Judge Overrules Gov't Lawyers, Provides Text of 1st & 4th Amendments to Deliberating Jury
The jury is in the midst of deliberations in the Judi Bari v. FBI/Oakland Police trial.
The jury sent two requests to the Judge this morning, 1) for an explanation why defendants and FBI agents Hemje and Conway were dismissed from the case, and 2) for the full text of the 1st and 4th amendments.
For the first request the judge stated only that the agents were simply no longer defendants in the case. Meanwhile US Dept. of Justice and City of Oakland lawyers made a motion to deny providing the text of the 1st and 4th amendments to the jury; Judge Wilken, however, has overruled them and the jury is now able to take into account the constitutional issues argued by lawyers for Judi Bari and Darryl Cherney.
