The initiative, overseen by oil industry, real estate, marina development and other corporate representatives, took water pollution, oil drilling and spills, wave energy development, corporate aquaculture, military testing, habitat destruction and all other human impacts on the ocean other than fishing and gathering off the table in its perverse concept of marine "protection."

"The Committee heard compelling testimony from North Coast Tribes that were unified in their concerns to protect their inherent rights to traditionally gather along the North Coast shoreline," they stated. "We ask for the Commission to respect Tribal interests and provide for adequate testimony from the Tribal perspective. We encourage you to work with the Tribes to develop a workable format for their full participation at your hearing by providing a block of time for tribal testimony."...

David Gurney, an independent film maker from Fort Bragg, is suing officials from the Marine Life Protection Act (MLPA) Initiative and state agencies in Mendocino County Superior Court over his arrest for recording and speaking at a "work session" in Fort Bragg on April 20, 2010.
"California’s open meeting laws guarantee that citizens and members of the press have a right to keep track of what goes on in a public process, and assures they will not be harassed at public meetings," said Gurn...

It would be insane to continue the MLPA fiasco when Brown is calling for the slashing of virtually all state programs and California has the lowest ratio of game wardens to residents of any state in the nation to enforce these fake "marine protected areas."...

17 salmon and clean water activists are asking Governor Brown to review and reform the policies and practices of the California Department of Fish & Game in the Klamath River Basin. This is needed, they say, in order to end dewatering of the Shasta and Scott Rivers, establish Klamath River flows sufficient for salmon recovery and to uphold the Public Trust Doctrine....

“It is truly good news that the current round of water quality planning for the Klamath River is complete,” said Catherine Kuhlman, Executive Officer of the North Coast Regional Board. “Now, it’s time for action to reduce water pollution and restore the river in order to enhance the myriad of beneficial uses of the river.”...

Governor Brown has a chance now to do the right thing - cancel or suspend the MLPA Initiative and conduct an investigation of the conflicts of interest, corruption and violations of state, federal and international laws that have occurred under the MLPA Initiative.

Below is my open letter to John Laird, who is expected to be appointed as Natural Resources Secretary, the top environmental post in California, by Governor Jerry Brown.
Environment California and the Sierra Fund announced his appointment in press releases on January 1, although neither Laird nor Brown have confirmed it yet.

"Our hope is that Governor Brown will take heed of what Tribal people and recreational anglers are saying about the MLPA and other water issues," said Georgiana Myers, organizer for the Klamath Justice Coalition and Yurok Tribe member. "I encourage the Governor-elect to have not just big oil and corporate interests at heart, but to listen to the real Californians who use the ocean."

Brown should abolish the Bay Delta Conservation Plan (BDCP) that was instituted under Schwarzenegger and all state plans to build a peripheral canal and new dams. Instead of the BDCP, Brown should establish the first ever "Blue Collar Task Force" (a concept inspired by Troy Fletcher, acting executive director of the Yurok Tribe), to recover fish populations and restore the Delta. The task force would be made up of representatives of California Indian Tribes, recreational fishing groups, comme...

This is an updated version of an article that I published on December 8. On December 21, the nation of Mauritius announced its plans to contest the legality of the Chagros Islands marine protected area. The use of a marine reserve to deny the Chagossians their human rights has a direct parallel in efforts to deny indigenous people their rights in controversial "marine protected areas" being implemented under Governor Arnold Schwarzenegger's Marine Life Protection Act (MLPA) Initiative in Cali...

“Water and salmon hold sacred value among the tribes of the Round Valley, and both have been bankrupted,” according to Ernie Merrifield, past Round Valley Tribal Council member. “Like a person, if you block the free flow of blood in your veins you will die, just as PG&E’s dams are killing the Eel River.”

The Marine Life Protection Act (MLPA) Initiative must be seen in the context of the campaign by the Schwarzenegger administration, corporate media and some NGOs to greenwash the environmental legacy of the worst Governor in California history for fish, water and the environment.

Why is a private corporation, the shadowy Resources Legacy Fund Foundation, being allowed to privatize ocean resource management in California through a Memorandum of Understanding (MOU) with the DFG? Isn't this very bad public policy?

Governor Schwarzenegger appointed an oil lobbyist, real estate executive, marina developer and other corporate interests to preside over the implementation of so-called marine protected areas on the California coast. This process has been characterized by conflicts of interest, corruption and the violation of numerous state, federal and international laws, including the American Indian Religious Freedom Act and the UN Declaration on the Rights of Indigenous People.
