During October 2017, in favor of Empire State Realty Trust (ESRT), Judge Gerald Lebovits ruled with a summary judgement in a lawsuit against WBAI Radio and the Pacifica Foundation, over alleged unfair, unreasonable and exorbitant annual increases in the rent for situating the station’s transmitter at the top of the Empire State Building, in New York City....

January 8th KPFA’s money and property may be seized by the Empire State Realty Trust because of a 1.8 million dollar debt of our sister station WBAI in New York. At that point, our building and our bank account will no longer be under our control....

A motion widely circulated on voluntary bankruptcy for Pacifica from the network's interim executive director, in the wake of a $1.8 million judgment against WBAI for failure to pay Empire State tower rent. The Pacifica board voted 11 to 7 to go into closed session 12/28/17 and then failed to take action on this motion....

Pacifica should make every effort to remain independent and not be eager to throw up its member-purchased assets for grabs, at the discretion of the federal government and a creditors committee headed by an aggressive capitalist real estate speculator and billionaire. That’s a bad place to be. It would make Lew Hill cringe....

On the 6:00PM KPFA evening news on December 28, 2017, it has been reported that the Pacifica Foundation board members were deadlocked on a vote this evening to go into foreclosure, or file for Chapter 11 bankruptcy, due to over $2 million owed to ESRT because of the unpaid use of the antenna (unpaid tower rent) at the Empire State Building, in New York City!...
