Injured Lowe's Home Improvement worker Joseph Dow will be going to court on Monday September 8 to provide evidence of felony workers compensation fraud by the company to prevent him from getting benefits. The San Mateo District Attorney, the California Fraud Assessment Commission and Steve Poizner, California's Insurance Commissioner have all refused to prosecute the insurance industry for criminal fraud.

Presentation Of Evidence By Injured Worker Joseph Dow of felony workers compensation fraud by Lowe's Home Improvement



Lowe's Home Improvement injured worker Joseph Dow will be going to Workers Compensation Court on Monday September 8, 2008 at 8:30 AM to present evidence of felony workers compensation fraud by the management of Lowe's Home Improvement. In a long term battle for justice and human rights, Dow will show that after he was injured at Pacifica Lowe's his manager forged his papers to cover-up that Dow was an disabled worker and that they had illegally had him carry 80 lb sacks knowing that this would severely injure his back.
Dow filed for workers compensation and Lowe's denied the claim and presented falsified material not only to a state workers compensation judge but a US Federal judge.
Despite the fact that a California Department of Fair Employment and Housing Staff attorney Erin R. Koch-Goodman wrote a letter to the San Mateo District Attorney's office on November 26, 2008 declaring that there had been criminal fraud againt Dow and the people of California there has been no prosecution by the San Mateo District Attorney.
At the same time, San Mateo District Attorney James Fox and his District Attorney Alberti went after injured worker Anita Blick in a retaliatory prosecution for workers compensation fraud for not telling her doctor she was driving to her appointments. Anita was jailed for 60 days in solitary confinement and later her conviction was overturned by the California Appeals Court. The District Attorney also went to the California Fraud Commission to ask for more funding in the retaliatory prosecution of Blick yet it refuses to prosecute clear felony fraud by Lowe's Home Improvement. Who does the San Mateo DA, The California Insurance Commissioner and the California Fraud Assessment Commission represent?
Joseph Dow also met personally with Insurance Commissioner Steve Poizner on January 17, 2007 with other injured workers and injured worker advocates and Poizner promised that he would personally investigate the case of Joseph Dow. His commission did an investigation and his office sent a letter to Joseph Dow that they had investigated and there was not insurance fraud in his case.
The failure of the Insurance Commission, the California Fraud Assessment Commission and the District Attorneys of California to investigate fraud is a deadly serious manner. Workers have lost their families, their homes and some have committed suicide as a result of this massive fraud cover-up.
At the same time in a multi-billion dollar cost shifting scheme to the taxpayers, the insurance industry is forcing injured workers to apply to SSI, SSDI and to go to public hospitals and public services for services that should be provided by the insurance carriers or self-insured employers.
Instead, as evident in the case of injured worker Joseph Dow, the injured worker is discriminated against, terrorized and traumatized by criminal actions of these insurance companies and employers.
We will make sure that Joseph Dow receives justice.

Call the California Fraud Assessment Commission at 916-492-3500 and ask them why they refuse to prosecute insurance company workers compensation fraud
Call Insurance Commissioner Steve Poizner at 916-492-3500 and ask his office why they have said there is no insurance fraud in Joseph Dow's case.
