Day Two- The Trial of Splitting the Sky Versus George W. Bush

A review of the first day of the trial of Splitting the Sky Versus George W. Bush, the media attention that it received, the main arguments being put forward.

At the trial on Monday, the police officer who arrested Splitting the Sky (John Boncore) said that he was "protecting Spitting the Sky” from Bush's guards. He went on to say that Bush's protectors carry “lethal weapons” and that they would have used them to kill the accused man had the police not intercepted him. The questions raised by the police officer's testimony were not raised by the defense nor the prosecution. The presiding Judge Manfred Delong, denied the defenses plea too allow for a distinction between “Obstructing a Police Officer” and “Preventing a Police Officer from Performing his Duty.”

Splitting the Sky testified in his own defense to remind the court that the laws which the minority government eschewed vis-a-vis Bush were invoked to keep British peace activist George Galloway MP out of Canada last March. He stated “All Galloway had been doing was bringing medical aide to Palestinians in Gaza, 2000 of whom Israel had massacred, but they barred Galloway from Canada using the same laws which they should have used to ban George W. The Calgary Sun framed the trial by reiterating defense counsel Charles Davison's assertions that his client’s attempts at breaching a police barrier to gain access to Bush were justified. Davison said that he will present evidence to support Boncore’s claim. Lawyers Against the War, had urged the RCMP to arrest Bush for crimes against humanity if he stepped on Canadian soil. That group asserted Bush was “inadmissible to Canada” as a suspected war criminal and said the former U.S. president should not be allowed into Canada. If he was deemed a suspected war criminal Bush would be disentitled to enter Canada under the Immigration and Refugee Protection Act, and would be breaking the law if he came here, Davison said. As a result, Boncore was entitled to make a citizen’s arrest since a crime was being committed.

The Crown prosecutor Tracy Davis argued that citizen’s arrests can only be carried out by a person witnessing a crime taking place and that Splitting the Sky was not entitled to make an arrest of George W. Bush.

The Calgary Sun's article is entitled- Citizen's arrest of George W. Bush justified, court hears. Russia Today also covered the story and interviewed Splitting the Sky.

Cynthia McKinney spoke in London yesterday. She first spoke to MPs and their assistants in in a committee room in parliament. She also spoke at a packed public meeting of some 150 people in the School of Oriental and African Studies, and received a standing ovation at the end of her talk. She was supported by 9/11 authors Nafeez Ahmed and Ian Henshall, who also gave good speeches, and by an excellent chairwoman: Dr Jay Ginn, who has been a long term peace campaigner since the 1960s. Cynthia read out to the meeting a prepared statement of support to Splitting the Sky which was acclaimed by near unanimous applause:

'Trial of John Splitting the Sky Boncore (aka Dacajeweiah)

'The organisers of this meeting, Reinvestigate 911, held in London, England on March 8th 2010 and addressed by Cynthia McKinney, send greetings of solidarity to John Splitting the Sky Boncore in Calgary, Alberta, Canada, who non-violently attempted to perform a citizens’ arrest on suspected war criminal George W Bush when he visited Calgary last year. We understand that as a result Splitting the Sky was manhandled to the ground, arrested and charged by the Royal Canadian Mounted Police. We hear he was seriously wounded and is now facing a criminal trial in Calgary.

'We salute your bravery, Splitting the Sky, wish you every success with your trial and hope you will be acquitted and compensated for the injuries you have sustained. We call on those present at this meeting to publicise your case so that justice may prevail.'

Joshua Blakeney, Media Coordinator of Globalization Studies University of Lethbridge, wrote a firsthand account of yesterday's events entitled- George W. Bush gets his day in court! STS vs. Bush trial goes forward. Kevin Barret hoped to get an update from the trial on his radio show this morning.

The Immigration law that was used to prevent entry into Canada by George Galloway states:

"A permanent resident or a foreign national is inadmissible on security grounds for:

in an act of espionage or an act of subversion against a democratic government, institution or process as they are understood in Canada;

(b) engaging in or instigating the subversion by force of any government;

(c) engaging in terrorism;

(d) being a danger to the security of Canada;

(e) engaging in acts of violence that would or might endanger the lives or safety of persons in Canada; or

(f) being a member of an organisation that there are reasonable grounds to believe engages, has engaged or will engage in acts referred to in paragraph (a), (b) or (c)."

Lawyers Against the War had urged Canada to recognize that, under the Immigration and Refugee Protection Act, Bush should have been inadmissible, and as a person suspected of torture, then he should either prosecuted in Canada for torture or extradited to another country that is willing and able to prosecute as required by the Convention against Torture and other Cruel, Inhuman or Degrading Treatment or Punishment, Article 7.

Splitting the Sky presented three documents which influenced his actions, the first was Lawyers Against the War request RCMP to investigate George W. Bush for War Crimes- W is reported to be planning to visit Calgary, Alberta on or before March 17, 2009, the second was a letter of solidarity written by former US Attorney-General Ramsey Clark, the third was an article Time for Accountability- Should George W. Bush Be Arrested in Calgary, Alberta, To Be Tried For International Crimes? by Professor Anthony J. Hall. The judge concluded the day by saying that he would allow the defense four, and possibly five days to present evidence, which in itself, was a victory for the defense. Cynthia McKinney will be arriving this evening in Calgary and speaking publicly, and hopefully testifying on Wednesday.

The big question before the judge is whether his court is a court of law, a court serving those with great political power, a court serving the cause of justice and accountability, and whether global public opinion bears any weight or is paying any attention to this case.

Judge Manfred Delong shut down the trial of Splitting The Sky versus George W. Bush on the second day of proceedings. The court denied STS his frequently emphasized request to have two witnesses give evidence in his defense. Those witnesses were myself and Cynthia McKinney. The trial came to an end just as Ms. McKinney arrived in Calgary from London. The US-based oil conglomerates active throughout Alberta form the core business constituency of the Prime Minister Stephen Harper, who represents a Calgary riding in Parliament.

The court accepted two documents as evidence for the defense. On is Gail Davidson's widely disseminated legal opinion for Lawyer's Against the War. STS and I studied this document closely in the days leading up to my friend being arrested for his arrest attempt. LAW's legal opinion highlighted some of the evidence, statutes and treaties to brand Bush as a "credibly accused war criminal" that should not be allowed into Canada. Prior to Bush's touching down in Calgary to address an audience of oil executives, Davidson's documemtation was distributed widely to officials of the Harper government and Canada's Royal Canadian Mounted Police.

The other exhibit for the defense was my own paper that I originally presented at an invited academic venue at the University of Winnipeg. It has been published under a variety of titles on the Internet, including at Global Research.ca, 911 Blogger.com, 9/11 Truth.org and Voltairenet in both French and English. My initial title for it is "Bush League Justice: Should George W. Bush Be Arrested in Calgary Alberta and Tried for International Crimes."

Delong will deliver his ruling on June 7. The case for the prosecution both revealed and obscured much about the new police strategies being employed throughout North America to monitor, manage, divide and spin doctor demonstrators seeking to call attention to their political dissent. In my opinion the Crown's chief agent of prosecution, Tracy Davis, acted more as an advocate and defender of the police rather than as a representative of the Canadian people through Her Majesty as she is required to do according the constitutional tradition of the British Commonwealth.

Thanks Tony Hall for the report. Sentencing. Any predictions? It seems to me that as much publicity about the "state trying to cover up and bury under the carpet, this issue" as possible should be put out. I believe this silly US politician that was recently up north, that had made incendiary comments about CAN health care, was like a red herring or a crash test dummy, as part of this effort to hegemonize the north here to that stars and stripes of capitalism.
The #1 priority is always justice and in this case that Dac is free healthy safe and sound, and #2 that common people at the bottom understand that they can change things and that Bush and no criminal is invincible. Cheers from "la Otr@ in Mexico, and the Zezta in Wetaskiwin-Edmonton.

Here the R.C.M.P and the courts in Canada are totally guilty of arresting innocent Canadian Citizen, and allowing a known war criminal into Canada. That is betrayal of the anti-fascist side which made the international and national laws that the western world is signed on to and in fact the majority countries of the world.

NUREMBURG TRIALS (1945) Chaired by U.S. Judge Jackson makes international law as such, that the planning and doing of aggressive war is the supreme international crime on the planet earth as it actuates all other crimes high, low, big and small. Further he says that it is the supreme international crime on earth whether Germany does it or the U.S.A. does it.

It is at this point that Splitting the Sky actually is upholding the anti-fascist covenants because it has been proven time and again throughout the various courts around the world, that George W. Bush as President and therefore the Commander-In-Chief of the U.S. armed forces did lie, and decieve the people of America and the world about the need to go to war agains Afghanistan and Iraq. No countries in the middle east threatened the U.S.A. The U.S.A. however on false pretences did plan aggressive war and attacked numerous countries in the middle east, while lying the there was imminent threat of nuclear war from them. There were no weapons of mass destruction, nor was there any threats from Afghanistan. The General Secretary Kofi Annan also commented that the U.S. violated and United Nations Charter by attacking members of the United Nations.

It was the U.S. Oil monopolies through the C.I.A. that lied and turned truth on its head. As early as April 2001 the U.S. paid the Taliban 66 million dollars to stay in power in Afghanistan, however, in the summer of 2001 they told their client Taliban that they must build a Caspian basin originated oil pipeline through their country to the sea. When the Taliban refused because it would then be all U.S. owned, the U.S. Imperialist system told them that if they did not build it they would be bombed and a more compliant governance would be put in its place. The Taliban still refused and the bombs began falling in October of 2001.

Remember all the planning for that attack originates and is carried out by the United States aggressive military under George W. Bush. The U.S. planned and did the aggressvie war crime, which is characterized by Canadian Law and International Law as the supreme worst sort war crimes possible on the planet earth. That is the material fact of the case. That proves that Splitting the Sky is not guilty of any crime but is trying to bring justice to the peoples of the world and Canada and the United States. He should be commendated not arrested.

There is in Spain for the next three week a Spanish Investigation of U.S. war crimes in Afghanistan, and Iraq, Just now the Spanish Judge is hearing the victims and the evidences on film and from others concerned and witnesses to the crimes and atrocities presently going on in those two countries by the U.S. Imperialist led camp. It has all the evidence it needs to bring war crimes inditements on George W. Bush and Dick Cheney, and fully intends to implement the justice to those and that administation.

The world court of the hague, the international criminal court, has found the U.S. Goverments aggressive wars against the peoples of the middle east guilty of numerous war crimes most notably and obviously, 1 the targeting and killing of civilians, 2) the torturing and killing of prisononers of war, 3) collective punishment the bombing and droning to rubble of numerous villages, towns, and cities throughout the area known as the middle east the erstwhile Holyland of the world.

Around the world where there are other numerous aggressive wars launched by the U.S. Imperialists there is other courts such as the internaitonal war crimes tribunal (Bertrand Russell style) that has found huge war crimes committed along with the killing of five million Indo-Chinese, and the acute and chronic poisoning of five million. These war crimes have yet to be addressed fully and the world awaits the day when all these crimes against humanity and cruel and unusual punishment will be brought to full extent justice of the world's international and national laws. U.S. Imperialism is guilty of the worst sort of war crimes possible on the planet. Splitting the Sky knows that truth, and is only acting in good concious to bring justice to the war criminals.
