guy James.

UGSOA TROUBLES continue to mount as more and more UGSOA members reach out for help. In Washington D.C. the FCGOA has just signed a stipulated agreement to represent 130 Watkin Security Officers working at various DC school districts after UGSOA Desiree Sullivan DISCLAIMED INTEREST in this group after selling them off to SEIU 32 BJ. Press Here to Read

Now these same officers are in jeopardy of losing their jobs as SEIU 32 BJ puts pressure on the DC Council and it's DC Mayor Adrian Fenty to remove these contractors in their attempt we believe to bring in a friendlier contractor willing to recognize SEIU 32 BJ as their collective bargaining agent without a NLRB vote or certification. Both the FCGOA and former UGSOA Watkins Security officers are calling for an investigation by both the Department of Labor and Washington D.C. Attorney General Peter Nickles to investigate this matter.

UGSOA Local 80 in Washington D.C. is also having its troubles as UGSOA President Desiree Sullivan has placed this local under trusteeship. The Department of Labor has already started an investigation of this trusteeship and UGSOA Local 80 finances.

On July 29th 2010 UGSOA Vice President and Director of the Fed Division Michael Hough resigned from UGSOA citing he had no longer any confidence in the leadership of UGSOA President Desiree Sullivan or UGSOA. Michael Hough is now working for the SPFPA as their Western Regional Director. Press Here to see letter

Subject: Response to UGSOA Letter dated July 27, 2010

Date: July 30, 2010

Ms Desiree Sullivan’s, President UGSOA perspectives of Mr. Harsleys achievements are in error!

Ms. Sullivan believes that UGSOA local # 44 President Mr. Harsley has collected and/or accumulated, through bargaining, some enormous amount of money for us over the past 12-13 years. Actually he has negotiated our salaries downward more than 20 % below the market of other security contracts in the Washington, DC Metro area that covered the same period of time. Mr. Harsley accomplished this by informing us at each and every Collective Bargaining Agreement (CBA) negotiation time that this is the best he could do for us and that we needed to accept his conclusion so that we would at least have a new CBA Contract in hand before the new federal contract was awarded to a perspective vendor.

By voting in the new perspective Federal Contract Guards of America (FCGOA) Union, our dues will be less than the amount charged by UGSOA for the past 12-13 years for having accomplished nothing. They have given us only headaches and misery when trying to deal with incompetence and inequities in our expectations to have them support us in an honest and professional manner.

All international unions train their perspective union heads, local executive boards, and shop stewards. Training is not only unique to UGSOA as Ms. Sullivan implies.

Mr. Harsley’s 12-13 years of serving our membership under local # 44 as president has been pure hell. He has abused his power and authority, misused his position, and undercut our benefits with his manipulations by telling un-truths in order to accomplish his goals by deceiving the officers into accept his untruths. It’s time to replace Mr. Harsley, UGSOA Local # 44 and UGSOA international with a new and more progressive, honest, user friendly, officer oriented organization that serves the union membership needs, not their own needs, wants and desires.

The grievance process, proceedings and methods that Mr. Harsley has used to fulfill, and accomplish our needs and objectives have been misused and distorted to support the corporation more than the offices. When grievances are filed and the findings support the officers positions, and a request is made to forward a grievance to the next level, the local executive board votes and declares the grievance unworthy of their time, and spending of additional funds to process it further, in favor of the company and against the officers. Mr. Harsley has hurt officers benefits causing officers to lose money for 4 hours additional holiday pay, and overtime pay for all hours worked over 8 hours in 1 day by cancelling the arbitration meeting that was to take place this past June, 2010 with MVM Inc in order to settle this disagreement and grievance with them. Mr. Harsley said that he wasn’t prepared or ready to go to arbitration at that time. This was another favor for the company against the membership security officers by Mr. Harsley.

Mr. Harsley still continues to inform security officers who fail the firearms training course that they do not qualify for unemployment compensation after failing the range, as MVM Inc has advised him. Mr. Harsley reinforces the company policy onto the offices so that they do not file for unemployment benefits after being laid off. There are many other issues, however, we need to help and support the security officers on the FPS/MVM Inc. Ice Contract.

We need a new environment and union to accomplish this, and I believe and support The Federal Contract Guards of America (FCGOA), Mr. Guy James and company, to be the best selection for us to accomplish our goals and objectives.

Thanks

Dear Brothers and Sisters:

As an outsider looking in, I was new to most of what’s happening or happened with local #44. I constantly heard complaints about Local 44 but so what! Everybody complains about everything I said. There’s no perfect world. Then I started really paying attention to what was being complained about. A union that wasn't stepping up to the plate for the members. I saw decent men and women dismissed from their jobs with MVM, Inc. as building guards because they couldn't pass pistol qualification on a course that is designed for soldiers going to Iraq or Afghanistan.

Then there came a point when MVM Management attempted to soften things to the betterment of the Guards/PSO’s who failed the range and were fired. They were willing to let them maintain their seniority and the union said NO. What makes a union so despised, want to press on after making one capricious decision after another. WE DON'T WANT YOU, PERIOD! One job saved means everything. Many of the problems we've encountered could've been circumvented through common sense negotiations.

A good union must know how to negotiate when things are not necessarily in our favor and this local lacks those skills. Name calling and fits of rage have no place as it applies to us putting forth meaningful efforts to get changes for the better.

Sometimes you just don't know and that’s not a crime as long as you don't know that you don't know, but when you don't know and know that you don't know, THAT’S FRAUD! Don't be fooled by International Stats that have been publicized. Ask local 44 what cases right here within our local, all these great lawyers have represented our guards on. The general attitude of our union leaders are one of “They don't come to the meetings so to hell with them!” Meeting are important, but so is ones dedication to the office he’s been appointed to up-hold. It’s time for change. God Bless America.

Subject: RESPECT

Dear Guy F. James,

Today I noticed instant respect, compliments of Lt. L. Cardoza, in reference to allowing me to take a sick day. He only asked, upon revealing to him it might be due to food poisoning, what food I might have ingested to cause the incident. He then agreed I take the time off. No hassle what so ever. Not to worry I have safe guarded my issues via email.

This is the kind of respect I feel that not only I, but all members of FCGOA should receive on a continuous basis, unless member abuse is more than evident, therefore we manage the situation ourselves prior to being in favor of management. Finally, the day has come.

I received a complaint from a fellow co-worker Amanda Salinas, that after advising Lt. L. Cardoza, she contracted Strep throat and feared spreading the air-borne disease at work, he still forced her to work the post without regards to the gov. employees, federal contract employees, or the general public. This is unjust, unprofessional, and needs to be corrected.

If you decide, that I, Jason Gonzalez, has what it takes to run shop steward position. I give you my honest to god word that no grievance will be presented without merit, nor direct proof of unprofesionalism shown towards members and non-members alike. None the less will be adamant in enforcing rules and regulations as come to be expected of any members, by the Company, FPS, or Client to avoid such problems. In any case, the issue will be immediately brought to your attention, and actions taken will be not without your knowledge or consent.

Again this new found sudden respect is flattering at best, but I will not rest till every member of FCGOA receives the same. Unlike my adversaries in the UGSOA Local 218, I wish to spread respect to all members evenly, for they are the sole reason we exist. I strongly believe once neighboring unions catch wind of our attributive actions in the name of our members they will surely follow and wish to recruit FCGOA as their representative, thus making us, sooner or later the core union to deal with, once congress or senate decides to federalize us. I strongly believe that day will come and when it does we should, by then, have the majority of federal contract security officers in our favor, putting FCGOA as the newly FCGOA (Federal Guards of America). Dream Big.

I recently commended you on your actions in the recent hearings involving NLRB resulting in our favor. I wish to retract my commendations for the re-assertion of another, not only did you manage to gain favor of NLRB hearing agent, but forced recognition of Michael P. Hough upon himself, as incompetent and unable to resist following the foot steps of his predecessor, James Carney.

F***ING OUTSTANDING JOB, SIR!

I look forward to making history in your legacy, sir. Again on behalf of everyone, thank you.

Respectfully,

J.Gonzalez

Michael Hough's Thoughts about UGSOA. "For The Record, under Sullivan's lack of experience and leadership, the UGSOA is in total chaos and losing major revenue. Sullivan's record of backroom deals, lack of service to members, firing of loyal office employees and recent nepotism made it clear to me as a member of their Board that the UGSOA would not survive and that it was time to leave".

" I feel that the organization (UGSOA) has Lost Focus on its Purpose".

Former UGSOA Representative Ryszard Zurek

Congrats to FCGOA!

I have stated many times and will continue that Ms. Sullivan is "NOT" suited for the position she currently holds and should have never been put in that position. Mr. Carney has doomed her to failure! Her lack of educatio...n, work experience, business background, and work ethic will cause the demise of UGSOA.

The perception that UGSOA has lost its focus is not exclusive to Mr. Hough, as he has stated in his resignation letter, but to most UGSOA office staff and members of UGSOA. The office staff will not come forward because they fear they will lose their jobs. Ms. Sullivan’s track record for firing personnel will support this claim.

Mike, Congratulations! Sometimes we all have to make a decision for ourselves and our families. UGSOA does not appear to understand this. This was why I was terminated because I made a statement relative to the fact that should I become "lai...d-off" I may have to go to another Union such as SEIU or SPFPA so that I may continuing payi...ng my bills and taking care of my family.

Email From Levet Brown

The UGSOA International Refuses To adhere to the Members Request to Stop UGSOA Local 80' s Request to halt an internal Election at this time.

A Petition was Filed by 106 UGSOA Local 80 Court Security Officers CSO's.

From: "Donna Huff"

Date: August 3, 2010 15:31:24 EDT

Subject: Update for Local 80

Greetings,

The International received a petition from Levet Brown trying to stop the current election process from going forward. However, there was not a majority of members in good standing (dues payers) who signed the petition (total of 106 signed, 39 confirmed dues payers, 34 confirmed not dues payers and 28 not legible enough to identify), thus we are going forward. Ron Mikell and Levet Brown are trying very hard to disrupt the Local for their own benefit. First, Ron Mikell, was once the president of a UGSOA Local and he was removed FOR CAUSE, by his own admission. Ron led his local into Trusteeship not once, but twice. He used union funds for his own benefit and later was forced to return the money. Ron Mikell has been banned from UGSOA for the last five years and has only become eligible to join UGSOA as of July 1, 2010. See attached settlement agreement. Ron is being used as a “salt” by a failing union that is funding the start up of yet another new union. It is not a coincidence that Ron Mikell shows up on the east coast working in not one, but two UGSOA Locals in Washington, DC. Ron was on the west coast when he was the president of UGSOA Local 38. Unions will sometime use a “salt” – a person that gets a job in a specific workplace with the intent of organizing that workplace. Legitimate unions may use this technique in organizing the unorganized, especially where the employer is very anti-union, however, this failing union and the new union they are funding is using this “salt” technique to RAID UGSOA Locals, not for your betterment, but for their own self interests. It is no secret that Ron Mikell hates UGSOA, we caught him and put him out of commission for awhile, but now he is there in your own backyard, seeking to destroy your bargaining unit. He has been key in the raid on UGSOA Local 44 by the new union that is being funded by the failing union. Levet Brown (previous treasurer for Local 80) saw the opportunity to jump on the bandwagon with Mikell, just so it would take the pressure off of him to explain how he has failed to keep the funds of UGSOA Local 80 up front and in compliance with Local 80’s own By-Laws and Department of Labor and Internal Revenue Service laws and statutes. The Department of Labor is investigating the past Local officers of UGSOA Local 80 and we at the International are reviewing the copies of Local 80’s records. See attached e-mail to Levet Brown.

The International will prepare a financial document, once we have finished reviewing the records. We did get copies of the invoices for attorney’s fees and are reviewing them as well, and will report back to the members as to what the former officers were spending the local funds on. There is no evidence of missing funds, just mostly payments to Ava Ramey for union business, without any explanation of exactly what she was doing. All of the vouchers with her payments just stated, “___ hours at $____ for union business”. It appears at first glance she collected the same hourly rate as the CSOs.

Nominations for Local 80 officers must be in by

Thursday, August 5, 2010.

FENTY URGED TO BOOT LAX SECURITY COMPANY: SEIU Local 32BJ is urging DC Mayor Adrian Fenty to boot the security company contracted by the District to guard government buildings, schools and public arenas. U.S. Security failed tests in which inspectors were able to sneak weapons through checkpoints, reported The Washington Post on Sunday. "D.C. taxpayers pay U.S. Security more than $40 million dollars a year to protect our schools and city buildings," says SEIU 32BJ, "but the company is not making the grade. The Fenty Administration should put U.S. Security's contracts out to bid." The local represents 1,500 private security officers who safeguard District offices and educational institutions. In May, reported the Post, "U.S. Security Associates, based in Roswell, GA., had eight weapons violations and 12 other infractions that resulted in up to $3,560 in fines for the firm and its subcontractor, Watkins Security." With the company still the security contractor at more than 76 schools and municipal buildings, Local 32BJ is concerned that U.S. Security's actions threaten to undermine the union's work with "responsible security contractors and elected officials to raise industry standards and improve life for security officers in DC," says Jaime Contreras, 32BJ Capital Area Director. "DC taxpayers and our kids deserve reliable protection at our public buildings and schools." Click here to urge Fenty to take action. - Chris Garlock ----BUT BEFORE YOU DO READ BELOW
