Response from Secretary Shelley on the Disenfranchisement of Terry Baum Voters
A response from California Secretary of State Kevin Shelley re: the SF Dept. of Elections' disenfranchisement of Terry Baum voters.
Thank you for your email. Secretary of State Kevin Shelley has asked the Elections Division to respond.
California elections law section 15342(a) specifically requires ". . . no write-in vote shall be counted unless the voting space next to the write-in space is marked or slotted as directed in the voting instructions." When tallying write-in votes, San Francisco must abide by that provision, unless a court of competent jurisdiction orders them to do otherwise. Elections officials are as bound by the law as any other citizen of this state, and, however much they may want to, cannot count votes that do no meet its requirements.
