On July 17, 2010, at 8:12 am, Oakland Police Dispatch Center received a 911 call stating that there was a male, who was armed, in the 3200 block of E12th Street. OPD dispatchers notified BART Police Department of the information received from the caller. BART PD had two officers in the area and made contact with the subject matching the description given by dispatchers. The man ran from the BART officers and they gave chase northbound on 34th Avenue. Oakland Police Officers caught up with BART PD and attempted to Taser the male, but were unsuccessful. The subject continued to run westbound on E16th Street and he turned southbound on 33rd Avenue. Oakland Police Officers tried to Taser the subject on 33rd Avenue with no effect. The subject, armed with two knives, attempted to charge at one of the officers. Multiple officers discharged their firearms at the suspect, striking him.

American Medical Response and Oakland Fire Department responded to the scene where the subject was pronounced dead. The adult male has not been identified.

Oakland Homicide Investigators, Alameda County District Attorney’s Office, Oakland Police Department Internal Affairs and BART Internal Affairs responded to conduct the administrative investigation. The Oakland Police Department is the lead agency in the criminal investigation.

Mayor Ronald Dellums said, "Anytime there is a loss of life, it is a matter of great concern and sadness for us all. It is extremely important that we as a community continue to work together in order to provide a safe and secure environment. Therefore, a thorough investigation of the circumstances surrounding this death has begun."

BART Board of Directors Vice President Bob Franklin and Board Member Carole Ward Allen issued a joint statement saying, "The loss of life under any circumstance is truly an unfortunate and regrettable event The BART Police Department is cooperating fully with the Oakland Police Department who has the lead in the investigation into today's officer involved shooting. We have immediately launched a separate but parallel administrative investigation as well to ensure this incident is thoroughly investigated in a transparent manner."

let's take to the streets and unite our struggles. we all know better than to believe any story Oakland PD and BART police are gonna tell. no death is justified. let's question why this story is NOT all over every television and computer screen and lets not be afraid of what coming together will bring.

The guy that was ranting about killing police should reconsider his words. Oakland police put their lives on the line everyday to protect and serve the east bay. They are not working for the 'red carpet' crowd. If you think this you obviously have never been to Oakland, California. I lived in Berkeley and came home multiple times at 1 am to hear multiple gunshots. You have a serious lack of respect for these law enforcement officers. Cops and the judicial system will never go away. If you don't like it get the fuck out of America.

I as one person have disarmed a crazed individual wielding a sword so I am continually baffled by multiple trained and uniformed officers are unable to put their heads and strength together to disarm someone who DOES NOT HAVE A GUN. Jeez, I have a cartoon running through my head where even a team of keystone cops drops a net on the perps head and then snatch em. Come on guys. Do you have NO BRAINS AT ALL. On the heels of what has just happened. I HAVE ONE QUESTION FOR THE OFFICERS INVOLVED. WHY DO YOU HATE OAKLAND SO MUCH!?!?!?!?!?!!!!!
SO LAZY THAT YOU CAN'T DO YOUR JOB, RISK GETTING HURT, AND TAKE DOWN THE SUSPECT WITHOUT KILLING HIM.

I never have understood police shooting like this at someone who has a knife. If you look deeply at this kind of thing it doesn't make any sense. Why not lasso the person or throw a net over them - but kill them. And if they felt they had to shoot someone why didn't they just shoot him in the leg?

This is another police murder which will just be covered up and they will go on doing the same things they always do. Of course, there are mindless people who will always justify this type of thing - like one of the previous posters.

A lot of people in Oakland were glad that 80 officers were laid off. Maybe with less police Gary King, Jr, Jerry Amaro, Amadou Diallo, Sean Bell, Oscar Grant and many others might still be alive today.

The only way to save the lives of everyday working and poor people from being murdered by the armed servants of rich people is to lay all those muthafuckas off. The funny thing about is it will save their lives too, because if not, like Lovelle Nixon, or the guy in this thread, someone will just get os angry as to what the cops do, that heor she will fight back, and some of those mudering assholes will also be dead.

why hasn't indy media posted this as a main article? it worries me that there has been no community response to this, especially after mehserle's verdict coming out. if it was a black man killed, would the streets be filled with people in mourning and anger? are the struggles of other people of color not seen in this community?

DIY homie. Why haven't YOU written an article about this? Is it because the killing of a latino man is not important to you? Why haven't you gotten involved in indymedia? Is it because you don't care about your community? Where are your interviews with the people that have been most effected by this tragedy?
Is it because you do not care about people of color?

Instead of publishing (silly) deconstructive comments, how about taking construction action. If you want indymedia to do more, then you need to do more.

This particular instance wasn't caught on video, so you know the cops will get away with it scott free, just as they always do.

There's also the question of what really happened. Did the guy actually charge police with a knife? Of course BART police are not going to come forward and say "oh, we killed this guy in cold blood, although we didn't have to." The account given by the cops doesn't jive for a number of reasons. Particularly striking, as a commentator above points out, is the claim that the guy came at them brandishing a knife after he had been tased. The taser was "to no effect?" I am more than a little sceptical.

So what really happened? We don't know, and even if more evidence comes forward contradicting what BART cops say -- as seen time and time again -- it wont matter. Given their record we certainly can't take their word for what occurred.
