Steve Kubby denied EQUAL PROTECTION UNDER THE LAW compared to Vice President Dick Cheney!

Steve Kubby still denied Constitutional right to Equal Protection Under The Law to not be persecuted and punished for using substances and products equally dangerous or less dangerous than Vice President Dick Cheney's hunting rifle.

and he is still being denied equal protection under the law of the United States Constitution, Amendment XIV, Section I, Nor shall any state deprive any person of life, liberty or property, without due process of law, nor deny to any person within its jurisdiction the equal protection of the laws.

Steve Kubby is still being denied his Constitutional right to use medical marijuana in jail.
Under Article I, Section X, [1] No state shall pass any law impairing the obligation of contracts. A law is a contract. Prop 215 which allows cancer patients, like Steve Kubby, to use medical marijuana is a law and a contract between the people and the government of California to not prosecute and punish people for the use of medical marijuana. Because medical marijuana is legal for cancer patients, like Steve Kubby, in California, the court has no right to make case law, and any court opinion becomes effective case law, to deny Steve Kubby the right to use medical marijuana in jail. The jail authorities are impairing the obligation of contract of Prop 215 to allow Steve Kubby the use of medical marijuana in jail.

Steve Kubby allegedly signed a contract under duress with Placer County Jail to say that he would not hold them responsible if he dies in their custody.
Obviously, he can't hold anyone responsible if he's dead. A contract under California law requires a meeting of minds of two parties and that implies two live parties. A contract of adhesion under duress can be voided. Obviously a person is under duress if they might die.
Steve Kubby allegedly complained about blood in his urine the first day or so in jail. He has suffered from cancer. If he has blood in his urine he might only have six months left to live.
Canadian authorities allegedly counselled Steve Kubby that instead of returning to California, they could allow him to go somewhere else, just as long as he left Canada.
Steve Kubby chose to return to California knowing he faced charges. Did he do this on purpose to be a martyr, knowing he would die within six months, to raise awareness to two causes:
(1) the right for ill persons to use medical marijuana in jail;
(2) the right to have equal protection under the law and to not be prosecuted and punished for using products and substances that are equally dangerous or less dangerous than Vice President Dick Cheney's hunting rifle?
Steve Kubby has allegedly consistently stated that medical marijuana has kept him alive for years, despite his cancer problems. Some authorities deny this could be true stating a lack of scientific evidence.
They have failed to look at all of the scientific evidence. People are genuinely different like snow flakes are different, and in biology, polymorphism is the existence of 2 or more forms of individuals within the same animal species, independent of sex differences.

Even the January 31, 2006 9th Circuit Court of Appeals opinion on Partial Birth Abortion holds that there must be a health exception to a law, and if a law does not have a health exception it is unconstitutional.

Therefore, the lower court, the Placer County Superior Court, and their co-conspirators, the Sheriffs at the county jail, cannot make case law and rule that Steve Kubby cannot use medical marijuana in jail. If they do it is a violation of the Constitution and the ruling should be appealed to the Supreme Court of the U.S.
