"It’s about building and privatizing taxpayer-built dams and moving the control of the California’s water from the public trust to the private sector," said Leonard Masten, chairman of the Hoopa Valley Tribe. "The measure also paves the way for the construction of a peripheral canal that would more easily ship Northern California Water south."...

“Tribes have always had the inherent right to gather - whether the state makes it legal or not is their choice,” said Georgiana Myers, Yurok Tribal member and organizer for the Klamath Justice Coalition. "The Yurok Tribe has been gathering since the beginning of time. We have always done it, we will always do it, and we feel that the MLPA is the biggest attempt in the last 30 years to take away tribal gathering and fishing rights."

Tribal activists essentially took over a meeting of Governor Arnold Schwarzenegger's Marine Life Protection Act (MLPA) Initiative in Eureka today and demanded an opportunity to speak on the record. For about an hour Native Americans as well as non-native supporters from the North Coast criticized the process and demanded tribal representation on the science panel.
As a journalist who has written dozens of articles investigating the conflicts of interests, violation of tribal gathering and...

The Schwarzenegger administration has taken all other “human uses” and “extractive activities” other than fishing and seaweed harvesting off the table in the implementation of the MLPA process. The MLPA fiasco does nothing to stop water pollution, oil drilling, and wave energy projects or other activities from destroying fish and other marine life populations in California’s coastal waters.

“Scott River water depletion has gotten so bad that today coho salmon are on the verge of extinction there, once one of their major refuges,” noted Glen Spain, PCFFA Northwest Regional Director.

“The Kashia began on the coast,” Reno Franklin of the Kashia Pomo Tribe stated. “Danaga is the place where we believe the tribe first stepped on the earth. It has tremendous significance for our tribe. We are a very traditional tribe that still speaks our language, follows our culture and respects our elders and follows their direction.”

According to Pete McCloskey: “This case is about Caltrans ignoring the science and the will of the people of California in favor of the interests of large trucking companies. Caltrans obviously cares more about trucks than trees. That’s not how most Californians see things, and we are honored to represent these organizations and individuals in their fight against this unnecessary and destructive project.”...

Here is the press release from the Karuk Tribe about the environmental review of the plan to restore the Klamath River.
“We’ve studied the problem to death,” says Leaf Hillman, Natural Resources Director for the Karuk Tribe. “We believe that when viewed through the lense of objective science, only one conclusion can be reached and that’s to implement these agreements. Otherwise none of the communities and economies on the Klamath River can survive.”...

John Lewallen, a well-respected North Coast environmental leader and co-founder of the Ocean Protection Coalition and the grassroots Seaweed Rebellion, has been a staunch opponent of offshore oil drilling for decades. He said that Schwarzenegger's MLPA Initiative not only fails to protect the California Coast from offshore oil drilling, but “paves the way for new offshore oil rigs.”...

There is no doubt that Schwarzenegger’s MLPA Initiative is an out-of-control, lawless process that must be stopped. The May 28 lawsuit will hopefully mark the beginning of a series of lawsuits by the many diverse communities under siege by the MLPA Initiative.

"WSPA has not taken a position on specific offshore projects," stated Catherine Reheis-Boyd, president of the Western States Petroleum Association and the chair of Governor Arnold Schwarzenegger's MLPA Blue Ribbon Task Force for the South Coast. "But we have been vocal about our views that California businesses and consumers would benefit from development of the huge reserves of petroleum off the California coast, in both state and federal waters."...
