Perjury Accusations and Mayor Ed Lee: Richmond District Democratic Club's Statement

Tonight the Richmond District Democratic Club voted to overwhelmingly pass the following resolution statement. We had ten voting members present. The vote carried with 8 Yes votes, 0 No votes, and 2 abstentions.

We have been working on this for some weeks now and in light of today's decision put forth by the Ethics Commission, we feel that it could not come at a better time. This resolution will be sent to District Attorney George Gascon, the San Francisco Ethics Commission, The Mayor's Office, and to any chartered Democratic club or organization who wants to adopt it for their own sponsorship. We are also looking into the Civil Grand Jury and Department of Justice in case it isn't honored by the City and County of San Francisco.

"The Richmond District Democratic Club, a Democratic County Central Committee chartered club, believes that the people of San Francisco should be able to expect all elected officials to follow the highest ethical standard. We further believe that such ethical standards must be enforced consistently and without the appearance of political motivation and that the enforcement of these ethical standards should be made without embellishment of the facts, especially when the result may lead to the removal of a democratically-elected official from office.

We absolutely acknowledge the seriousness of, and in no way condone, domestic violence involving any person. Furthermore, we are not minimizing any accusations against Sheriff Ross Mirkarimi in an attempt to be biased against Mayor Ed Lee. It has typically been our stance to not enter political entanglements, but instead to focus on educating our community about policy and empower the people of the Richmond District to take part in the democratic process. As a result, it has been our club's position to allow the process of Sheriff Mirkarimi's removal to unfold in the appropriate venue.

We hereby request a formal investigation into the allegations that Mayor Ed Lee committed perjury in his Ethics Commission testimony regarding his removal of Sheriff Ross Mirkarimi from office, by the San Francisco District Attorney. Should the San Francisco District Attorney not pursue said investigation, we then request that an investigation be undertaken by a government agency other than the City and County of San Francisco."

City Hall bomb threat during testimony

During the Ethics Commission hearing on Friday, June 29, 2012, following the Mayor's testimony in which he allegedly committed perjury by saying he had not consulted with anyone on his decision to remove Mirkirimi,[28][29] the Ethics Commission Chair announced that the hearing was being suspended and the room would need to be cleared immediately, without further explanation, while Mayor Lee’s security detail escorted the Mayor out of the room. Although the SF Examiner later reported that a "high-priority call" which was a bomb threat had come in "at almost exactly the same time that Lee began to testify", at 1:06 p.m., the cross-examination of Mayor Lee by attorney Shepard Kopp was not interrupted until 1:28 p.m., 22 minutes later.[36] None of the other estimated 900 people in San Francisco City Hall were told to evacuate, despite the claim that a bomb threat had been made on the building. City Hall building manager Rob Reiter said that, "One of the things we were trying to do was not to induce panic". A second reason, according to Reiter, was that San Francisco Sheriff's staff had reported that the explosive device was planted outside City Hall, possibly in the hedges or in a car, and so Reiter said that he didn’t want to risk sending people into a potential danger zone when exiting the building.[37] No explanation was given as to how the Mayor knew where to exit the building. One report suggests that Lee was seen going to his second floor City Hall office, closing the door, and did not re-appear in public for at least ninety minutes.[38] The hearing resumed at 3:01 p.m.

There were also allegations of money-laundering by the Ed Lee campaign, in collaboration with a notorious eviction strongman, Archway Property Services, which terrorized tenants at apartments owned by CitiApartments. Archway asked its employees to contribute $500 each to Lee's campaign, claiming they would be reimbursed.

All of us can and should call all 11 members of the Board of Superivisors to demand they reinstate Sheriff Mirkarimi. Sheriff Mirkarimi promised to stop the evictions and foreclosures and as sheriff, he can also stop election fraud. His supporters are proud of his ability to stop crime with rehabilitation programs. Election Fraud, perjuring Ed Lee and his ruling class patrons have misused women to promote the real estate profiteers. The one No vote to the phony charges on the Ethics Commission was from Ben Hur, appointed by Assessor Phil Ting, who blew the whistle on the phony foreclosures in San Francisco. Ben Hur is a plaintiff's attorney at Keker & Van Nest. The contrast with him and Paul Renne, the corporate attorney from Cooley Godward and husband of former City Attorney, Louise Renne, says it all about this Ethics Commission, as the rest of the political appointees are clearly the same as Renne.

We have made progress due to massive public protest. All of the phony domestic violence charges were dropped for the vague false imprisonment misdemeanor. The 5 political appointees on the Ethics Commission would certainly have voted to support all the phony charges if there were no public protest. Instead, 4 of them went for the unconstitionally vague “conduct that falls below the standard of decency, good faith and right action impliedly required of all public officers.” By that standard, jaywalking could be a misconduct charge. All Ross did was, while seated in the parked car in his seat with the seatbelt on, reach to the back of the car and touch his wife's arm, causing a slight bruise. This is not even domestic violence; this was a marital argument which marriage needed counseling. It is very clear that this is a political frameup by the real estate interests of a Sheriff who will stop evictions and foreclosures. We certainly need someone to stop the epidemic of shootings in town. In 2012, there have been at least 45 shootings so far. Call, fax or write all 11 members of the Board of Superivsors. You can leave a voice message at any time. Tell them to reinstate Sheriff Mirkarimi. We only need 3 votes to have him reinstated, with all his back pay and benefits that have been denied him since March 21, 2012.
