Ishii in U.S. District Court, 1130 "O" Street, Fresno, CA. Medical marijuana patient and caregiver Dustin Costa (a.k.a. "DC Greenhouse"), 58, who is president of the Merced Patients Group, was being prosecuted on state charges stemming from a March 2004 cultivation arrest by Merced County Sheriffs, when the state decided to turn his case over to the U.S. Attorney for federal prosecution. After being re-arrested by federal agents on August 10, 2005, Costa is facing federal charges of cultivation, possession with intent to distribute, and possession of a firearm. Costa is currently incarcerated in Fresno. ------------------------------------------------------------------------ *Tuesday, January 31st, Auburn: Court Support for Steve Kubby *From Dale Gieringer: Good news - After much pain & anguish Attorney Bill McPike reports that Steve Kubby is to receive Marinol in the Placer County Jail! There will be an arraignment and/or hearings on Tuesday at 1 PM and possibly 8:30 AM at the Placer Co. Courthouse in Auburn. Here's how to contribute to Steve's commissary:. OK - anybody can put money on Steve's books for commissary & health items. These must be US postal money order. No letters may accompany the money orders. Letters of support may be sent to the same address. MOs should be made out to Steve Kubby. I will be there at 8:30 am, to see if we are still calendared. *** * ------------------------------------------------------------------------ *Monday, February 6th, Sacramento: Court Support for Bryan Epis *Non-evidentiary status hearing at 9:30am before Judge Frank C. Damrell, Jr. in U.S. District Court, 15th Floor at 501 "I" Street in Sacramento. Bryan Epis was the first medical marijuana patient convicted in federal court after the passage of California's Proposition 215. Epis was arrested June 25, 1997, after Butte County sheriff's officers discovered marijuana plants growing in the basement of his home in Chico. Epis was released on bail August 9, 2004, pending his appeal. ------------------------------------------------------------------------ * Monday, February 6th, Pasadena: Court Support for Lynn & Judy Osburn *Oral arguments at 9:30am before the Ninth Circuit Court of Appeals at the Richard H. Chambers Building, 125 South Grand Avenue, Pasadena, CA. Lynn and Judy Osburn, operators of the West Hollywood-based Los Angeles Cannabis Resource Center (LACRC), were raided and the dispensary shut down by the DEA in the fall of 2001. Also raided was the Osburn's Ventura County medical marijuana garden and supply for the Center. As a result of the raid on the LACRC, the federal government proceeded with an asset forfeiture action against the city of West Hollywood for its part in funding the building that housed the Center. The Osburns were raided again in July 2002 and arrested on cultivation charges. In September 2003, the Osburns pled guilty without waiving their right to appeal. Invoking the rule of "lesser harm," U.S. District Judge A. Howard Matz sentenced Judy Osburn to only one year of probation. Lynn Osburn is out on bail pending appeal. The appeal deals mainly with the denial of an entrapment by estoppel defense, and their assumed immunity as agents of West Hollywood under 21 U.S.C. Section 885(d). In addition, the City of West Hollywood is jointly appealing the asset forfeiture action. ------------------------------------------------------------------------ *Tuesday, February 7th, San Bernardino: Protest County's Vote to Join San Diego Lawsuit Against the State! * The San Bernardino County Board of Supervisors are considering signing on to the San Diego County lawsuit against Prop 215, our Compassionate Use Act. This lawsuit is unprecedented and is in stark opposition to the opinion of the overwhelming majority of Californian voters who feel that seriously ill patients should be able to use medical marijuana legally under state law. Join patients & patient advocates in standing up for Prop 215 at the Feb. 7th San Bernardino County Board of Supervisors meeting. We will rally outside the San Bernardino County Government Center at 12pm, noon, on Tues., Feb. 7th. The meeting starts at 10am and those who wish to speak should arrive early to sign up for the public comments segment at the end of the meeting agenda. The meeting (10am) and rally (12pm) will be held at the County Government Center at 385 N. Arrowhead in San Bernardino, 92415. We will have 2 rounds of car pools leaving from the Los Angeles Patients & Caregivers Group: the first will leave at 7:45am for those who wish to speak at the meeting, and the second will leave at 10am for those who will be attending the rally.
