Oakland Ca.-Oaklands renters continue to get screwed by lawless landlords that refuse to comply with Oaklands
2 Year Moratorium On Rent Increases after evictions.
Staffers of Oaklands Rent Arbitration Program upon
Wednsday 1/3/2001, confirmed that since the Moratorium went into effect on August 1st,2000,no landlord has yet to face prosecution for breaking the law.
Oakland has around 84,000 units available for rent,compared to around 18,000 units available in neighboring Berkeley.In comparison,Berkeleys Rent Arbitration Program has around 26 staffers to run the program that administers to the approximate 18,000 units for renters,and until recently Oakland had only 3 staffers to run Oaklands Rent Arbitration Program. Oakland had just
recently hired 3 more staffers to help run the poorly mismanaged program in Oakland.During recent years,staffers in Oaklands Rent Arbitration Program have lost evidence that was submitted for some of the cases
brought before the Board.
Oaklands 2 year moratorium on rent increases was sabotaged from the begining when it was written in such a way that there was a lack of enforcement built right into the ordinance itself.When a landlord in Oakland
raises the rents in the rental unit beyond what was lawfully allowed,the newly arrived renter has only 30
days to file a complaint with the Rent Arbitration Program in an attempt to roll back the rents to where their supposed to be.If not the rents are then locked into place for those that do not file the complaint in time.This results in renters that are forced to pay up to 1-2-3 hundred dollars per month more than what the law actualy allowed,and sometimes more.It depends on how much money the slimeball landlord feels like stealing from the new renter at the signing of the contract.
Calls to City Officials have yet to produce anyone willing to come forward to explain why landlords in Oakland are not facing prosecution for stealing money from their renters. Landlords by law are supposed to inform the new renters of what the old rent was when they evicted the last renter of the same unit in Oakland.
Few if any do so,and the new renters lack the information needed to defend theirselves from these rent scams.The
City Of Oakland does not prosecute the landlords that refuse to comply with the ordinance,renters get ripped off,and the cycle of scams continue to suck in new victims.Its organized crime.....
Tenant activists are outraged by this situation.
It seems that nothing short of a complete and total
rebellion in Oakland by the renters will ever end this form of blatant robbery.If the City Of Oakland continues to fail to prosecute the landlords that choose robbery as a means to survive,then renters of Oakland should consider a long over due rent strike to bring this corrupt system to its knees.When one landlord after another loses their buildings to receivership due to massive amounts of renters that refuse to pay their rent,the other landlords may just start to rethink their position.
In the meantime, tenant activists advise all Bay Area Renters to boycott the landlords of Oakland, and avoid this town like the plague when seeking housing.Theres other local cities that this sort of criminal activity is not
allowed,and renters have fair representation with politicians in the arena of politics.In this town of Oakland renters do not have rights that are enforced,and a 30 Day
