Oakland Community Housing Inc. Investigation Update:

An Oakland CEDA Report reveals that the non profit housing organization known as East Bay Asian Local Development Corporation (EBALDC) was deeply involved in the scheme to displace the tenants from the California Hotel last summer. An injunction filed during early summer of 2008 to stop the owners of the California Hotel from evicting their tenants and shutting off their utilities stopped the scheme to displace the tenants and transfer the California Hotel to EBALDC!


Oakland Community Housing Inc. OCHI Investigation Update

Oakland - On March 31, 2009 a petition with over 500 signatures was delivered to Oakland's City Council demanding an investigation into Oakland Community Housing, INC (OCHI).

During that same evening Councilman Ignacio De La Fuente announced that his office asked the Attorney General's office to conduct an investigation into OCHI, and that the results should be available in 90 days. An e-mail from Libby Schaaf of Councilman De La Fuentes office dated one day later (April 1, 2009) to Noelle Quattrin of the Attorney General's office in California reveals that an investigation into OCHI was requested by Councilman De La Fuentes office.

As a result of requesting documents under the public records act, on Monday July 13, 2009 the City of Oakland released a number of reports, including one report which reveals that East Bay Asian Local Development Corporation (EBALDC) & the Oakland Housing Authority (OHA) were deeply involved in the process that resulted in actions intended to illegally evict (displace) the tenants from the historic California Hotel.

The tenants of the California Hotel were protected at that time under Measure EE and still are, but the April 22, 2008 CEDA report reveals that EBALDC, OCHI, the OHA, and City of Oakland had total disregard for the rights of the tenants at the California Hotel, in their haste to to transform the California Hotel into transitional housing.

On Monday July 13, Noelle Quattrin of the Attorney General's office stated that she was not aware of any investigation into OCHI.

Moments later, Jerry Brown's spokesperson Scott Gerber advised me that he was not aware of any investigation into OCHI, but that theres over 1,100 attorneys in his agency with around 3,300 employees, and stated that he would get back to me if he learned that an investigation into OCHI is actually underway, or has occurred.

See the April 22, 2008 report called the 'Work Out Plans For OCHI Properties' for more on what was happening at the California Hotel and other OCHI properties right before an injunction was filed last summer to stop the scheme to displace the tenants of the California Hotel.

On August 6, 2008 a $53 million claim was filed against the City of Oakland for their involvement with OCHI in illegal scheme to evict the tenants from the California Hotel.

The April 22, 2008 CEDA report reveals that there were others involved besides the City of Oakland and OCHI in the scheme to displace the tenants from the California Hotel, and backs up the claims of the tenants stating that they were being illegally evicted from the California Hotel.

Over the last twenty years, the City of Oakland has given this
organization more than $25 Million to build and maintain affordable
housing for low-income individuals and families. In 2007, it became
clear that the OCHI organization was having severe difficulties and was
failing to meet its obligations to the individuals and families living
in their more than 600 units of affordable housing in Oakland.

As of today, OCHI staff and board members never filed bankruptcy nor
transferred their assets to a more capable party - they simply walked
away. The City of Oakland has had to take extraordinary measures to
restore and protect this valuable affordable housing stock and insure
that OCHI tenants have safe, habitable shelter.

I have attached a list of knowledgeable and involved parties, as well as
several City Council reports detailing some of the losses, risks, and
actions taken.

It was nice to talk with you earlier this morning. Thank you for taking
the time to talk with me.

This is a formal request asking for any pertinent information regarding
the request with the Attorney General's office to investigate Oakland
Community Housing, Inc (OCHI).

If I recall correctly, on March 31, 2009, Ignacio De La Fuente publicly
announced at the City Council meeting that an investigation into Oakland
Community Housing, INC (OCHI) is underway, and that the results of the
investigation should be available in 90 days.

Please advise me as to the nature of the investigation if there is one,
and what exactly about OCHI did your office want the Attorney General's
office to investigate.

1) What is the name of your contact at the Attorney Generals office.

2) Please submit a copy of any or all information submitted to the
Attorney General's office regarding the request for an investigation
into OCHI.

3) Please let me know the results of any investigation into OCHI, indeed
if any investigation did actually take place.

The June 2008 Ballot has a dangerous measure known as
Proposition 98 (California Property Owners and
Farmland Protection Act, or CPOFPA). If passed by the
voters, Prop. 98 would terminate rent control, tenant
protections, and would place homeowners at risk by
allowing unscrupulous property owners to challenge
existing building codes and zoning laws that may
prohibit the placing of a "pig sty" next to someone's
home, or a "porn shop" next to a church or school.

California Hotel fiasco in a nut shell

For those of you who failed to look at the "Work Out Plan for OCHI Properties', in the section called 'Properties With Identified Sponsors' on pages '5 & 6'.

The April 22, 2008 CEDA report clearly reveals how the City of Oakland requested that OCHI and the John Stewart Company (JSCo) stop renting out units being vacated by tenants at the historic hotel.

This action alone starved the California Hotel of much needed funds to maintain it properly and keep it afloat for the existing very low-income renters.

With EBALDC and the Oakland Housing Authority as partners involved with OCHI and the City in the process to displace the renters from the California Hotel, the April 22, 2008 CEDA report clearly reveals how often local non profit housing organizations who profess to be helping out the poor, are actually involved in schemes to displace the poor from thier housing by getting involved in schemes to intentionally create a crisis at various low-income housing sites, by starving them for funds needed to properly maintain the buildings.

The whole point of the schemes are to displace the poor from their housing, in an effort to bring in higher revenues to the low-income housing sites.

Case in point. The Coliseum Gardens public housing complex in Oakland.

If EBALDC ever manages to get their dirty hands on the California Hotel somehow, will it refer to the historic location as the NOTORIOUS California Hotel, such as it calls the old Coliseum Gardens public housing complex?

Lion Creek Crossings (Coliseum Gardens) Now Renting
The Oakland Housing Authority received a HOPE VI grant to replace its 178 notorious Coliseum Garden apartments with a mixed income development of over 400 apartments and approximately 28 homes for sale. EBALDC assembled a development team, which includes The Related Company of California and Chambers Construction to work with the housing authority.
