Logging Protesters Take A Breather

about to tackle second-growth redwoods in the Freshwater Creek area there has been a period of respite for direct action defenders of these venerable trees.
<p><center><b>Logging Protesters Take A Breather </center></b></p>
<p> With Maxxam’s Pacific Lumber having logged much of old-growth Douglas fir in the Mattole River watershed and about to tackle second-growth redwoods in the Freshwater Creek area there has been a period of respite for direct action defenders of these venerable trees. </p><p>The
Mattole Forest Defenders and Earth First! supporters tried to preserve the trees with their bodies, and in the process more than 55 were arrested for trespassing in May & June by county sheriffs on behalf of PL. The charges varied from simple trespass, to trespass with intent, or lockdown. So did the penalties. The judge in the
civil case against the protesters simply issued an Injunction and a TRO (Temporary Restraining Order). But subsequently they were served with the SLAPP (strategic lawsuit against public participation). The intent of both is to forbid people going on PL land for a set period of time. Some accepted a swap of working for
a community service instead of jail time. This involved paying the county for time spent. </p>
<p>As of this writing, there has not been any arrest for 2 or 3 weeks and only 2 in jail Jeff Nyhan and Kim Starr. Kim, a Jewish vegan who refused probation, received the maximum sentence of 120 days (49 of which have already been served). Kim has filed for a writ of habeas corpus on grounds the jail is violating her constitutionally-protected religious beliefs as it pertains to her religious dietary requirements (namely refusing to serve her vegan food).</p>
<p>Posters notes...In one of the forest defenders recent trials, the jury came back in a 8-4 verdict against the forest defender for trespass resulting in a hung jury. </p>
<p>KMUD news reported that in the active Devil's Hole Timber Harvest Plan near Rainbow Ridge, a baby golden eagle was discovered and that Fish and Game was investigating the area for a nest of the critter. Apparently, the biologists overlooked this critters home.</p>
<p>Forest Defense remains strong with a group of dedicated people maintaining a backwoods presence while they await the decision on several timber harvest plans being routed through the CDF process. </p>
