Local ACLU Issues Resolution of Support for Santa Cruz 11
SANTA CRUZ COUNTY CHAPTER OF THE ACLU OF NORTHERN CALIFORNIA RESOLUTION OF SUPPORT
WHEREAS, The Santa Cruz County Chapter of the American Civil Liberties Union of Northern California (ACLU Santa Cruz County) believes that all four remaining defendants charged in the Santa Cruz Superior Court action collectively known as the “Occupy” cases, i.e., Gabriella Ripley-Phipps, Cameron Laurendeau, Franklin Alcantara and Brent Adams, are local activists working for social and economic justice; and
WHEREAS, ACLU Santa Cruz County believes that the constitutionally guaranteed rights to freedom of speech and peaceful assembly are essential to a functioning democracy; and
WHEREAS, ACLU Santa Cruz County believes that the defendants' exercise of these constitutional rights are being seriously threatened by the continuing prosecution of these cases; and
WHEREAS, ACLU Santa Cruz County believes that the right to due process under the law has been substantially abridged by the government’s failure to bring this two and one half year old prosecution to a speedy resolution; and
WHEREAS, ACLU Santa Cruz County believes that the criminal offenses which were charged by the Santa Cruz County District Attorney are overbroad and overreaching in consideration of the facts; and
WHEREAS, ACLU Santa Cruz County believes that these defendants are being selectively prosecuted in that evidence shows that nearly 300 separate individuals were present in the building during the 75 hours of the occupation and yet only four defendants remain subject to prosecution; and
WHEREAS, ACLU Santa Cruz County believes that basic principles of fairness and justice guaranteed by the United States Constitution require that the enormous power of government be exercised fairly and even-handedly and not be based on the identity or past actions of the defendants:
THEREFORE BE IT HEREBY RESOLVED THAT ACLU Santa Cruz County calls for the immediate dismissal of all charges presently lodged against the four remaining defendants.
