 in support of constitutional rights to public education that will be denied 
 under SB 277. The rally will take place at 1:00-2:30pm on Friday May 15th 
 outside of Senator Wieckowski's district office at 39510 Paseo Padre 
 Parkway, Fremont, CA 94536. Parents are dismayed with California Senate 
 Bill 277, a proposed legislation being voted on this week that would take 
 away parents' constitutional rights to make medical decisions for their 
 families and deny children access to public education. Senator Bob 
 Wieckowski (District 10) co-author of the bill, referred to an archaic 
 110-year-old court case and asserted that the "parens patriae" doctrine 
 would allow "The police power of the state... absolute authority to force 
 that person-even adults-to get the vaccination....We undervalue our 
 power--the state police power. .. [The state can] go into this domain of 
 family rights, which are not absolute, and my question is: maybe we are not 
 going far enough?" In effect, Senator Wieckowski denied the legal doctrine 
 of medical Informed Consent in favor of coercion and argued that children

 Paseo Padre Parkway, Fremont, CA 94536. \n\nLocal parents are dismayed with 
 California Senate Bill 277, a proposed legislation that would take away 
 parents' constitutional rights to make medical decisions for their families 
 and deny children access to public education. SB 277 has been fast-tracked 
 out of three committees and is being moved to a Senate floor vote this week 
 despite the opposition of thousands of California parents across party 
 lines. Senator Bob Wieckowski (District 10) is a co-author of the bill. In 
 his statement at the CA Senate Judiciary Committee hearing on April 28th, 
 Wieckowski referred to an archaic 110-year-old court case and asserted that 
 the "parens patriae" doctrine would allow "The police power of the state... 
 absolute authority to force that person-even adults-to get the 
 vaccination....We undervalue our power--the state police power. .. [The 
 state can] go into this domain of family rights, which are not absolute,

 California pointed out in their 4/2/2015 statement of concerns about SB 277 
 that they "do not believe there has been a sufficient showing of need at 
 present to warrant conditioning access to education on mandatory 
 vaccination for each of the diseases covered by this bill… unlike other 
 states, public education is a fundamental right under the California 
 Constitution, and equal access to education must therefore not be limited 
 or denied unless the State demonstrates that its actions are 'necessary to 
 achieve a compelling state interest… [T]his bill does not declare what 
 this interest might be, nor does it explain why denying students access to 
 education is necessary to advance that interest. If there is, in fact, a 
 compelling governmental interest in mandating that all students in every 
 school be vaccinated against each of the enumerated diseases except for 
 medical reasons, the bill should be amended to explain specifically what 
 that interest is, where it exists, and under what conditions and 
 circumstances it arises."

 \n\nAccording to the most recent jurisprudence on public health and law, in 
 the last 100 years, "Public health and constitutional law have evolved to 
 better protect both health and human rights. States’ sovereign power to 
 make laws of all kinds has not changed in the past century. What has 
 changed is the Court’s recognition of the importance of individual 
 liberty and how it limits that power. … Public health programs that are 
 based on force are a relic of the 19th century; 21st-century public health 
 depends on good science, good communication, and trust in public health 
 officials to tell the truth. In each of these spheres, constitutional 
 rights are the ally rather than the enemy of public health. Preserving the 
 public’s health in the 21st century requires preserving respect for

 \n\nThe CDPH reported earlier this year California vaccination rates are at 
 or near an all time high and well on track to meeting statewide 2020 goals. 
 CA rates for individual vaccines are higher than national rates. There is 
 NO vaccination crisis. With Personal Belief Exemptions falling by 20% this 
 school year because of AB2109's informed consent procedure, this draconian 
 law is unnecessary. We're not in the middle of an epidemic today. The 
 Disney outbreak primarily affected adults, many of whom were vaccinated 
 with MMR. CDC and WHO data all show that the 10 diseases required for 
 school entry are not immediate risks to public health or to school-aged 
 children. There's simply no justification or modern legal precedent for 
 such blatant disregard for family rights and our children's constitutional 
 right to education. Suggesting a "Police State" to enforce 34 mandatory 
 vaccines for ten diseases - some of them for non-communicable diseases - as 
 a condition for children being admitted to school violates constitutional 
 rights and liberties. Parents demand INFORMED CONSENT, NOT COERCION.
