Anesthesiologists Delay Calif. Execution

The planned execution of Michael Morales was delayed until Tuesday night after two anesthesiologists refused to participate because of ethical concerns.

Prison officials rescheduled the execution for 7:30 p.m. Tuesday and said they would employ a different technique: administering a fatal overdose of barbiturate in lieu of the three-drug cocktail typically used in lethal injections.

The apparent sticking point was the physicians' obligation, under procedures specified by a federal appeals court in a ruling Sunday, to intervene if Morales appeared to regain consciousness or displayed signs of pain. The court said the anesthesiologists would then have to take steps to render the inmate unconscious or "otherwise alleviate the painful effects'' of the drugs.

"Any such intervention would clearly be medically unethical,'' the doctors said in a written statement today. "As a result, we have withdrawn from participation in this current process.''

(2-21) 16:04 PST SAN JOSE -- The state can execute Michael Morales tonight for raping and murdering a 17-year-old girl in 1981, if the execution is carried out by someone with medical training who injects a lethal dose of barbiturates directly into the prisoner, a federal judge ruled this afternoon.

The state did not immediately say whether it would comply with the conditions laid down by U.S. District Judge Jeremy Fogel for the execution, which is scheduled for 7:30 p.m. at San Quentin State Prison. A lawyer for Morales said the condemned inmate would probably appeal the ruling.
