The Supreme Court in a 5-4 ruling declared that carbon dioxide and greenhouse gases are air pollutants under the Clean Air Act. There were laws in the books that the Environmental Protection Agency (EPA) and the White House chose to use the lesser degree favoring not to use stringent measures and take measures that were dubious in nature.
