This will be Gabe's first hearing facing a number of charges stemming from an April 9th incident at the BART Board of Directors meeting, where he allegedly threw red paint on Dorothy Dugger and disrupted the meeting. OK Gabe – I accept your apology:

“I have decided to take full responsibility for my actions and I want people to know that I had acted on my own accord. I know that some people are upset with me because what I did was not in consensus with the rest of the group. For this I am sorry, but I want people to realize that what I wanted to do, I could not share with the entire group, and I could best carry out and execute my action, without risk of detection, by myself. I have accepted the consequences and am willing to do the time. . .”

I was at the board meeting but had to go to work . . . so i left just before you did the paint thing.

I think you made a mistake and I'm glad you apologized.

Of course you are going to suffer the consequences and of course i hope you’ve taken the whole thing to heart and learned a huge lesson.

If you had told the NJNB folks you were going to do the paint thing they would have tried to discourage you and i really think you know that would have been the outcome of any disclosure you might have made to them. Individualism in a collective effort under those circumstances is COUNTER PRODUCTIVE.

I hope you learn that radical/symbolic acts need to be focused and wisely directed in terms of time and place as well as correct targets.

I only wish you had done it when Dugger was making a statement at a press conference or some such thing and not when a movement organization was making a little head way in their demand. Actually I wish it had been a pie in the face at a more appropriate time.

Hey Curious,
thanks for asking. This was my first appearance and it was really brief. I still did not make a plea because I did not have any counsel with me. At my next appearance I will have a public defender and I will make a plea. I won't be suprised if an offer is presented to me at that next appearance as well. Anyways, if people want to come out and support me: the hearing will be on May 22nd at 9AM in dept. 104 at Wiley M. Manuel Courthouse in downtown Oakland on 7th street next to the jail and OPD headquarters.

So hopefully people can make it out

Also: On a bad note, I noticed that some of the comments that were posted on a video that Dave Id posted of me being arrested at the board meeting were taken down by Indybay. I tried to post some comments asking why the other comments were taken down, and my postings were taken down. Really, no BS. This is really troubling if things are going to be censored on Indybay. I posted another comment and it is up for right now, but who knows how long that will stay Who knows how long this will stay up. =(
