"Unruly Party" Ordinance coming up for amendment Tuesday evening at City Council
Council member Rotkin's "Unruly Assemblies" ordinance, the "Party at Your Peril" law, comes up for modification on March 11th at the evening city council meeting. Coonerty and Rotkin are moving to liberalize the ordinance with four changes. The real question, of course, is whether there should be such an ordinance at all and what kind of suffering it has inflicted. Mayor Coonerty's New Rules Ban Public Comment on Half of City Council Afternoon Agenda
On becoming Santa Cruz Mayor last November, Ryan Coonerty laid down a new set of procedures at City Council requiring members of the Public to get his permission before talking on "Consent Agenda" subjects. The afternoon Consent agenda makes up more than half of what City Council acts on. Hence this new ruling removes Public Comment on the majority of Council actions. Local ACLU Statement on the Parking Lot Panic Law
The Santa Cruz chapter of the American Civil Liberties Union in one of its rare statements defending civil liberties locally issued the following statement at http://www.aclusantacruz.org/node/154.
As of yet, they have not been visible at any of the Drum Circle crackdowns nor offered any legal assistance. ACLU attorney Don Zimmerman, however, has both publicly and privately expressed strong opposition to the current law....

Police disrupted and dispersed lawful public assemblies of drummers on December 26th, January 2nd, and January 16th. But this time the Community with the help of the Trash Orchestra and Food Not Bombs repeated their victory of January 9th holding the bumbusting Blueshifts at Bay. They were ably assisted by "Jumbogumbo" Joe Schultz's vegan victuals and renewed community outrage against keystone kop kapers cracking down on an accepted weekly tradition--the Farmer's Market Drum Circle!...

Suggestions for Street Performers Fighting Police Bullying
I've found that police have regularly suggested that "I've received a complaint" is justification for demanding a street musician pack it in and move. Not so. The police are relying on your willingness to unquestioningly comply. Consider instead the actual law involved. Often if you reasonably stand your ground with witnesses (an audio recorder is also nice), police back down. It's not without risk, but there are other risks in surrendering your rights silently....

Mayor Coonerty Dismissed Call for Homeless Shelter During LBAM Spraying
In spite of a City Council lawsuit, and various public statements, City Council members approached by homeless activists--Mayor Ryan Coonerty and Councilmember Tony Madrigal, have refused to commit themselves to providing emergency shelter for homeless people if and when LBAM spraying resumes. The word "homeless" apparently didn't enter into the after-midnight proposal by Councilmember Madrigal at the last Council meeting to establish a Task Force on the issue....

Parking Lot Panic Law Used to Disperse Drummers
On two successive Wednesdays, police have ordered the peaceful drum circle to leave their traditional spot in the public parking lot behind Tacqueria Vallarta and Logos using Mayor Coonerty's Ban on Public Assemblies in parking lots. The new merchant-backed law prohibits lingering in a parking lot or garage unless you have a vehicle there (and then only for fifteen minutes). It removed ten blocks of public space from public use....

It describes the combination of ignorance, pigheadedness, arrogance, and obstruction that can and do happen. These kind of hostile roadblocks are raised even in relatively simple matters where the law is on your side--perhaps particularly where the law is on your side. SCPD Covering Up False Police Report From Councilmember Mike Rotkin?
The following correspondence between me and Trisha Husome, Records Keeper of the Santa Cruz Police Department shows their reluctance to release a public record documenting Councilmember Mike Rotkin's inappropriate call to the SCPD in order to demand my arrest for merely attending a public ACLU meeting with a sign. Could this be to protect the 3-time Mayor? It seems to have that effect....
