Sen Sanders Joins 99 Senators for Israel; Supports Ann Coulter's Fascist Speech

On April 27, 2017, all 100 US Senators, including Bernie Sanders, signed a letter initiated by Sen. Mark Rubio to the UN supporting Nazi Trump’s UN Ambassador Nikki Haley’s statement that “It is the UN’s anti-Israel bias that is long overdue for change.” This comes as 1500 Palestinians are on a hunger strike in Israeli prisons, protesting the horrifying conditions that are a clear violation of international law. This came a few days after Bernie Sanders condemned the protests of fascist Ann Coulter who had been allowed to speak at a public university, UC Berkeley, by the local fascist Republican Club, as part of the fascist invasion of Berkeley under the phony umbrella of free speech, which free speech is never supported by any Republican Club.

The free speech lesson is: No one has a right to falsely yell fire in a crowded theater. Fascists, by definition, are falsely yelling fire since they always scapegoat victims for the problems of the private profit system in which we live. Thus, there can be no free speech for hate speech. When it comes to what fascists, who always despise free speech, have been doing in Berkeley, the issue is not free speech but a fascist invasion of Berkeley.

Since we continue to hear from Sanders’ supporters, we have to continue reminding everyone exactly who Bernie Sanders is. These latest outrageous positions are nothing new with Bernie Sanders, a long time supporter of military contractors in Vermont and everywhere else. Sanders also supported the war machine and the racist, anti-workingclass prison system:

* The sending of U.S. military units to Kuwait and Saudi Arabia to threaten Iraq because “we cannot tolerate aggression”
* The objectively racist and mass-incarcerationist Federal Crime bill.
* Every US intervention since elected to Congress–Iraq, Somalia, Haiti, Bosnia, Liberia, Zaire (Congo), Albania, Sudan, Afghanistan and Yugoslavia.

More recently, Sanders has joined in promoting the lies about Syria and in the anti-Russian hysteria of the bankrupt Democratic Party. It was well-established that Trump’s fraudulent victory was perpetrated by tossing the black vote, the same as the Republicans did in 2000 and 2004.

While I agree with the author over all, I would like to address the author's quote that "no one has a right to falsely yell fire in a crowded theater" because this quote often gets misapplied simply because people don't know the history behind it.

That analogy was used in Schenck v. U.S. in 1919 which did not involve fires at all. Schenck had distributed flyers encouraging readers to resist conscription. The court in Schenck used shouting fire in a crowded theater as an example of creating a clear and present danger. Clear and present danger became the standard by which to determine under what circumstances limits can be placed on First Amendment freedoms of speech, press, or assembly.

The "clear & present danger" standard held until 1968 until the Brandenburg v. Ohio, a KKK case. The Court overturned the Schenck decision that had introduced "shouting fire in a crowded theater." No longer was "clear and present danger" a sufficient standard for criminalizing speech. To break the law, speech now had to incite "imminent lawless action." Now having said that it is possible that recent circumstances such as Ann Coulter's Berkeley visit and Milo Y's recent visit to Berkeley and Sacramento earlier that by the very nature of what they represent and intended to do such as created lawlessness and what Berkeley has long represented that their speech may have risen to the "imminent lawless action" standard. I do not know as I was not there.
