Workers willing be filing workers comp complaints against the Poway Toyota dealership owner and manager for refusing to provide workers compensation from workers who were contaminated by mold at the dealership. Also other workers will present testimony about the need of the District Attorney of San Diego to prosecute criminal fraud by insurance companies and employers.

8/25 San Diego Complaints & Charges Filed With DA For Workers Comp Fraud by Toyota of Poway and Judicial Bias

Injured workers from the Toyota of Poway dealership will be filing complaints with the Fraud Unit
of San Diego District Attorney's office on Wednesday August 25, 2010. Workers at the dealership
were exposed and sickened by mold that the owners, Vincent Castro and Troy Duhon, as well as manager,
Rick Gallagher, refused to acknowledge as a health hazard while placing the health and safety of the injured workers at risk.
According to the complain, these individuals, their workers compensation insurer and legal counsel have engaged in
criminal schemes and intimidation of workers to shift the healthcare costs to DI disability insurance, SSI and other
providers; thereby defrauding the public. This is not an isolated incident as more and more employers and insurance
companies shift their costs as a result of the deregulation of workers compensation under SB 899. The failure of
CA OSHA to enforce health and safety regulations have aided and abetted to shift the costs of injured workers and
their families onto taxpayers of California.
The press conference will be held at 2:00 PM at the San Diego District Attorney's office,
330 Broadway/State St. San Diego. Also testifying will be other injured workers who are fighting in San Diego for
prosecution of employers and insurance companies who refuse to take responsibility for the medical and compensation
costs of injured workers.
District Attorneys including San Diego Bonnie Dumanis have a responsibility to carry out prosecutions including against
employers and insurance companies as well as officials who are involved in covering up felony workers compensation fraud.
Additionally speakers will discuss the ACOEM regulations which have allowed company and corporate doctors to deny
compensation for health hazards created by mold in the workplace and at homes. Sharon Kramer will be speaking of
how the San Diego court system has aided and abetted this deception and interstate insurance fraud to continue five
years longer than it should have. She is filing a complaint with the District Attorney’s office on Wednesday for systemic
judicial bias involving ten San Diego judges and justices, including Justice Judith McConnell who is Chair of the California
Commission on Judicial Performance, causing the corruption of the US Chamber of Commerce and ACOEM over the mold
issue to flourish in the San Diego, California and US courts.
Dina Padilla from the Peace And Freedom Party and Bill Balderson from the Green Party who are both candidates for
California Insurance Commissioner have issued statements of support for this investigation and prosecution in the
Poway Toytota case and will have statements available.
