The Chico Decision-Hope for the Homeless in Santa Cruz
The grim news of sweeps removing homeless-run encampments in Sausalito and San Rafael, as well as the RV rousts in Seaside, in recent weeks is now counterbalanced by a ray of light from a federal court in the Warren v. City of Chico case, which I transcribe here....

Sounding a Warning in the Benchlands and the Broader Community
On Tuesday, the Federal magistrate Susan Van Keulen ended federal protection of the Benchlands surivival campground for the last 6 months by dissolving the Injunction issued in January. I've been passing out flyers there regarding upcoming meetings to resist the dispersal order City authorities that will inevitably follow in the months ahead replete with false promises....

Judge Dumps Benchlands Survival Camp, Ignores Shelter Emergency
The federal court ignored the City Manager Bernal's failure to fulfill the terms of the modified Preliminary Injunction to meet regularly with the Homeless Union to improve Benchlands conditions. Magistrate Susan Van Keulen lifted the Court's protection of the encampment Tuesday afternoon, discarding more than several hundred people into the City's predatory "care"....

Real Struggle to Support Survival Camps While Council Gentrification Juggernaut Grinds On
Community focus must shift from the prefabricated public-excluded City Council meetings to direct action and legal support to defend the many survival encampments (Meyersvilles) that have sprunt up around Santa Cruz as emergency housing....

Saying No to the "Punish the No-Permit Protesters" Law
Keith McHenry's Food Not Bombs facebook page has a one sentence descriptive protest against the permits-for-protest law. Its 2nd reading is coming up as item #40 at City Council on the June 22nd afternoon agenda. Likely around mid or late afternoon. I also include Keith's quoting of some sections of the law, and my earlier commentary on the law from 2013....

Chico Shines a Light, But Activists Here Must Do the Heavy Lifting
Down Chico way, a Senior Sacramento Judge of the Eastern Division of the Federal District Court has stopped encampment sweeps dead in their tracks city-wide with a TRO in the Commanche Creek Greenway case. This was justified not by the fading COVID-19 shelter-in-place concerns, but rather by lack of shelter or campground alternatives for those being rousted....

Modified Injunction is Bad News for the Unhoused; Prepare to Resist Now, or Regret Later
Judge Susan van Kuelen's March 30th modifications in the 1-20-21 Preliminary Injunction previously protecting the San Lorenzo Survival Campground was published April 1st. It allows a week or two relief, if that, before the unhoused population faces restored confinement or persecution....

Judge "Relocates" San Lorenzo Survival Campers
At a status hearing on March 30th, Federal Magistrate Susan Van Keulen bought the City Attorney's restrictive and repressive plan to relocate the San Lorenzo Park residents to the Benchlands, and move those currently in the Benchlands, first to San Lorenzo Park and then...to nowhere....

Latest Assault on the Unhoused Community
Of uncertain use is this critical itemizing of the City Council's latest work-around to eliminate homeless civil rights without running afoul of the Martin v. Boise decision requiring no criminalization of the homeless for survival camping where adequate resources do not exist. And the CDC's obvious "shelter-in-place" rules ignored by City Manager Martin Bernal....

Return of the Sleeping Ban and a Letter to Mayor Meyers
On February 23, City Council ignored dozens of speakers, silenced another two dozen, and passed the TOLO (Temporary Living Outside Ordinance) well after midnight. I filed a Brown Act complaint, noting the failure to provide adequate Agenda notice, requiring them to redo the item. I'm not holding my breath....

Two Victories on January 20th: San Lorenzo Park Residents and RV Dwellers on Riverside
Joint community direct action and legal pressure prompted two victories this last week for unhoused folks in Santa Cruz. In-person physical support on Riverside St. and at San Lorenzo temporarily thwarted the standard "move out and hide out" strategy of both the Public Works Department and City Manager Martin Bernal....

TRO Extended Another Week; Homeless Removal Squad Seeks More Pretexts
Federal Magistrate Susan van Keulen granted a last minute motion from City Attorney Condotti delaying any decision and/or hearing on the San Lorenzo Campground until January 20th, allowing both the SC Homeless Union Survival Supporters and "Save the Grass; Screw the Homeless" attorneys to present more evidence and argument to sweep the park....

Working on a History of Protest Power Around Shelter and Sweeps in Santa Cruz
In light of the current community support for the San Lorenzo Survival Campers, I thought it might be helpful to post a partial history of the changes and services created by protest and direct action in the past. I distributed this flyer at the Park today. If Chief Mills word is to be believed, the protests Monday have already extended the Final Sweep "Solution" deadline to late January....

Educating the City Manager (and his Neighbors)
On December 20th and 21st, Santa Cruz Union activists demonstrated and spoke in front of City Manager Martin Bernal's suburban house at 96 Brookwood Drive. Bernal's police have begun demolition of the San Lorenzo survival campgrounds destroying tents, gear, and other property. In winter weather, with no winter shelter, defying a shelter-in-place CDC order--Bernal's decree raised much outrage....

Next Steps in Fighting the Anti-Homeless Sweeps?
An outreach demonstration today on Pacific Avenue seeks to gather perspectives and supporters for a sane and fair solution to the Winter Shelter crisis. The crisis has been provoked and intensified by City Manager Bernal's Sweeps, the overboard powers granted him by Myers' City Council, the lack of any walk-in shelter, and the police destruction of homeless gear in violation of the Boise v. Martin "no tickets without shelter" decision....

Missing Documentation on San Lorenzo Camp Extermination to Remain Missing
I sent the following Public Records demand to the City Administrator/Clerk on 12-17 regarding the abrupt and toxic shutdown of the San Lorenzo Campground displacing 150-200 people. I received a reply that City offices would be "closed for the holidays" until January 4th -but City Mangler Bernal has set January 6th as the date for completion of the destruction of the shelter-in-place camp....

Homeless Dead in Santa Cruz County 2020
This is the list given out at the on-line 2020 Homeless Memorial on December 17, 2017, sponsored by Housing Matters, the Santa Cruz County Homeless Persons Health Project, Wings and the Salvation Army. It was updated for the in-person Memorial held today at the Food Not Bombs meal location at Front and Laurel Sts....

"Clear 'em Out" Cruelty as Usual: Deportations Slated from San Lorenzo Park
City Manager Martin Bernal and Parks and Recreation Boss Tony Eliot are expanding an existing crisis in San Lorenzo Park. Staring Monday December 21st, they have announced they will begin removing unhoused survival camps there with no shelter destination. Community activists Alicia Kuhl and Peter Gelblum have published their responses to this latest insanity....
