Today the 9th Circuit Court of Appeals denied the en banc petition for rehearing by the controversial Drakes Bay Oyster Company. Notably, not a single member of the Appeals Court found DBOC’s legal case persuasive enough to vote on whether to rehear DBOC’s case: “The full court has been advised of the petition for rehearing en banc and no judge has requested a vote on whether to rehear the matter en banc.”
