City Denies Wrongful Death of Alex Nieto by SFPD!

The Law Offices of John L. Burris have received a Notice from the City Attorney of San Francisco, Dennis Herrera, in response to the Claim filed by Refugio and Elvira Nieto on April 14th, 2014 for the wrongful death of their son, Alex Nieto. Without any explanation regarding the findings of their investigation, the City Attorney DENIES any wrongdoing on behalf of SFPD.

We quote:

"An investigation of your claim filed with the City and County of San Francisco has revealed no indication of liability on the part of the City and County. Accordingly, your claim is DENIED."

With this denial, the City is forcing the Nieto Family to consider lengthy litigation as their sole recourse for justice for their son! These processes bear a heavy toll on family and friends, prolonging closure for traumatized victims of violence.

Meanwhile, in the criminal justice process, the District Attorney’s investigation dwindles to a complete halt awaiting the slowest Medical Examiner’s Report to ever be issued by the Coroner. D.A. Gascón (a career police officer and former Chief of Police of San Francisco) promised to expedite this report, but there is no sign of interest or hurry.
