2/9 Medical Marijuana: Appeal of Conviction

Since his first appearance at a federal hearing he has
continued to dispute the government's jurisdiction in
his cultivation of marijuana in California for
California patients at his private domicile.
Here is the update about Keith Alden, who was
sentenced on July 11, 2002 to federal prison for the
cultivation of marijuana in California for himself and
other California patients.

URGENT NEWS: Keith Alden's Appeal to the 9th Circuit
has been scheduled as a public hearing on Monday,
February 9, 2004 at 9:00 at the
U.S. Ninth Circuit Court

His is 9th Circuit Case No. 02-10356 and Dist. Case
no. CR01-0202 MJJ.

Keith Alden is presently at Camp Sheridan in Oregon.
He is focused on researching case law for his appeal,
studying for a paralegal certificate, taking
landscaping classes and gathering sentencing reduction
merits in substance abuse classes.

Federal Public Defender Karen Landau is serving as
Keith's counsel in his pro se defense.

Since his first appearance at a federal hearing he has
continued to dispute the government's jurisdiction in
his cultivation of marijuana in California for
California patients at his private domicile. Judge
Martin J. Jenkins did not agree with him at the
District Court hearing, however, Judge Jenkins also
did not agree with Angel Raich and Diane Monson in
Raich v. Ashcroft and his decision was reversed by the
recent 9th circuit court ruling on Dec. 16, 2003.
