Homeless advocate Dr. John Colby files color of law complaint against Mayor Don Lane

Disabled homeless advocate John Colby filed a color of law complaint this morning against Santa Cruz Mayor Don Lane for segregating him from the community by not forcing the Santa Cruz Police Department (SCPD) to protect him against Take Back Santa Cruz (TBSC) death threats and now silencing him from exercising his Free Speech rights and his right to petition the government for a redress of grievances.

Dr. Colby made a minor request that his sister Patricia Colby be given two minutes to read letters in the open speaking session of City Council meetings about the SCPD denying him protection, about City Attorney John Barisone denying him written explanations and about the City Council (except for Micah Posner) and City staff aiding and abetting TBSC hate crimes.

Mayor Lane — for no good reason — denied Dr. Colby's request, allowing him to allocate two minutes (inexplicably) for someone other than his sister to speak on his behalf.

Dr. Colby immediately emailed a color of law complaint to the San Francisco FBI Duty Agent against Mayor Lane for abusing his position of authority to violate Dr. Colby's civil rights, to segregate Dr. Colby based upon his disabilities, and to silence him from being an engaged, effective citizen (to speak out in a public forum on Community Television about City crimes, fraud, abuses of power and public corruption).

re: Filing color of law complaint against Santa Cruz Mayor Don Lane

Dear Duty Agent:

Last night or the night before, I left voice messages for Santa Cruz City Council-member Micah Posner (who I call as a witness) and Santa Cruz City Clerk Administrator Bren Lehr (whom I also call as a witness).

I asked — because denial of protection by the Santa Cruz Police Department (SCPD) in response to (death) threats made against me by Take Back Santa Cruz (TBSC) member Tom Cunniff and other individuals have falsely imprisoned me, segregating me from the community based upon my disabilities, shutting down my advocacy for disabled (homeless) people and preventing me from exercising my Free Speech rights — so that my sister Patricia Colby be allocated a mere two minutes on my behalf, so she could read a letter from me to the City Council, the City Attorney, the City Manager, the council audience and the public via Santa Cruz Community Television. I explained that this was necessary to fully exercise my Free Speech rights, my right to petition the government for a redress of grievances, and also to exercise my disability rights to not be segregated from City Council meetings and from the wider community.

It was a very small request. 

Santa Cruz Mayor Don Lane is clearly retaliating against me for exercising my civil rights and for petitioning President Obama and the U.S. Senate to come down on him, the City Council (excepting Micah Posner), the City Attorney, the City staff and the SCPD for reasons presented in previous emails (which you were carbon copied).

Essentially, Mayor Don Lane is denying me the right to be an (engaged) citizen, to protect my civil rights and the civil rights of others. He has aided and abetted — as described in previous emails — me being falsely imprisoned in my residence threatened by TBSC stalkers and potentially SCPD officers colluding with them.

Demand: immediately investigate Santa Cruz Mayor Don Lane for abusing his position of authority to deny me my constitutional and civil rights so that an impartial U.S. attorney may prosecute him (to the fullest extent possible under federal law).

Mayor Don Lane has imprisoned and silenced me! This is completely unacceptable!. He has dictatorially abused the powers of the state to punish me. He must be held accountable so no other government official considers committing the heinous acts he has committed against my sister, I and my disabled clients.

Thank you for your immediate action to protect my rights, the rights of those associated with me, and to protect our health and safety.

I spoke to the Mayor regarding your request to have your sister read into the record, during oral communications, on your behalf, letters that you write prior to City Council meetings.
 
He suggests that you send your letters to citycouncil [at] cityofsantacruz.com. When correspondence is sent to this email address, all councilmembers and any appropriate staff members will have access to your letters and respond appropriately. Any correspondence that goes to this email address is also logged into public record.
 
He also suggests that if your sister is unwilling to give up her time to speak during oral communication to read your letters that you ask someone else to read your letters, on your behalf, who is not going to speak during oral communications. Thanks!
